A RFSOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF
ENGLEWOOD, COLORADO, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO
MAKE IMPROVEMENTS TO THE ACOMA STREET PARKING LOT, AOOPI'ING
DETAILS AND SPECIFICATIONS FOR TH£ PROPOSED DISTRICT, AND DIRECTING
PUBLICATION AND MAILING OF Tl'? NOTICE OF HEARING TO THE OWNERS OF
THE REAL PROPERTY IN THE DIST. . ::T.
WHEREAS , \he Englewood Downtow1: 1)evelopment Aaaociation (E .D.D.A.) has
requested tht a development plan be cr<·.tad; an improvem ont district be formed and a
vote of the m,,mbers of the district be held to incur debt to construct improvement& in oaid
district; and
WHEREAS , the Englewood Downtown Development Asaociation (E .D.D.A.) has
presented this plan to the Englewood Urban Renewal Authority (E .U .R.A .) and on June 21 ,
2000 the E.U.R.A. voted to approve a Tri-Party Agree r 1ent with minor amandmenta and
E.D.D.A. approved the Tri-Party Agreement on June 22, • JOO; and
WH!sREAS , based on this requeat, the City Council of the City of Englewood . Colr·ado
has determined that it i.s neca88 ary to r.re,te a special improvement district within tht .:.'ty
for the ;,urpose of constructing impnm,menta to the Acom a Street Parking Lot, together with
nece88.>.ry incidentals within the proposed special improvement district, all as set forth in
this Rasolution; and
WHEREAS . based on thia request, the City Council of the City of Jl:nrlewood, Colorado
has determined that it is necessary to assess and apportion the coats of the improvements
agninst the real property s~ecilically benefited by the improvementa and included within the
district, as described in "Exhibit l of the Notice"; and
WHEREAS, tha proposed project consiata of improvements to the parking facility at the
Acoma Street Parking Lot as shown on the attached "Exhibit 2"; and
WHEREAS , E.D.D .A. has prepared and s ubmitted preliminary plans and specifications
WHEREAS, E.D.D.A. in co njunction with City staff, hss prep.red and submitted ,
esti mates of costs, maps and schedule for the proposed improvements;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD,
CO LORADO :
I. Based on the request of the Englewood Downtown Development Alaociation
(E.D.D.A. \, the City Council of the City of Englewood, Colorado has determined that
it ia neceaaary to create a special improvement district within the City for the
purpoae of const.ructing improvementa to the Acoma Street Parkinr Lot, topther
with neceuary incidentals within the proposed special improvement diatrict, all as
set forth in this Resolution; aa said district is described in the notice h.:reinafter set
forth.
2 The design to be used in t he construction of th L proposed improvements ia ■et forth
in the Architect's design and is generally described in the notice hereinafter set forth.

II. DESCRIPTION OF P OPOSED DISTRICT AND IMPROVEMENTS.
(a) The proposed District shall include all of the real property fronting or abutting
on tho streets hereafter described on the attached map. Adjustments for the
assessment of costa will be made for irregular and odd-shared lots and parcels
of property.
(b) The improvements to be coru.tructed or installed are renovations to the Acoma
Stre,t Parking Lot between Englewood Parkway and Girard Avenue, to
include an increase in padling spaces and additional landscaping.
(c) 'Thr. estimated total proj,,ct cost of the improvements is eight hundred and
thirty-six thousand dollars and forty cents ($836,600.40) The total amount of
such costs will be assessed against the property within the district.
(d) The costa of the parking lot improvement&, hall be assessed by ordinance
upon each parcel of real property within the district based upJn the benefit
conferred by the improvement& upon each parcel of realty within the district.
The benefit wil1 be calculated by taking into con sideration the number of off-
street parking spacas required by City zoning law :nd the actual number of
off-street parking s , aces which are presently provided by the owner. For the
purpose of a ssessing the costs of the parking improvements, th• district will be
divided irto u Primary Zone (bounde~ on the north by Englewood Parkway, on
the east by South Broadway, on the west by the alley between South
Broadway and South Acoma Street a:id on the south by Hampden Avenue),
and a Secondary Zone (bounded on the north by Girard Avenue on the south by
Hampden Avenue or. the east by the alley between Broadway and Lincoln
Avenue on the west by Broadway, see attached "Exhibit l". Deficient spaces

Ill . 'T: :,; HEARING ON THE CREATION OF THE DISTRICT.
(a) A hearing on t he creation of the district will be l.'e!d by the City Council on
Auguat i, 2000. at i :3 0 P .M .. in the Council Chumbers, Civic Center 1000
Englewoorl Pa rkway, Englewood, Colorado.
(b) Any person desiring to be hearci upon the issue of the creation oi the district or
upon the constru .:tion of the improvements inv olved, may appear at the time
and place set for the public hearing thereon for that purpose .

located within the respective zone described in the notice hereinafter set forth.
5. Notice of the public hearing on th• :nation of the District shall be publilbed once a
week fot thrff (3) consecutive weeks in the Englewood Herald, a 119Wlp ■per of
general cm:ulation in the City. In addition, a copy of such notice aha!! be mailed,
postage prepaid, to each known owner of real property within the proposed District.
However, such notice of hearing by publication and by mail as well as the '1enring
itself, may be waived by agreement of all property owners within the dittrict.

All ownera of real property hereinafter described, and all pert10t11 g,,nerally, are hereby
n.,tified that the City Council of Englewood, Color,do, pursuant to its own initiative has
adopted preliminary details, plane, and specifications for the conatruction of the Acoma
S treet Parking Lot improvements, together with necessary incidentalr, within a proposed
s pecial improvement distri ct within the corporate limits of Englewood, Colorado, to be
known as Acoma Street Parking Lot Special Improvement Di strict. Said person,, :>re further
notified as follows:
I. .;REATION OF DISTRICT.
The Englewood Down t own De velopment Association (E.D .D.A .) has requested that a
development plan be created ; an improvement district be formed and a vote of the membt!ra
of the dittrict be held to incur debt to construct improvement> in aaid district. The
Englewood Downtown Development Association (E .D.D .A.) has presen,..d thit plan to the
Englewood Urban Renewal Autho~.,7 (E.U.R.A.). The E.U.f • .A. and E.D.D.A. voted to

III. THE HEARING ON THE CREATIO N OF THE Dl3TRICT .
(a) A hearing on the creation of the di strict will be held by the City Council on
August i, 2000 , at i :30 P.M., in the Council Chumbers, Civic Center 1000
Englewood Parkway, Englewood, Colorado .
(b) Any person desiring to be heard up on the issue of the creation of th!:! district or
upon th l' ronstruction of the improvements involved, ma y appear at the tim e
and pl ac1: set for the pub l:.c hearing thereon for that purpose .

accordance witn the preliminary report, plans, maps, 1pecific3t.ions, detail, and
eatimatea of coats herein referred to and now on file in tile office of tho Director of
Publir Worka. It ia anticipated that the ordinance will be considered for puuge on
6.rat reamn1 by the City Council at a regular meeting thereof to be held on August 7,
2000 .
8. Should any one or more sections, paragraphs, clauses, or provisions or thia
Reaolut.iun be judicially determintd invalid or unenforceable , such determinati,a
shall not affect. impair or invalidete the remaining prov,aiona nereof, the intention
