Mayor Weigand called the Meeting to order and asked f or Roll Call: ROLL CALL 1 Bodan , Present Cush ing , Present McCabe , Abse nt Parker, Pr e sent Purce ll, Absent Rapp , Present Robohm, Present Weigand, Present Wright, Pre sent Pre sent : Bevan Absent: Two Clerk read the call as follows: •The Meetin g is calle d f or the purpose of c onsidering Water distributors contract with the Valley Development ~anpany, and consideration of resolution to approve relocation a nd p iping of Denve r City Ditch in Bates Avenue and Clarie..§treet.• . ------ City Attorney Banta read the contract with Va lley ~evelopment Co :--.pany and then presented and read the followi ng resolution: RESOL UTI O N WHEREAS, VALLEY D .VELOPMENT COMPA NY beinr, desirous of' obtai n ine the service and facilities of the water system o f the City o f !nglewo od , Colorado, did by lett er dated March 17, 1955, propose to the City of J:.nglewood, Colorado that such water service be made available under a distributor's contract to be ex ~c ut e d by it with the City of Englewood, Colorado, and in return for VB.ter service the Valley Development Com pa ny proposed to sell to the City of Englewood , Colora~ approximately thirteen shares of Nevada Ditch stock at a price or Two Thousand and no/100 ($2 1 000.00) dollars per sha reJ also the first ri ght to purchase at the same price any additional Nevada .Uitch stock acquired by Val ley Developnent CompanyJ also the first rtght to purchase tiny Brown Ditch wa ter own e d by Valley Developnent Company at a price to be agreed upon, and further to turn over, withou t charge, to the Ci1:1Y ot Engle wood, Co lorado, three water wells i r clu din g pumps, pumping equipment and water line to Union Avenue tntake o f the City, which wells will pump approximately 3 1 000 gallons per minute J and WHEREAS , in the opinion of the City Co u ncil o f the City of Englewood, Colorado, it is deemed advisable and t o the best i nterests o f the City to acquire additional sources or water under the terms of the proposal of Valley Devel opment Company and as noted aboveJ and WHEREAS, the Valley Deve~nt C om~a ny and the Cjty of Enclewood, Colorado, have nego- tiated a w. ter distributor s contract, the terms and conditions of which are aceeptable to both the canpany and the City, and the Valley Development Company agrees to fulfill all other p rovisions of its propo sal of MP rch 17, 1955. HOW' THEREFORE , .. u-; IT RESOLVED, that t he City Council of t he City of Englewood, Colorado, does hereby accept the p roposal o f the Valley Deve lopment Company as set forth in its letter dated Yt~rch 17, 1955, And the May or is a u thorized to ex~cute said water di s tributor's contract on behalf o f the City of Englewood.
