for City co mments in May 2C81 . A preli minary plan was pr esented at a neighborhood
me eting on August 22 , 2001 , as required by th e PU D Ordinance. The formal PL 'D
ap pli cat ion was sub mi tted on May 14, 20 02 . The Di str ict Plan an d th e Site Plan have been
combine d and su bmitted as one doc um ent fo r co ncu rr ent review, as provided for in the
PU D O rdinance. A preliminary subdivis io n pl at. based on the PUD , was also submitted.
ANALYS IS:

The PUD Distric t Pla n es tablishes the zo ning regulations fo r th e ne w district. The proposed

NEIGHBORHOOD MEETING SUMMARY:
On August 2~. ~001 , property owner Da vid DiPane , wi th rep resen tat ives of Pa ppas
Architecture, co nducted the required pre-appl ication nei ghbo rhood meeting. The applicant
pre se nte d a proposal fo r 4 single-fami ly detached homes on a cul-de-sac street. Ni ne
neighbors and /or property owners (4 Englewood residents and 5 Denver residents )
attended the me eting . Attendee comments and questions foc used on four main topics:
the style of homes prop o sed , who would design and build the homes, loss of privacy for
neighbors to the north w hen new structures are built, drainage.
PLANNED UNIT DEVELOPM ENT CONSIDERATIONS :
When co nsidering a Plann ,?d U nit Deve lopment application, the Commission must
determine if th e proposal meets District Plan and Site Plan criteiia as es ablished in the
PU D Ordinance.
PUD District Plan
University Homes PUD District Plan se ts forth the zoning regulations within which the
proposed developmen t w ill o ccur. The Planning and Zoning Commission is requir ed t0
make the following findings concerning the Un iversity Homes PU D District Plan :
• 1. The PUD Oi suia P/Jn is, or is not i~ :oniorm ance with ~'l e Oisuia Plan req uirements and
the Comprehens ive Plan.
The proposed University H omes PUD is in conformance with the applicable
requirements set forth in Section 16-4-15 : E 3 e. PUD D ist rict Plan .
2. All req uir ed documents, drawings , re fe rrals, recommendation s, and approvals have been
received.
All approp riate documents concerning the proposed University Homes PUD have
been recei ved and approved.
3. The PUD Distria Plan is co nsistent with adopted and generally accepted standards of
development in the City of Englewood.
The proposed PUD District Plan is co nsistent with accepted development standards
established by the City of Engle wood.
4. Th e PUD Distria Pla n is substilntially consis tent with the goals, objectives, design
guid eline s, policie s and any oth er ordinan ce, law or requirement of th e City.
The proposed U ni ve rsity Homes PUD District Plan is in con formance w ith all other

U ni versity Homes PUD Site Plan sets fo rth the site planning an d design parameters within
w hich the proposed develop ment will occur. The Planning and Zoning Commission is
req uired to make the fo ll owi ng findings co ncerning the University Homes PU D SitP Plan :

The pr oposed University Homes Pi.JD S,t;; Plan is in conformance with the
Uni versity Homes PUD District Plan . foe PUD Site Plan establishes the lot
arrangement, orientation , and location , and the building envelopes on the lots. The
PUD Site Plan also includes a landscape plan for the public right-0f-way that
provi des details as to lo ca tion of landscape areas and the plant species to be used.
The Plan also identifi es co mmon and public areas .
2. All required documents . drawings, re ferrals, reco mmendations, and approvals ha ve been
receiv ed.

Title 10, Land Subdi visio ns , of th e Englewood ,vlunicipal Code requires that the Pla :c :-1:-lg
and Zoning Commi ssion re vi ew th e preliminary plat for a major subdivision at a i:0:,k
hearing. After the public hea ring, th e Commission ma y approve, conditionally appro,:. ::ir
disapprove the preliminary plat. If the f}reliminary plat is approved or conditic:-c.lly
approved , the applicant prepares a findl plat incorporating any suggestions or conc:;:c,7\.1
resultin g from the public hea ring .
Upon submission of the fina l plat. the Planning and Zoning Commission re vi ews the :::-,al
plat fo r conformance to an y conditions imposed on the prelim inary plat. A public hear.,:'!; ;s
not required fo r this re view. Aiter this review, the Commission ma y either ap~r::•, ~-

ANALYSIS :
The Planned U nit Development is a rezoning process tha t establishes specific zonimg
and site planning cri teria to meet the: needs of a specific develop ment proposal than
ma y not be ac ~o mmodatec within the e,isting zoning scheme or developmemt
re gulations. The PU D p rovides the oppor!Jnity for unified development control for
multiple properties. The PUD is co mposed of a District Plan . which is the set cJi
zonin g regu lat ions tha t w ill apply to the proposed develo~ment project. This C'istric:
Plan is co upled wic h a Site Plan that spe, ·ifies the general site design ant=
requ irements of the proposed development.

The U niversity Homes Planned Unit Development proposes 4 single-famiiw

Drivewa accesses to Lot I and Lo t 1 and also Lot 3 and Lot 4 are proposed via am
acc es; eJsemen t on each lot. The proposed lots wi ll range from approximatei"
6,770 square feet to 8,400 sq uare feet. The priva te drive, identified as Outlet A, wlill
be owned and maintained by the Homeowner As so cia tion, which is to be formed ii!.S
a req uirement oi this PU D . Maintenance of landscaping in the public right-of-waw
and the so und wall is the responsibility of the Homeowner Associ at io n .
The PU D District Plan establishes the zonin~ regulations for the new district The
proposed use is limit ed to single-famil y res idences with accessory structures. Home
office, as an acces sory use , is also proposed .
Setba cks are established for each /01 by a building env elope. The building envelcoe
is the area in which de ,e/op ment ma y occur; ii does not mean that developm ent

Title 1 O. Land Su bdivisio ns, of the Engle woo d Municipal Code requires that the
Planning and Zoning Commission re view the preliminary plat for a major subdivision
at a pub lic hearing. Afte r the publi c hearing, the Commission ma y approve,
cond i1 ionally approve, or disapprove the preliminary plat. If the pre li mina ry plat is
approved or co nditionally approved, the applicant prepares a final plat incorporating
an y suggestions or conditions resulting from the public hearing.
Upon submission of the final pla t, the Planning and Zoning Commission reviews the
final plat for conformance to an y conditions imposed on the preliminary plat. A

plat is approved. it is forwarded to City Council with the Commission 's

2. The proposed grade of the channel is ve ry flat.
□ 0.13 % grad e is e .. :reemel y flat. This is onl y one-quarter inch offal! every 10
fee l. On the co nstruct io n plans we will requ ire very tight spe cifications that
indicate the need to provide steel rods at grade ev ery IO fee· to pro vi de finish
grade s fo r the concrete workers to finish to. But gi ven the co nsrraints of the
site•-(The y ha ve to accept flows from the Mansion Property to the west , we
would not allow the developer to push the flows onto the Denver Properties to
the north . and therefore all these flows need to be conve yed to University to
the east.) The on ly other viable option is to provide a Fre nch drain system and
sump pump at university to lift the flows back to the surfa ce . French drains
have a tendency to fail . as fine part icles will plug the system over time . And
we hate to rel y on sump pumps si nce po wer has a tendenc y to go 0 u1 during
se vere rainfall eve nts .

2. THAT Public Notic e of the Public Hearing was given by publication in the
Englewood Herald on August 9, 2002 ; letters we~e a ls o mailed to adjacent
property owners not ifying them of the date , time, and location of the Public
Hearing.
3. THAT Senio r Planner Langon testified that the proposed University Homes
Subdivision divides the site commonly addressed as 3055 South University
Boulevard into four single-family building sites, and establishes a private
drive extending west from South Univ ersity Boulevard to provide a.cces s to
the building sites. Ms. Langon testified that the proposed University Homes
Subdivision Preliminary Plat is in conformance with Title 10 , Land Subdivi-
sions, of the Englewood Municipal Code .
CONCLUSIONS
l. THAT the appli cation for University Homes Subdivision was filed by L'avid
M. DiPane .
2. THAT proper notification of the date , tim~, and place o the Public Hearing
was given by publication in the official Cit:, newspaper, and by personal let-
ter to adjacent property owners of rec c,rd mailed via USPS .
3. THAT the proposed University Homes Subdivision Preliminary Plat is in
conformance with Title 10 , Land Subdivisions , of the Englewood Municipal
Code, and that a Final Plat is to be prepared and referred to Englewood City
Council for approval.
DECISION
THEREFORE, it is the decision of the City Planning and Zoning Commission that
the Preliminary Plat of the Uni versity Homes Subdivision is in conformance with
Title 10 , Land Subdivisions . of t he Englewood Municipal Code . The applicant is di-
rected to prepare a Final Plat, identical to the Preliminary Plat. and said Final Plat
of University Homes Subdivision shall be referred to Englewood City Council for
approval.
The decision was reached upon a vote on a motion made at the meeting of the City
Planning and Zoning Commission on September 4, 2002 , by i\-Ir . Welker, seconded
by Ms. Krieger, which motion states:
The Planning Commission approve the Preliminary Plat of the University Homes
Subdivision, the applicant is directed to prepare a Final Plat identical to the Pre -
