WHEREAS, the cu rrent development app li cation and associated fees were established by Ci ty Cou ncil in the ear ly 1980 's; and WHEREAS , City staff conducted a survey for assessment of fifteen muni cipalities along the fr ont range regarding their development fees ; and WHEREAS , the City's existing development kes requ lre an adjus tm en t to reflect the cos ts to the City for the processing of development applications . WHEREAS, these fees are reasonably related to City of Englewood expense s that are inherent in proce ss ing development applications . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO , THAT: Section I. Council als o recommen ded that the proposal be referred to the Alli ance for Commerce in Englewood (ACE) for rev ie w za d comment pertaining to the impact the proposed Deve lopment Revi ew Applicafon and Fee 5checi ,le may have ,,n th e business community. The Allian ce for Commerce in Englewood revi ewe d th e proposed Fee Schedule at its meeting on March 13•. A memo regarding ACE 's review is atta ched. The Board of Adjustment and Appeals als o discussed the fee proposed for a Variance appli cation at its March 1 2• meeting. A lett rr from Board Chair Jill Carlston is attached urging City Council to adopt a Variance application fee not to excee d $12 5.00 . IIECOMME NDED ACTION Staff recommends that the City Council consider and approve by reso lution the proposed Development Review Application Fee Schedule as outl ined in Exhibit A. BACKGROUND The City of Englewood's current development applica ti ons and associa ted fees were es tablish ed in the early 1980's, and have not bee n updated since th eir implementatior,. To determine if the City's development fees are up to date an d com pa raL,le with other cities, staff conducted • survey of fifteen (15) mu1,icipaliti es along the Front Ran ~e. Th ose objectives are identified below: To review th e City's cu rrent developmen t fees ensuring that they provide reasonable cost recovery for staffs ' time; and To compare th e City's existi ng and proposed developml fees to ensure that th ey remain equitable with other Front Range jurisdictions; and To determi ne projected revenu es bas ed upon propose d deve lopment review appli ca tions an d fees . Th e proj ected re venue wou,d in crease 3 -3%, Attachment B provides two separate charts tha t indi vidua ll y break down th e fees between the existing Development Review Application Types and the associated Fees, and the propo~ed Development Review Application and Fee Schedule. The first chart, Current Development Review Application Fees and Projected Revenue illu strates the current Development Review Application Typ es and Associated Fees that are currently implemented vs . the projected reven ue th at each application would generate based upon the proposed fee. Specifically, the chart indi cates the current fee charged for each application, the number of applications reviewed in 2002, the rev e nue th at was colle cted for each a pplication (and tota l revenue for all applicatio ns ), the proposed fees associated with each application, and the projected revenue that would have been gene rated based the number Development Review Applications received in 2002. Util izi ng this formula, the projected revenue from the Development Review Fe es would increase 373% from $2,350 to $11,125. Proposed Development Review Application Fees and Projected Revenue 85 requests for the proposed Development Review Appli catio n Typ es were received in 2002 . or the 85 requests, th ere was no De velopment Review revenue ge nerated. The proposed Developm ent Review Applicati ons types and associa ted fees wo uld have generate d $5200 in reve nue from the sam e 85 req uests. The second c hart, Propo sed Development Review f ees and Projected Revenue, illu strates the proposed Developm en t Re view Application Type s and Associated Fees recommended by Community Development staff. The chart depicts th e proposed Development Review Application Typ es, the current fees cha rge d for each application, the numbe r of reques ts/appli cations receiv e d by staff in 2002, the revenue generated for each application, the proposed fee for each application, and th e projected revenue for each appli cation type. Based on th e proposed Development Review Application Typ e s, the numl or of req ue sts for each revi ew type, and the proposed associaced review fees, an additional $5200 would ha ve been generated in Development Review Application Fees .
