A RESOLUTION APPROVING THE NULLIFICAn, OF ~'hl'; IUNNED
DEVELOPMENT FOR THE SCL";'H DENVER MEDIC:.U. P1.AZA LOCATED IN THE 3200
BLOCK OF SOUTH LINCOLN STREET.
WHEREAS, the City Council of the City of Englncoa approved the South Denver Medical
Plaza Planned Development with the passage of Resolm:ion No . 58, Series of 1995; and
WHEREAS, on August 15, 1997 Englewood 's Neigbborbood and Busine,s Development
!lepartment received a requeot from Kevin Gallacher,• ceneral partner of the 3299 South
Lincoln Street Partnership requesting that the a-,>pr0\'1!111 Planned Development be declared

NOW, THEREFORE, BE IT ORDAINED BY THE Cl'JY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO, AS FOLLOWS:

RECOMMENDED ACTION :
City Slaff recommends the City Council adopt a resolution declaring the South Denver Medical
Pl aza Planned Development null and •1oid .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED :
On August 21 , 1995, the City Council approved the South Denver Medical Plaza Pla nned
Development located in the 3200 Block of South Lincoln Street. The South Denver Medical Plaza
Planned Development anticipated a development of a 43 ,355 square foot , two story medical office
building located on approximately 1 443 acre s.
On August 15, 1997, the Department of Neighborhood and Busin ess Development received a
request from Kevin E. Gallacher, General Partner, 3299 South Lincoln Street Partnership ,
requesting that the approved PD be declared null and void. The Planned Unit Development (PUD)
District replaced the Pla nned Development (PD ) District in the Zoni ng Ordinance Title of the
Englewood Municipal Code. Plan ned Developments approved prior lo July 1, 1996 continue to be
governed by the;: respective Deve lopment Plans and the regulati ons of the underlying zone
districts . The procedure to be followed in this situation is found in Sectio n 16-4-15:I of •· n ·epealed
Plann ed Development regulations , which slates:
I. Ann ual Review . If the appl ication for building permits has not been made ,. . .. , two (2 )
ye ars of the Planned Devel nor,,er,I approval . the ap plicant shall be notified in writing and
req ue sted to give cause why the Planned Development approval shall not be withdra wn.
If the owner does not respond within sixty (60) days, the Planning Com mission may
recommend to the Ci!y Council that the Pl ann ed Development ap ,oroval sho uld be
withdrawn ; the approved Develo~,nent Plan may be declared null and void by the C ity
Council , and written notice given to the pr~perty ow ner . Any subsequent Pla~ned
Development shall comply with the proc edure se i forth above .

prapbatd in the original PD. He doflll l'loweY!lr, have t11nanw interested In the property If it Is
dllYeioped with three smallll' buildings rather than one large building . Because the timing of the
proposed MW development is crilical, Mr. Gallacher Is requesting that the PO be derl~red null and
void rather than wait for the Planning Commls•3ion to Initiate this action .
