SERIES OF 1999
A RESOLUTION SUPPORTING THE ENGLEWOOQIMCLELLAN RESERVOIR
FOUNDATION'S DEVELOPMENT OF THE FOUNDATION'S PROPERTY CONSISTENT
WITH THE APPROVED DEVELOPMENT PLAN AND THE ADJACENT PROPERTY THE
RESTRICTIVE USE AGREEMENT.
WHEREAS, the Englewood/McLellan Re ■ervoir Foundation (EMRF) waa formed to
overeee the development of the McLellan Re ■ervoir property ; and
WHEREAS, the EMRF owns approximately 100 acres of the 500 acres that are to be
developed adjacent to McLellan Res· ,rvoir; and
WHEREAS, the imposition of covenants or wie restrictiona on all lands within the
development area will ensure a consistent high level of d•velopment ; and
WHEREAS . these wie restrictior.B will provide even greater protection to the McLellan
Reservoir's water quality when compared to development without the restriction; and
WHEREAS . these restrictions will create and mabtain a greater v,:ue Cm· the land that
in tw-n ensures a long-term income stream to the City; and
WHEREAS, the Englewood Utilities Department retained THK Aeeociatee ae a
consultant to review the restrictions; and
WHJ,;REAS , after review THK Associates recommended approval of the "Restrictive Use
Agreement";
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO . THAT :
~-The City Council of the City of Engle wood, Colorado , hereby supports the
"R< .trictive Use Agreement, attached hereto as "E"'1ibit A".
~ Thie resolution of support in no way waives or delegate, the City's regulatory
powers , duties anr respo~sibilities with respect to zoning and govert...11ental issuea.
ADOPTED AND APPROVED this 6,.day of July, 1999 .

RECOMMENDED ACTION
Staff recommends that Council adopt a re,lOlution, which supports the imposition of the Restrictive Use
Agreement on the En~lewood/Mcle!len Reservoir Foundation property .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Englewood/Mclellan Reservoir Foundation ~a~ been established lo oversee the development of
the Mclellan Reservoir property. The Foundation has articulated the following development goel :
Protect the quality of Englewood's stored water .
Protect the ecosystem that has developed since access hes been restricted.
Maintain the quality of the Highline canal recreational facilities and the wetlands that i;,Jst between
County Lin e Roed and C-470 .
Develop the land south of C-470 in a manner that minimizes the impacts on Mclellan Reservoir.
Develop the land scuth of C-470 in a manner that enhances the quality of the neighborhood of
wh ich it is part.
Establish and maximize a future lon~-term income stream fort the benefit of the City of Englewood
after meeting the above listed ge,als.
The Foundations owns approximated 100 acres of the 500 acres that are to be developei:l adjacent to
Mclellan Reservoir . The imposition of covenants or use restrictions on all Janda within the development
area will ensure a consistent high level of development . F'urtherr.iore, these use restrictions will provide
even greater protection to the Reservoir's water qualily when compared to development without the
reslrictic,n . Finally, these restrictions will create and maintain a greater value for the land that in tum
ensures a long-term income stream to the City.
THK Associates , the consultant retained by the Utilities Department to review the restrictions has
recommended approval of the Restrictive Use Agreement.
