COUNCIL GOAL
Redevelopment of General Iron Works.
PREVIOUS COUNCIL ACTION
In 1997 Council passed a Moratorium limiting new bu ilding permits and business licenses for .h e
industrially zoned land bounded by Broadway, Santa Fe , Dartm outh and Yale so that land use and
redevelopment opportunities could be studied . Du ring the Moratorium, Staff worked with resadents and
businesses de,eloping issues and priorities for future land use to incorporate into the Engle""Clod
Comprehensive Plan . Als o during the Moratorium , Council accepted an EPA Brownlields Grant that
paid for a Phase I Environm ental Assessment of the area. The Study was presented to CoUl'1lci l in
January 1998. In an April 1998 letter, (attached), Council wrote to the Colorado Department Health
and the F.nvironment regarding the City's interest in determining the "appropriate redeve lopment of the
property."
RECOMMENDED ACTION
Staff requests that Council approve a Resolution support ing General Iron Works property
redevelopment br .sed on an Environmental R,s k Assessment for a full range of land uses indl.Jding
industrial, commt:ci al , civic , and resident ial uses . Staff will forw ard the Resolution to the Colorado
Department of Health and the En vironment for inclu: ·on in the public comment on the Vo luntary
Cleanup Application for the subject prop erty and ask that the pr oposed restrictive covenants b>e den ied.
BAC'-GROUND , ANALYSIS . AND ALTERNATIVE S IDENTIFIED :
Atlas Metal, as current owner , has qurmitted an applicati on fo r Volu ntary Cleanup of its industrial site
to the Colorado Department cf Pub lic Health and the Env ironment (C DPHE). The Gene ral Iron Works
property is currently under contract for sale to an ind ustrial user. Although the owner freque rdy and
publicly made commitments to work with the City to :dentify appropriate land uses and users ttiat wou ld
be compatibl e w,th adjacent re si dential ne ighbo rhoods, they have co nsidered only industna l uses in
the ir application to CDPHE. The City co mmitted revolving loan funds of approximate ly S118 ,000 from
the Bro wnfi eld Pilot progra m lo studying the co ndit ion of the land and to determ ine what amo1.J111t of
environmental cleanup would be required for a rang e of land uses inclu ding in~ustrial , ligh t inoustrial,
commercial and resident ial. Th e funds were made avai lable to Atlas Metal for over 90 days be'ore
Atlas informed the City that they wou ld not accept the loan and wou ld not co nsider land us es c lher
than industrial use s. In th eir appli ca tion , Atlas Metal proposes to establisr, restrictive covenants ,
(attached), that wou ld fo re ve r proh ihit a rang e of land uses on the GIW property , such as pa<k:s and
recreation , libraries , sc hools and resi denti al de,1elopment.
Statt believes that a risk assessment for a full ra11ge of land uses shou ld be com plet ed at the General
Iron Works site . This lsk assessment should be comp lete before restr icting redevelopment options .
No access to the site l!as been granted to the City for such an assessment. The Environmental Risk
Assessment is the bes protect ion for the health , safety and wettare of Eng lewood citizens and an
important conslderaliorl !or determining the appropriate land use and zon ing . Statt has made
arrangement~ for expert review of the data subm itted to the Colorado Department of Health and the
Environment In Adas Metal's application for Voluntary Cleanup for Industrial uses . This rev iew Is
expected to be compte:ted within 3 weeks. Based in part on the recommendations in that review, statt
will retu rn to Council lll'ith recommendations for appropriate zon ing and redev£1lopment of the property
in the t.est interests ot the Englewood Community .
FINANCIAL IMPACT
The cost of the Environmental Risk Assessment is an eligible expense of the Brownfie ld Gra nt
awa rd ed to Englewood by th e U.S. Environmenta l Protection Agency and admin istered by the
Ne ighborhood and BtJ1S1 ness Development Ott ice.
