A RESOLUTION FOR REAPPOINTMENT OF TRACEY M . PORTER AS
ASSOCIATE MUNICIPAL JUDGE FOR THE CITY OF ENGLEWOOD,
COLORADO .
WHEREAS, pursuant to Article IX, Part Il, Section 68, of the
Englewood Home Rule Charter, "Council may appoint one or more
associate judges, who shall sit at such times and upon such causes as shall
be determined by the presiding municipal judge;" and
WHEREAS, because Tracey Porter's present term expires as of May
5, 1994;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ENGLEWOOD , COLORADO, THAT:
~-Tracey M . Porter, shall be and hereby is reappointed as
Associate MuniC:pal Judge in and for the City of Englewood, Colorado, for a
term commencing May 5, 1994 and expiring May 5, 1998.

ISSUE/ ACTION PROPOSED
The Municipal Court recommends the reappointment of Associate Municipal Court Judges
Tracey Porter and Vincent Atencio to third four-y ear terms expiring May 5, 1998.
PREVIOUS COUNCIL ACTION
Council passed an ordinance l -7-3A (2&3) in 1990 (at the request of the Court) limiting the
associate judges terms to four years. An associate judge must be admitted to the Bar of the
State, must have practiced for at least two years, and must reside in this City. Porter and
Atencio meet these criteria and ha ve been associate judges since May 1986.
BACKGROUND
Both associate judges have served th e Municipal Court well through th e years and are
needed to sit when the full-time elected judge has had to recuse himself (d ue to companion
case, knows the defendant, etc.) or when he is out of the office for mee tings , vacations, or
illness .
STAFF ANALYSIS
There are four other associate judges: one currently has serious health problems, one is
gone during winter months, ar-d L'1e other two have busy law practices. It is not easy to A find attorneys that reside in the City and are w illing to give up any cases they might ha ve
W in this court in order to sit.
FINANCIAL IMPACT
A.wociate Judges are paid $360 per day (with amount reduced for less than a fuJJ day).
They are paid on'.y when they si t and do not have any other compensati on as part of the appointment.
