WHEREAS . the Dillon Con _1 anies has submitted a planned developm ent to allow ilie
red evelopment of Trol1ey Square; and
WHEREAS , ilie Dillo n Co mpanies planned development is fvr the redevelopment of
p roperty located in ilie area bounded by West Floyd Avenue on ilie norili , South Broadway
on ilie east. Englewood Parkway on th e so uili , and Souili Bannock Street on the west, which
co nt.:1.ins ap proximat ely 5.5 ac res and is curr ently developed as mixed retail uses: and
IVliEREAS, the Dillon Co mpan ies Plann ed Deve lopment is in a B-1, Business Dis trict
and is in co mp li nn ce with the Planned [)evelopment regulation s and is consi st ent with the
intent and purpose of the Co mprehensive Plan: and
\VHERE.AS . the Dillon Co mpanies Plan ned Development wa.s co nsi'1 ered by the
Englewood Planning and Zoning Comm iss ion and a Public Hearing was held on April 18,
L95 and said hea ring was co ntinued to April 25, 1995: and
WliEREAS, the Planning a nd Zoning Co mmission did not approve ilie application by
the Dill on Companies Planned De velo pm ent io r the redevelopment of Trolley Square as
the ap pl icant ·ndi ca ted that the plan was not yet fi n al and details were to be worked out with
th e business ~ommunity : and
lvliEREAS, the applicant has co mpleted its plans detailing and inc orporating the
commu nity's conce rns ;

~-The City of Englewood Ci ty Counci 1 hereby approve s the Dillon Companies
Planned Redevelop ment of Trolley Square wi th the followi ng conditions:
I. Dedicati on of nine feet of property along the So uth side of West Floyd Avenue
fro m the entrance to King Soopers to South Broadway for purposes of roadway
imp rove m ents. Dedi cation of this prop erty will not be r equired until warranted
by traffi c co nditions as documented by the City of Engle wood Department of
P ublic Wo rk s .

THAT Steve Collins, PIP Printing , and Englewood Downtown Development Authority
Board member , tes tified in support oi the proposal , but also cited concerns r:garding
the mid-block access from Broadway, the maintenance of the "fabric" of ill~ downtown
area, and the appearance of the "fence" or "wall" along South Broadway .
11. TBA T Dave Paschal testified 10 owne rshi p of businesses fronting on Englewood Park-
way , and 10 his support of the proposed redevelopment. Mr . Paschal urged that ihe
City take steps 10 assure the maintenan ce of the parl:in ~ lot in the 3400 block of South
Acoma Street.
12 THAT Ron Straka , an urban design consul tant emp loyC<.\ by the Englewood Downtown
Development Authori cy, testified to the need for rede v, · . ~m ent of Trolley Square, and
addressed issues to be considered by th e Commis~ion, such as pedestrian and vehicular
movements , accommodation for the City's elderly population in the downtown area,
the "wall • along Sou th Broadway . the neec' for continu ity and cohe siv eness of the im-
provements with remaining businesse s in th e co mplex , the need for further study of
West Floyd Avenu e fr om Broadway west to S0uth Bannock Scree :.

DECISJQN
THEREFORE, it is the decision of the Planning and Zoning Commission that the application
for approval of a Planned Devdopment filed by Dillon Companies, Inc . not be approved .
Titls decision was reached upon a vore on a motion made at the meeting of the City Planning
and Zoning Com,nission on April 25, 1995 , by Mr. Garrett, seconded by Ms. Tobin , which
motion stares:
"The Planning Commissio n recommend approval of the Planned Development for redeve lop-

King Soopers Plann ed Develop ment . Add itio nally, a moti on was approved to ad vertise the date
of Council's fi nal consideration of the proposed Planned Development in the May 4, 1995 and
~l ay l , 1995 editions of the Fnglewood Herald .

Sq ·iare retai l ce nte r. The Trolley Square sit e is approximately 5.5 ac res in area and is curre ntly
co mp ris ed of the King Soo pers , Trolley Sq uare Liquo rs, Fant astic Sam 's, Anita's Coffe e Shop .
and Copy ~!asters .
This retail cen ter was tile fi rst project undertaken as a part of the urban re newal effort of the earl y
1980. s. The western portion of this site was originally a t:;iry om1ed parking lot and the eastern
portio n was compri sed of a mix of retail uses . The Trolley Square project was completed in 1984
and inclu ded the 51 ,000 square foot Ki ng Soo~e.-s as we ll as an additional 57,000 sq uar e feet of
retail space . With the exceptio n o the Kin:'! So o pers , the majori ty of the sp ace has remained
unoccupied since its co nstruction .
Cnder th e prop osed Pla nn ed De velopment th e site "ill be redevel op ed in two ph a;es . The fir st
phase "ill include the demolition of the Br oadway shops and the parki ng structure , exte nsion of
• the par king lot int o the dem olition area, closure of tn e eas ternm ost access to West Floyd Avenue ,
• and th~ crea tio n of a right-in/right-out mid -block access on South Bro adw ay . Phase two will
include the ex pansion of King Soopers and the development of the pad si te at the nonheast comer
of the si te . When completed the development will be co ntain a total of88,000 sq uare feet of
retail space , or a reduction oi20,000 sq uare feet fro m the original dev elopment size .
The City Planning and Zoning Commissio n considered the Planned De ve lopment at a Public
Hearing on Ap ril 18, 1995 . At that time the Applicant requested a co ntinuance of the Hearing to
April 25 , 1995 to allow additional time to prepar e revi sion s to their plan . On April 25, 1995, the
Commission receive d testimo ny fro m the City, the Applicant, the Englew oo d Downtown
Develo pment Authori ty (EDDA ), and several downtown busi ne ss people .
The public te sti mony received was in gene ral suppon of the proposed redevelopment of the site ;
howeve r, the EDDA and local busi nesses did expre ss co ncern over se veral issues . The staff
analysis found that the propo sed plan met bot h the 8 -1 zo ne di st rict ar.d the Planned
Cevelop ment requirements . Howeve r, the EDDA and their urb an design co nsultant questioned
th e adequa cy of the proposed redev elopment 's treatme nt of the urban street scape along South
Broadwa y and the justification fo r the righ t-out movement or. So~th Broadway as pre sent ed in
th e . .\pplicant 's traffic impact analys is . After discu ssio n of the se issue s a moti on to approve the
King Soo per s Planned De elop ment was made . The motion was deieated by a vote of thr ee to
four with rwo members ab se nt
On :'-,lay 4, 1995 representat ives fro m King Soope rs , EDDA. th e Planni ng and Zoning
Com.-nissio n. and City Staff met to revie w and disc uss the outstan din g issues surrou ndin g the
• proposed Pl anned De velopment . The follo ,ving is sues were addressed and reso lved :

Mid-blo ck Br oadway right-in/right-o ut· Agreement was reached that this ingress/egress
poin t sho uld remai 11 Pu blic Works Dep artme nt staff\Vi ll assist with the design of the
traffic island fo r this access point:
Broadway wall • Agreement was reached that the wall is necessary and will be cons tru ct ed
to a he igh t of 3 feet 6 inches . Three columns will be included in each sectio n of wall. The
columns will be constructed to a height of 9 feet 6 in ches . King Soopers wi ll provide fo ur
benc hes along the wall and EDDA will pl ace decorat iv e met3.l work on top of the wall .
Pad site • Agreement wa s reached tha t no details fo r th e proposed building ,vi ii be
presented in the P. D. An amendment to the P. D will be required befo re deve lopme nt of
th e pa d site will be approved .
Parking lot landscaping • The existing landscaping is in conform anc e wi th the landscape
regula tio ns of the Zoning Ord:nance . No additional 'la nd scapi ng will be req uired .
Signage . Signage "i ll be in conformance wi th the sign re gula ti ons of the Zoni ng
Ordinan ce ln addit io n to the existing sig nage three joint identific ation signs are propos ed .
• Light ing -Site lighting will be in conformance with the lighting regulations of the Zoning
Ordinance .
The opt ions available co the City Council are to approve the proposed Planned Developm ent,
conditionall y approve the proposed Planned Development , or deny the proposed Planned
Development .
FlNANCUL IMPACT:
The pr oposed Planned De velopment will result in the revitalization of a commercial de velopment
th at has fo r man y year s not performed to its full potential . King Soopers has indicated that the
perfo rmance of this store has decreased over the last three : elll's . The y assert that the below
average performance can be linked to the access ai ,d visibility is~ues . Thus ti .e redevelopment is
desi gned to address these problems an~ ~esult in improved pe .-fo,mance of thi s store .
The ant icipated inc reas e in sales will generate more revenue for the City as a re sult of the ac cess
and visi bility impro veme nts . The pr oposed expansion of Kin g Sooper s ,viii further increa se sal es
tax revenue to the Ciry si nce the expan sio n wi ll increase the ,;umber of no nfood item s so ld . \Vhi le
th ere is no guaran tee that King Soo pe rs "111 rem ai n at this locati on if the P. D. is approved . it is
reasonab le to assume tr.at if it is no t appr oved the ir incentive to remai n at this site would be
diminished si gni fic ant lv Th e vi ab ility of this de velopment will hav e a maj or impact on the ov erall
eco no mi c heal th oi the entire downt own ar ea .
