Windhager for STAFF SOURCE : Robert Simpson, Man- Trammell Crow Res idential Service•, ager of Neighborhood and Business Devel - opmen: COUNCIL GOAL AND PREVIOUS COUNCIL ACTION; Council Goal · Previous Council Action· The original Planned Development for The Marks cevelopment was appro ved by City Council in 1985 . On , October 16, I 995 , City Coun cil held a public hearing on the Planned Development Amendment RECOMMENDED ACTION : Staff requeslS City Cou ncil approve by resolution th e proposed amendment to The Marks Planned Develop ment. BACKGRO UlSD ; Co u•ncil considered thi s request on October 16 , 1995 . Concern was expressed about the lack of specificit y in the request condition s regarding I) Whal is meant by continuous?, 2) What is a negative impact? These co ncerns have been addre ssed and are introduced as part of the Council Resolu ti on . First , continuous will generally mean that only one car at a time ma y pass throu gh the ga te , and two , negati ve impact will generally mean that no acc idents , or car stacki ng does not creat e impediments 10 traffic flow . The remainder of this report is un - changed from previous Council Communications . "The Marks-. a high-density residential developm ent , was constructed in the mid -to late 1980's on the former KLZ Radio To we r site at South Lafayette Street and US 285 . Access to thi s high den sity site , throughout the vari ous developments of Kimberly Woods , Kimberly • Vill,,ge , the Waterford , and The Marks , has been restri cted to protect the single-family resi- dential areas abutting on the nonh and on the west. Primary access is from US 285 at South • • Gilpin Street, and from East Girard Avenue at South Lafayette Street. Staff was made aware in 1993 that The Marks development had been divided by sale . At that time , one management company oversaw the rental/leasing offices for both Lot I (The Marks West) and Lot 2 (The Marks). Currently, Lot I and Lot 2 are managed by different compa- nies , and there is need for more direct access to The Marks West marketing office . The City recognizes the need for the additional point of access, but also recognizes the neces- sity to protect the adjacent neighborhoods from a greater influx of traffic . The Public Works Depanment has suggested that the point of access be gate controlled, and be for entrance pur - poses only ; the applicam has agreed to this restriction . FINANCIAL IMPACT: The improvements for the point of access will be at the expense of the applicant. No expendi- ture will be required of the City . UST OF ATTACHMENTS: Resolution • •
