A full -time clas sified empl oye e who is no t a confide ntial emp loyee , a managerial employee, or a supervi sor shall have the right: A. A written oc,licy ha s been deve loped and included in the operations man ual sp ecifically addressing the iss ue of ,c1i11;n.istrative and criminol investigations and employee rights. SEN I OR ITY Fo r the pu rposes o f thi s Con trac t, se niority shall be determined fir st b)' length of continuous fu ll .time se rvice with the Ciry Po lice Divi sio n according to rank and second b)' length o f continu ous full.tim e service with the City Police Divisi o n fr om the first date o f hire , provided th e ··mploycc succe ss fully compl eted a pr obati o nary pe ri od. In ca ses where two o r more empl oye es have the same hire date , the badge number :is issued by the Divi sio n sha ll establi sh pri ority o f po sition on the se niority li st. Empl O)'CCS shall not continu e to accrue se ni ority whil e lai d off, an d se niorit)' will ,aminate when an emplo)'ee has been laid off fo r a perio d o f eight een (18) mo n th s o r mo re . A work week is a regular re currin g peri od o f 168 hour s in the fo rm o f seven consecutive 24-hour perio d s. 'The wo rkw eek need no t be the sa me as the ca lendar week. The wo rkw eek ma y begin o n an y d ay o f the week and an y ho ur o f the da y and need no t be the same for all employees . When an employ ee's work schedule is changed fo r purposes o f training, special instruction, etc., the supcn1is o r ~l1a ll make a rea sonable effort to acc o mmo date the employee's intere sts co ncerning the scheduled chan ge. D. Sillffing E. SPEC!J\L ASSIGNMENT The Divi sion will maintain a wri rt cn process for selecti on and service including perform ance of employees for special assignments in the Police Operations Manual. LAYOFF Whenever there is lack of work, lack o f funds, or under conclitions where the City determines continued work would be inefficient o r non-productiv e the appointing authority shall de sign ate the positions in which the layoff is to be made . 1be order of la yoff sholl be determined by the City Manager on the ba sis of the quality and length of service provided by 1he employ ees in cl,e affected areas. Q uality o f work will include the empl oycc1s total empl oyment reco rd. This record include s annual performance evaluations, commendations, disci plinary actions, tducation, training, etc . Any cmplo)'CCS who ha ve not ye t achieved permanent or regular starus or who have le ss than twelve (12} months of full-time employment wi th the City shall be laid off first, regardless of perfo rmance . Permanent employees who are laid off have the rigbt to be reemployed as a police o fficer, in inverse o rder of layoff, provided that s uch recall occurs within eighteen (18) months oflayoff and the employee continues to meet the qualifications for that posi tion . Laid off employees will stay on the recall list for eighteen (18) months. In the event die quality and length of scn~ce are equal, seniority shall prevail. The recall list shall terminate after eighteen {18) months . If financial conditions warrant and at the discretion of the Director of Safety Services, an employee, recalled from layoff to a classificatio n lo wer than that hc!d at the time of the layoff, may be moved up to the highest classification previously held at an accelersted pace. E mployees shall not continue to accrue se rvice credit, including seniorit I Jr be eligible for 2ny City benefits during layo ff. Wages for the period January I, 2005 through December 31, 2005 will be negotiated in 2004. Cla ss Increa~ The wage increase provided for Poli ce Officer 4th Cla ss through 1st Class shaU not be consi dered automatic, but ra ther based upon meritorious service. Said class increase may be granted or denied to any individual Police Officer upon recommendatio n of the Direc tor of Sa fery Services and with the approval of the Ciry Manager upon written notice to such indi,•idual Police Officer. The date in which the class increase is approved shaU determine the new cla ss anniversary date . I I ARTIC LE 10. MERIT PAY A. Each Polic e O fficer I shall be eligible fo r meri t pay in an amo un1 det ermined by the Director o f Safct)• Services, up to a to tal o f$625. fo r 2002 and up to a tota l o f $7 50. for 2003. B. Such merit pay shaU be awarde d in Lh c exercise of the Director's disc retion, based up on spec ifi c written objec tiv e an d s ubjective p erformance criteria devel oped by the Director and made availabl e to employees. C. E ligi bl e employees who be lieve th ey meet the crit eria fo r such an award shall s ubmit applic ations to the Merit Pay Review Committee on or be for e thirty (30) da ys prior to the employee's employment annive rsary date. The Committee shall make a rec ommendation to th e Director regarding th e amount of the merit pa y, if an y, to be award ed to the empl oyee . Emp loy ees who ha ve worked overtime hour s ma y take time off in lieu of overtime pay upon murual agreement between the employee and th e emp loyee's supervisor. lf d1cre is no mutual agreement, the employee shaU be paid. Such time off shaU be taken during the pay period in which it was earned and shall be paid in accordance with the Fair Labor Standards Act.
