The Commission received the Staff Report, which was incorpo~ into and made a part of the record of the Public Hearing. After considering the statements of the witnesses, and reviewing the pertinr.nt documents , the members of the City Planning and Zoning Commission made the following Findings and Conclusions . FJNDINGS OF FACT I. TBA T the Public Hearing was initiated upon the application filed by Jerry S. Nestler for approval of the Chicken Ranch Estates Subdivision. 2. THAT Notia: of the Public Hearing was accomplished by mailing Certified letters to 44 property owners within the immediate area giving date, tin-.:, iocation, and purpose of the Public Hearing . 3. THAT Community Coordinator Stitt testified that after ._,a)ysis of the proposed subdi- vi!ion, and the resulting nona,nfonning stalUS of existing muctures rin propoted Lots 2 and 3, staff is of die opinion that the elimination of 16 substant'..anl, nonamforming rental units will benefit and improYC the nciplborllood , and far outweighs the impact of deficient side-yard setbacks for two existing structures . THAT Planning Commissionen IIOled the position of the existing structure on Lot 2 inhibits access for off-street parking at the rear of the site; the Commission also made note of the Public Service Utility lines which cross the properties outside of the desig- nated eucmenL 10. THAT applicant/property owner Jerry Nestler testified to ownership of Lot I , to plans to raze: the converted chicken coop and the structure presently addressed as 4357',', South Huron Street , and to his conversations with representatives of Public Service Company regarding the location of the overhead lines . I I. mA T Bill Kelley, property owner , testified to the intent of he and his wife to sell their properties , Lots 2, 3, and a portion of Lot 4, and relocate out of State. 12 . THAT Ms . Devon, Ms. Hoffman, Ms . Allen, Mr . and Mrs. King, Ms. Kelley, Mr . I. Hovland, Ms . Bartlett, ar,d Ms . Baker all declined to address the Commission regard- ing tht proposed Subdivision . BACKGROUND, A)SALYSIS, AND ALTERNATIVES IDENTIFIED · The proposed Chicken Ranch Estates Subdivision is located on the west side of the 4300 block of South Hwon Street and is zoned R-1-A, Single-Family Residence . Three separate parcel s containing a total of 19 dwelling units compose the area to be subdivided. The propo sed subdivision will result in the creation of five lots with four of the lots coch containing a single- family dwelling (proposed Lots I , 2, 3, aud 5) and one vacant lot (Lot 4). This subdivision will eliminate the nonconfonning use status (16 dwelling units on one parcel) of the parce l identified as 4377-<n South Huron Street. However, tile structu,al nonconformity of 4387 South Hwon Street and 4397 South Huron Street, that of not meeting ·ihe minimum side yard se tback , will not change as a result of tru s proposed subd ivision.
