It is further understood and agreed b y the City that because or the nature of the special facilities and sp ecialaerYice herein provided, and ot the pos- eibility or expansion or r eduction of service or facilities as may be required tron1 time to time by the City, that the ratea and charges fro such facilities and. service are declared to be su b ject to change, end the City hereby agrees I to pay tor auoh facili t ies and s e rvice as may be provided in accordance with the rules, regulation• and practices or th e Ccmpany in that r espect. 3. ill teleph one plant facilities and equipment constructed and installed by the Company shall remain the eole and e e parate property of the Comp rrny, and 'the City does hereby grant and conTey unto the Company all necessary right-of-ways needed tor t he est ao liabwiint or f a cilities and the furnish ing of such service to the City and tor the construction, maintenance1p operation, recoaatruction, and/or re-location ot telep~one lines and associated equipment o-.er lands owned by the City(or, if the City be not the owner thereof, to obtain Yalid right-ot-ways u may be re- q*1red by the Company to fulli'ill its o b ligations hereunder). The City further agreea, upon request ot the Company, to execute or o btain any and all papers n e cessary to evidence such right-of-way conyeyancea. 4 . The City also agrees to comply with all rules and regulations of the Company as now existing or hereafter .. ended, and the proYisiona of tariffs now on file or here aft e r to be filed with the Public Utilitiea Comnission ot the State or Colorado, an u. where applicable, all tariffs now on file or hereafter to be tiled with the Federal Can- lmlllicationa comnisaion or other lawful authority having juriadition in the praaiaea, and upon tailure to ao comply with any euch rule•, r egulations or tariffs, th e Canpany may at its option terminate this contract. 5. It is expressly understood and agreed by and between the City and tbe Company that tbe Company under- takes t~ installation ot said special facilities an d the furnishing of s a id special service, solely for the assis- tance and accomodation of the City and its Fire Department and its inhabitants, and it is agreed that the Company aasumee no responsibility whatever tor any act or omission on the part of its emplyeea o• operators or agents in connection with the use and op eration od said epecial facilities and said special service, nor tor the failure ot the eaid Fire Department to respond to any call, whether or not the same is caDpleted or receiTed , and the City agree• to indemnity and save harmless tlE Ce>11pany from any and all claims, demmds, actions or damage which may be uaerted against the Company, arising out of or in any manner predicated upon the installation or operation or use ~ said special facilities &Di s aid special service. 6. This board shall be equipped with two incaning trunk s reaerTed exclusively for fire alarm reporting by the public. One extension line shall be provided to the College View F ire De p a rtment and one extension line shall be pr•vided to the Sheridan Fire Depart- ment. On e call circuit (privat e Line ) shall be provided from the En g lewood l'ire Department board to a apecial group signalling an talking equipment in the Fn g lewood c e ntral office to enable the firemen on duty at the Eng lewood F i re Dep a rtment private branch excbange~o 1 aallr'Y61.Juneer tt-..men either individually or in groups. When a tire report is receive d by the fireman on duty, the equipment provided will enable the fire- man on duty to call the Tolunteer firemen in groups of 20 or individually depending upon the number ot tiremem required. This is acomplished by means of the special equi pment which baa been provided. This e~ quipment permits the firemen in attendance at the fire reporting boeird to ring the regular residence telephone lines of the vol nte e r firemen which finds it necessary to call. Code ringing under control ot the ri key at the fire board may be used in order that the firemen and their tamilea may distinguish the tire calla from aign ls for r e gular telephone calls. In oaae a firemen's resi dence telephone is busy at the time the conf e rence connection is established, t he op e ration of the ring key will impose a special ton e on the line durine the ringing interval to sig- nal the firem1m, but will not· ~ut off the existing connection •• llhen the fireman hears this tone he mS¥ b aJJg up to diao•ntinue the conv ersation, and when he picks his telephone up he will be connected to the conte reno e oircut. Any fireman's t e leph one may b e disconnected from the confe rence connection by replacing the receiver on t he switch h ook. T e station line is then free to originate or receive other calls.
