SERIES OF 2001
A RESOLUTION ESTABLISffiNG RATES OF PARKS AND RECREATION SERVICES FOR
BUSINESS OWNERS AND EMPLOYEES OF THOSE BUSINESSES WITHIN THE CITY
OF ENGLEWOOD.
WHEREAS, this Resolution shall update and re place Resolution No. 46, Series of 1991 ;
and
WHEREAS, the City Council aeeka to encourage buaineaa and commercial "88S of
Englewood Parka and Recreation Services within the City o(Englewood; and
WHEREAS , many buaineaa owners do not reside in the Crty t...at support city services
through payment of sales and uae taxes;
NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO, THAT :
~-For a business owr.er and their immediate family members (must be living
in the same household) to qualify for resident rates, the buaineaa must have a pi,_1sical place
of busir.eBB within the City boundaries and be licenaed if required by Englewood Municipal
Code .
~-Corporate oflicers on fil e with the Secretary of State shall be entitled to the
same atatua as a buaineaa owner.
~-Landlords or owners of rental property shall not be eligible for resident rates.
lw:!iluu,. Englewood residents eball continue to h•ve priority for all re reation programs
and service, without limitation.

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
Council has previo usly approved R,· 1lution No. 46, Series of 1991 establishing rates for Parlcs and
Recreation services for Englewood Lusiness owners .
RECOMMENDED ACTION
Staff recommends Council approve by resolution a new and updated pcl icy regarding rates for Park
and Recrea tion services for Englewood business owners.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Parks and Recreation Commission requested th~ City Attorney's ofiice to redraft Resolution
No. 46, Series of 1991 to clarify language dealing with business owners, tenants and property
owners. The City Ar.vrney's office created a new draft resolutio n that would update and replace
Resolution No. 46, Series 1991. Parks and Recreation Commission recommended by motion that
the City Attorney's office proceed with the draft and present it to City Council for consideration.
FINANCIAL IMPACT
The new resolution clarifies the previous resol uti on 's ;n· ant in establishing rates for Park and
Recreation services relative to City of Englewood business owners. No flnanclal impact

Residency Requirement for Business Owners and Landlords of
Residential Property

During the past few months . the Parks and Recreation Commission has discussed whether
landlords of residential properties sliould receive resident rates for Parks and Recre:ition-
programs and facilities. Since the resoiution was approved in 199 I, tenants of le:ised
property have received resident discounts and not the owner of the property .
After considerable discussion 31 the November P:lrks and Recreation Commiss ion meeting, a •
motion was made by Commission Member Wllldman and seconded by Vice Chafrperson
Neyer proposing that the City "ttomey redraft the resolution co clarify that only the tenants
of the residential propert/ shai1 receive resident rates for parks and recreation progrnms and
facilities, and not the property owner. The motion passed unanimou.ly.

Reco .nmendation regarding Draft Resolution for Residency Requirements
At the March Parks and Recreat io n Co mmissi on meeting, Direeto r Black pre se nted the !)raft
Resolution prepa red by the City Anomey's office establishing rates of Parks and Recreation
services for busim ;s owners and empi oyee s of those businesse, within the City of
Englewood . Commission members were told that the Draft Re sol ution would update ar.d
replace Resolution No. 46 , Series of 199 I.
After a brief di sc uss ion , a motion was made by Commission Member Waldman and
seconded by Vice Chairpe rso n Neyer r,,commending that the City Ao Jmey proceed with the
