Th is prope rty was annexed 10 th e City by Ordinance Number 23, Series of 1957 . In
1985 this prcpe 11y was grant ed a Subd ivisi on Wavier by the Planning Commission . At
that ti me , the Subd ivi sion R~gulati on s provided for a "Waiver' if no public bene fi t
wou ld be gai ned by requi ri ng the property owner to subm it to the full subdivision
proc ess. Subsequent to th gr:in ti ng of the River Drive Subdivision Wav ier, the
Subdiv isi on Regulat ions were amend ed an d the Wavier provisions repealed.
The re has been no de velopment oi the property under the approved Ri ver Drive
Subd iv is ion Wai ver . Since th e present owner's proposed development of the property
does not con fo rm with the existin g Subdivision Waiver, development of the property
must conform with the current Subdivision Regulations .
COMMENTS FROM OTIIER PEF\RTMENTS:
The proposed Ness Subdivi sion Pre li minary Plat was re view by th e Techn ical Re view
Comm ittee on March 9, 1993. The following comments were made :

This anal ysis is based upon the po ints that the Commission must consider .
I. The area surrounding the subjec t prope11y, within Englewood is zone 1-1, Light
Jndusuial . The property adjace nt to the subject property's south property line, within
the City of Sheridan is zone D Commercial .
2. The 1-1 zone disuict does no t have lot frontage or lot area requirements.
3. The owner has worked with the Utilities Depanment to extend the existing
water line in South Platte River Drive south to service this property. The sewer service
will be gained from the existing lines in South Platte Ri ver Drive .
4 . The su bje ct propeny is not with in a designated special flood hazard area .

ISSUE/ ACTION PROPOSED
Council consideration is requested of the attached resoluti0n approving the subdivision of
property located on the east side of the 3300 block of South Platte River Drive .
PREVIOUS PLANNING COMMISSION ACTION
In 1985, the subject site was granted a Subdivision Waiver by the Planning Commission. At
that the time, the Subdivision Regulations provided for a "Waiver" if no public be,,efit
would be gained by requiring the property owner to submit to the full subdivision process.
Subsequent to the granting of the River Drive Subdivision Waiver, the Subdivision
Regulations were amended and the Waiver provisions repealed . There has been no
development of the property under the approved River Drive Subdivision Waiver.
A Public Hearing was held before the City Planning & Z.oning Commission on March 16, 1993,
on the Preliminary Plat. The Preliminary Plat was approved on a unanimous vote of the
Planning Commission. The Final Plat was considered by the Commission on April 6, 19'J3, .ind
they voted unanimously to recommend approval of the Ness Subdivision .

BACKGROUND

The s ubject property is located on the east side of the 3300 block of South Platte River Drive.

contains 3.38 acres, and is bounded by South Platte Ri ver Drive on the west, and the Engle-•.
wood/Sheridan City Boundary on the south. The site is zoned 1-1, Light Industrial , as is the
adjacent property within Englewood. The adjacent property in the City of Sheridan is Zonej
"D", Commerci al.
Mr. John Ness, President of ess Manufacturing, recentl y acquired the property, and wa nts to
relocate his business from Denver to this ;ite . Mr. Ness proposes to divide the property into
four lots, twc-of which wi ll be used for hi s manufacturing business . Since the present owner's
proposed development of the property does no: conform with the exi sting Subdivision Waiver,
de\'elopment of the property must co nform with the current Subdivision Regulations .
STAFF ANALYSIS
The subject property is zoned 1-1, Light Industrial, as is the adja::ent property within Engle-
wood . The property adj acent on the south (in Sheridan) is zoned "D", Commercial . The
owner has worked wi th the Utilities !Jepa1tment to extend the existing water line in South
Platte Riv er Drive south to serve the property, and r,ew er servire will be from the existing
lin es in South Pl atte River Drive. The site is not within a designated special flood haza rd
area . There are M streets proposed within the subdivision, and no additional right-o f-wa y
is required in this area. Th e owner has petitioned the Ci ty to be included in Paving District
#36 so that the portion of South Platte River Drive adjace.nt '.? his property is brought up to
City standards; this will incl ude the installatinn c f curb, gutter and side\ a lk .
Utility easements for Public Service Company and l:.S. West will be determined after the exact •
nature of development is determined . No City utility easements are proposed in the subject
site . Public Works Department did not require a drainage study for the property; however, all
drainage must be directed to the street.
Based on the above anal ys is, staff recommends approval of the Ness Subdivision Final Plat.
