ATENCIO AS ASSOCIATE MUNIC IPAL JUDGE FOR THE CITY OF ENGLEWOOD, COLORADO . · WHEREAS, pursuant to Article IX , Part II, Section 68, of the Englewood Home Rule Charter, "Council may appoint one or more as sociate judges, who shall sit at such times and upon such causes as shall be determined by the presiding municipal judge;"' and WHEREAS , because Vince Atencio's present term expires as of May 6, 1994; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF E NGLEWOOD , COLORADO, THAT: ~-Vince Atencio , sh all be and hereby is reappointed as As sociate Municipal Judge in and for the City of Englewood, Colorado , for a term commencing May 6, 1994 and expi ring May 5, 1998. PREVIOUS COUNCIL ACTION Council passed an ordinance 1-7-3A (2&:3) in 1990 (at the request of the Court) limiting the associate judges terms to four years . An associate judge must be admitted to the Bar of the State, must have practiced for at least hyo years, and must reside in this City . Porter and Atencio meet these criteria and have been associate judges since May 1986. BACKGROUND Both associa~.<! judges have served the Muni,J pal Court well through the years and are needed to s,t when the full-time elected judge has had to recuse himself (due to companion case, know,; the defendant, etc.) or when he is out of the office for meetings , vacations, or illness. STAFF ANALYSIS There are four ,other associate judges: one currently has serious health problem~, o.,e is gone during winter months, and th e other two have busy la w practices . It is not easy to find attorneys that reside in the City and are willing lo give up any cases th•!Y might have in this court in order to sit. FINANCIAL IMPACT Asaociate Judges are prud $3( J per day (with amount reduced for less than a full day). They are paid only when they sit and do not ha ve any other compensation as part of the appoinbnent .
