Title 11, Chapter 7, entttled "City Rights-of-Wey-Permtts and Requirements", (Council Bill No . 40) was approved on llrst reading October 16, 2000 . RECOMMENDED ACTION The Public Works Department recommends that Council approve a resolution In order to establish fees for adm inistering the new Trtle 11, Chapter 7. BACKGROUND, ANALYSIS, AND ALTERNATiYES IDENTIFIED n1e 11, Chapter 7, repealed Trtle 11, Chapters 3(A), 3(B), and (3C), and Tttle 12, Chapter 4 of Iha City of Englewood Municipal Code. These Chapters contained the permit lee requirements that the Public Works Department has been enforcing since 1985. The purpose of this resolution is to establish the schedule oi fees that will enable staff to charge in order to cover the costs associated with private individuals and companies that use public right-ol-way . These fees will allow the City to recover the costs for administering the Code requirements contained in Title 11, Chapter 7. The Right-of-Way Committee of the Greater Metro Telecommunications Consortium (GMTC) has examined cost recovery lees used throughout the c,,untry, and has recommended a Model Right-of-Way Ordinance. The te lecom munication and utility compr;,,;es have numerous issues and oojections wtth the cost recovery fees proposed by th e GMTC . Staff is recommending that the controversial lee elements be left out of the proposed fee schedule until the Colorado Supreme Court reaches a decis;on on the Quest Communications and City of Denver case . FINANCIAL IMPACT The "user lees· that are proposed will cover the increased administra !i on costs . At the present time the City of Englewood does not have a mechanism lor recovering costs for t~.e degradation caused by street cuts or for the inconvenience caused to our citizens wher. access to portions of tt:'eets are denied when private companies are doing work in the right•of·way. Cost recovery for degradation and ;neonvenience caused are nr' included in this resolution, but they may be later, if the Colorado Supreme Court give ;; direction on these issues.
