'-12.. • • SERIES OF 1997 A ttESOLUT!ON E3TABLISHING FEES FOR ADULT ENTERTAINMENT ESTABLISEMENT.l LICENSES UNDER TITLE 5, CHAPrER 6, OF THE ENGLEWOOD MUNICIPAL CODE 1985 . WHEREAS, the City Council of the City of Englewood, Colorado has amended the Englewood Municipal Code with the passage ofG.B. 21, Series of 1997, by deleting the reference to license fees; and WHEREAS, license fees are more appropriately set by Council resolution on an annual ba sis ; and WHEREAS, this resolution establishes license fees for Adult Entertainment Licen,es; NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, THAT: S~. The City Council of the City of Englewood , Colorado hereby approves the following fees for Adult Entertainment eotablishments: A . Adult Arcade Ljccnse Fees: $2,000 anuually Application Fee $10 .00 paid in advance B . Adult Bookstore Lic ense Fees : $2,000 a nn~ally Application Fee $10.00 pai d in advance c . Oli::ecto< COUNCIL GOAL AND PREVIOUS COUNCIL ACTION This resolution establishes lees for adult entertainment establishments licenses. Eslablishing f~es by resolution Is required by revisions made lo TIiie 5, Chapter 1. At the May 8, 1998 study session, staff discussed lhe proposed moratorium .,;!II, the City Council. On June 3, 1998, the City Council read and passed Ordinance 25, Series of 1996 on finll ....acing. This Ordinance established the moratorium to run from June 10, 1996 lo December 10 , 1996. C ouncil adopted Ordinance 55, Series of 1996 elllendlng the moratorium until April 10, 1997 . On February 18 1997. City Council approved on first reading a blll for an ordinance elllendlng lhe moratorium until July 10, 1 gg-_ Council approved on first reading changes to Trtle 5, Chapter 8 of the City Code on March 17 , 1997. RECOMMENDED ACTION Staff recommends City Council approve this resolution . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Fees are being held at previous levels unt il City Council chooses 10 rev iew license fees . Fees are set by resolution 10 allow City Council flexibility In reviewing and sett ing fees . No altematives were identified . FINANCIAL IMPACT No fees were collected for these licenses in 1996 . The fees are the same for rrwltiple uses . but not mulliple localions .
