A RESOLUTION AWARDrnG A N!GOTIATED CONTRACT FOR ENGLEWOOl>'S
1998 MICROSURFACING PROGRAM INSTEAD OF THE COMPETITIVE BID PROCESS
UNDER SECTION 116 (b) OF TH:E ROME RULE CHARTltR AND SECTION 4-1-9 OF
THE ENGLEWOOD MUNICIPAL CODE 1985.
WHEREAS , t he City of Englowood is responsible for maintenance of approximately 120
mile s of public roadways in the City; and
WHEREAS, the Department of Public Work& and Engineering and Street Maintenance
Di vis ions have developed a syatem-wide maintenance program in whi ch they h ·ve found
Micros urfacing to be a viable and economic preventive maintenance alternati·,e; and
WHEREAS, previOWI ronstruction experience and expam!ed product knowledge has
ca us ed the staff of the Department of Public Works to believe that local contraCU>rs do not
possess the s pecific product knowl edge or construction expertise or construction eq uipment
to construct Microaurfacing acceptable to City s tandards; a:>d
WIIEREAS, the staff of the i'ublic Works Department has evaluated the quality of
Microsurfacing utilizing a s p,,cific local aggregate and a guiclt-set ERGON emulsion for
the past 11 years; and
WHEREAS, Bit.aminous Asphalt Sealing Specialists, Inc. (BASS ) of North Little Rock,
Arkansas, has laboratory-tested and field-tested this produtt, and City staff has evaluated
the abilities of this company in placing Microsurfacing, and bas discussed their work
quality and product quality with other gove rnmental age~ which have bad years of
experience with this companyj and
WHEREAS , BASS , Inc. has now placed a total of 1.990,000 square yard s (a pproxima tely
100 miles of roa dway) in the City of Eng lewood over a perioc 11 years; and
WHEREAS, Section 116 (b) of the Englewood Home Rule Chaner and Section 4-1-3-1,
En glewood Municipal Cod e 1985, aHow contracts fo r public works or impr ovements to be

RECOMMENDED ACTION
We are seek ing Counc il approval of a Reso lution owing ,. negotiated contract with Bitum inous Asphalt Sealing
Spec ialists, Inc ., a.k.a .. BASS , Inc .. in an amount 01 to exceed $350,000 for our 1998 Micro -surfacing Progra m .
BACKGROUND , ANALYSIS , AND AL'TERNAllVES IDENTIFIED
Micro-surfacing is a cost effective maintenance alternative that provides rut filling , leveling of existing
pavements, a surface seal and a new wearing surface. The finished product is jet black , aesthetically
pleasing, and exhibits more traction than the originaJ auphaltic concrete (improved safety).
Staff Introduced "Englewood" micro-su rfa cing in 1991. Our obj ective was to develop a maintenance
alternative to address the maintenance needs, roadways subjected to excessive traffic volumes
resulting in pavement rutting and lanes requiring leveling treatments along with new wearing courses
and surface seals . BASS has satisfactorily panicipated in a pa11nership arrangement with the City for
the last eleven years to construct our slurry 8flld micro-surfacing programs , having now placed a total of
1,990,000 square yards of our design products (approximately 800 blocks, or 100 miles of roadway).
Micro-surfacing requires highly specialized construction equipment . Based on our last seven years of
experience . we know that the use of continuol'.JlS micro-surfacing equipment produces a superio r
product when compared to that appl ied with truck-mou nted type machines . Continuous equipment
provides consistency of application and mini es Se ams by red ucing equipment stops and starts.
l ruck-mounted equipment was used in the co,nstrucnon of our earlier slurry products. Continuous
micro-surfacing equip ment can app ly standa ro slu rry products whil e standard slu rry machines are not
ca pable of arplying micro-s urfaci ng . The nu er of cont inuous micro-surfacing machines continues to
grow throughout th e country; BASS owns and operates two o f these machines . BASS has
successfully constructed micro-surfacing on selected arterials. collecto rs , industrial and local service
streets in our 1991 , 1992, 1993, 1994, 1995 , 996 and 1997 Micro -surfacing Programs .

1YOrkmanship of BASS , Inc., particularly with micro-surfacing, appe~rs to remain superior. Mud!
inconsistency exists in the mix designs used by others in the met !o crAa. allhoLlgh many jurisdictions
are again requiring the gray gr11nile aggregate that we have specified since 1987. Many other user
agencies continue to modifY their specifications , suggeiting lha,t they are not completely satisfied with
earlier products . We have obsaived areas of localized allure In micro-surfacing products ptace!II by
others during 1992 and 1993, Indicating only marginally satisfactory results .
It appears that many othe•· cilieo continue lo settle for standard slurry products instead of micro-
surfacing . This can be partially attrlbL1ted to local cc 11ractors recommending and selecting iow.-
priced, lesser quality components under competitive bid conditions. Also, slurry p oducts tend be
more user-friendly duri;1g construction than mlcro-s11rfaclng . It should be noted that micro-surfacing
has construction adval'tages over slurries in that micro can be used for rut filling and leveling in
ad dition lo providing the su rface seal and new wearing surface that is obtained with standard sbry
ap plications .
Throughout our eleven year experience with "Englewood" slurry, micro-surfacing, and BASS, Inc.,
citi zen response continues to only question our not including more streets in our micro-surfacing
programs.
Experience with applying our product is crucial lo a success,ul project. We continue to monitor and
evaluate slurry and micro-surfacing contractors in the Denver area, and we may choose to recommend
others for future years ' work, dr,pending upon their performanc e on other projects . H'Jwever . OtJ\I' local
choi ces continue to remain extremely limited.
Van ce Bro s., Inc . of Kansas, established a Denver office , and in 1993. con st ructed a Littleton micro-
surfacing demonstration project, with marginal results . Van ce Bros . had some less than satisfiel:I sluny
cu stomers in 1994, and their key Colorado coord inator left their employ in eaiiy 1995 . Vance Bros.
closed their Denver office in late 1995 .
lnlermountain Resurfacing , Inc . (IMR) remains in the slurry market. and they attempted to enter e
micro-surfacing market with a project in Littleton in 1997. Unable lo develop a micro-surlacing product
fo r Littleton , standard slurry was utilized with marginal results. Englewood had a contract dispute with
th is company in 1986-1987. Using older truck-mounted equ ipment , their micro-sunacing experiecnce
wi th the Colora do Departm ent of Transportation (COOT ) on Bellev iew Avenue was les s than
sat isfactory. In an earlier COOT micro -surf acing pro ject on 1-25, in Pueblo , IMR sublet product
application to another contractor, with very discou raging resul ts . While we wi ll continue to monitor the
ac tivities of this com pany, we aro not impress ed with their pe rform ance to date . and are concerned that
th ey are no lo ng er mem be rs of the Internatio nal Slurry Surfacing Association (ISSA), the organrzation
nal has established all current industry standards .
Quality R•Jsu rfac ing Company of Commerce City is the ne wes t slu rry contract or in our area. ThllS
compa.~y was establis hed in 1994, and the principals appea r to have ma~y years ' experience in die
gene ral paving industry. Th is company uses late model truc k-mounted type equip ment and appe ars to
have successf ully ta ckled several standard sl ur ry projects during the 1994, 1995. 1996 , and 199
seaso ns . They do not have continuous micro-surfacing equipment or ex perie nc e placing our
tempera mental Engl ewood micro-surfacing product. We will also mon itor the performanc e of t~llS
company and may , depending on the quality of the ir work on other projects , wis h to consider th, for

future work in Englewood . •

We prefer to UH the onty contrac:or that has demonstrated successful eppllcatl ons utilizing the
p roducts end mix deeigrl8 that we have developed, and that achieve our desired results. We e re
satisfied with producl performance to date and are pa rticularly pleased with performance on our local
service streets . The oontractor, BASS , Inc., is available to accomplish our 1998 project In late Mey o r
early J une th is year .
O ur 1998 Micro-surfacing P rogra m will ta rg et local service a nd collector streets . We continue to
sp bcily m icro-su rfacing over standard slurry because of its flexibi lity of use. Slurry seal Is a single
thickness application product. Micro-su rfacing has the c apability of bei ng applied in whateve r
th ickness necessary to a ddress our maintenance requirements. M icro-surfacing is used for rut fil ling
anu leveli ng as well as for overall roadw~y sealing. In e a rl y years , chem ical makeup caused a 17
s econd break ti me with our micro-surface specification . Modification in p roduct chemistry in 19 9 3 ,
1994 , 1995, 19 96, and 1997 increased break time to a bout 40 seconds. This greatly improved the
workability o f the m ix while maintaining our ability to open stree1s to through traffic in 20 to 30 minutes,
if required.
Our d esign contin ues to specify the quality custom crushed , g ra y gra nite a ggregate supplied by
A sphalt Pavi ng C o m pany, G olde n, Colorado. We will continue to use the improved EAGON emulsion,
as develo p ed for our 1993 , 1994, 1995, 1996 , and 1997 pro grams. However, our specif ied EAGON
emulsions a re no longer manufactured in th e Denver a rea. In 19 98, as in 1995, 1996, and 1997,
emulsions must be transported from W aco, T exas .
FINANl:tAL IMPACT
We expect that bids for standarc slurry in the metro area, us ing local contractors and lower q uality componants
than our specifications (approx,mate ly 5 hou r tra ffic limes). should ran ge fro m ,0.ao to $1.05 per square yard in
199 8. Qu ick set. polymer edified slurries with characteristics sim il ar to our specifications (2 to 3 hour tra ffic
tim es) will likely bid at S 1.30 to S1 .40 per sq uare ya rd in 1998. The Ci ty of Greel ey ap pea rs to be the onl y Front
Fiang e City specifying products similar to ours. The ir 1997 bid price wa s $1.25 per square yard fo r quic.k se t
sl urry. Littleton used standard slurry in 1997 , not quick set. at a co mparable unit price of $1.02 per squa re yard .
A competitive bid for a micro-surf , ,ing de monstration pr0ject in 1993. in the City of Littleton, wa s in the $1.65
pe r sq uare yard range . Wrth cur speci fied quality emulsion, agg reg at e . a nd appl ication eq uipment, our
comparable coverage cost in 1993 , 1994, 1995, 1996. and 1997 averaged S1 .26 p,,r square yard.
Prel iminary co nversations wrth BASS suggest a willingness to return to Englewood in 199 8 and co nstruct micro-
surfacing at a unit price co.-nparable to last year's co ntract (S 166.02 per ton )'. even thoug h Increasas in the price
of aggregate and emuls I0 could ru n 4% to 5% over 1997 . The 1991 contract was for $280,000 (app roxi mate ly
160,000 square yards or 50 blocks• S1 .75 per square yard -and included heavy applicatio n rate on Sou th
Broadway). Fund ing fo r 1992 was limited to 5260,000 for micro -surf ac in g (app roximatel y 185 ,000 sq uare yards
or 70 blocks• S1 .41 pe r sq uare yard ). In 1993, we const ructed ap pr oxi mately 201,000 sq uare yards (76
blocks) at a cost of 5305,000 • S1 .52 per square ya rd. In 1993. ru t fill ing , surlace le veli ng and olightly increas.d
ap plicat ion rates generated a hig her pe r squdre yard constru ctio n cost than our 1992 experience . Our 1994
ex perience was aga in in the S1.50 p,r square yard rang e . based upon 21 'l/JO square yard s of product and a
con tract price of S315 .000 . In 1995 and 1996 , with mafor increases i, co· of materials an d an approximately
20% increase in appl icatio rates to do t,eavy rut fi lli ng and leveling , we p' .ed 209,000 squa re ya rd s of micro•
surfacing at a tota l cost of $339 .000 • S1.62 per square ya rd -and 223.LvO square ya rd s at a total cost of
$358.000 • $1 .61 per sq uare yard -respec uvely . In 1997, we placed 240.000 sq u.••e yards (97 blocks) of
material at a total cost of $360.0w • S1 .5e per square yard . This cost re mains in i he magn itude of 40 '• of lhe
cost of asphaltic concrete er1ay wh ile stiil all owi ng us to co rrect many of the irregularities within a structurally
sou nd roadwa y surface . Increases incurred in 1998 m1cro-surfacing const ru ction and material costs would also
be refl ected In construct,o costs for asphaltic co ocrete overlays in 1998.
For the 1998 program . we ecommend contracting with BASS, Inc . to r app roA1mate ly 220,000 square yards of
mic ro-surfacing at a unit price comparable to that oeg otiated in 1997. •esulting in a contrac t of approximately
