HomeMy WebLinkAbout1993 Resolution No. 082• • • RESOLUTION NO . ff A SERIES OF 199~ A RESOLUTH 1N SUBMl'ITING TO A VOTE OF THE REGISTERED ELECTORS OF TH E CITY m ENGLEWOO D AT THE NEXT SCHEDULED REGULAR MUN1CIPAL ELECT ION A PROPOSED SPECIAL IMPROVEMENT ASSESSMENT TAX Tv BE IMPOSED UPON THOSE PROPERTIES WITHIN THE BOUNDARIES OF .;PECIAL ASSESSMENT DISTRICT COMMONJ.Y REFERRED TO AS THE NAVA;O STREET S PECIAL ASSESSMENT DISTRICT WITHIN THE CITY OF ENGLEW(;QD FO R CONC RETE, SIDEWALKS, CURB, GU'ITER AND AS PIIALT PAVING IMPROVEMENTS IN CONJUNCTION WITH THE STATE OF COLORADO DEPARTMENT OF TRANSPORTATIO N SANTA FE PROJECT AND AUTHORIZE DEBT TO PAY FOR THE IMPROVEMENTS. WHEREAS, wi th the passage of Re so lution No. 9, Seri es of 1992 which formed Pavi ng Di strict No. 35 (Navaj o Street), and Ordinance No . 17, Series of 1992 which cr eated the District, a Public Hearing wos hel d, Ph ase I • Oxford Avenue to Stanford Avenue const ru ct ion is nea ring complet io n constru ction bei ng accomplished by COOT: and WHE REAS, pursuant to an order of the City Cou ncil, the City Engin eer h as prPpa.-ed and filed preli minary plans, specifications, estimates of cost, maps and schedules for t.he propo~ed i mprove ments; NO W, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE C ITY OF ENGLEWOOD , COLORADO , THAT : Sw.i.2n..l. Pursuant to the provisions of law the City of Engl ewood h ereby submits fo r a vote of th e registered electors of the City of Engle woo d at the 1993 Municipal El ection the fo llowing bnll oL questions: SIL<\LL THE CITY OF ENGLEWOOD DEBT BE INC REASED $500,000, WITH A REPAYMENT COST OF $728,500; AND SHALL THE CITY OF ENGLEWOOD TPJCES BE INC REASED $90,000 ANNUALLY (over the life of the district th e sum of the tax i ncrease shall not exceed the sum of $7 28,500), such amount to be issued fo r the purpose of paying for the costs of removing and repla ci ng substandard co ncrete curb, gutter , and sidewalk as well as installing asphalt paving to min i mum City spec ifications for paving district the tax to be imposed over a period of ten yeart1 and onl y upon propertie s loc ated within locnl improve~ent distri cts crea ted within the City; such taxes to co ns is t of special assessment bonds payabl e so lely fr om · lhe proceeds of special assessments or other legally availa ble moneys of the City and the proce ed,, of such bonds and specia l assessments, and investment incom e th ereon , be collected nnd spent by the City witho ut rega rd lo rny expenditure, reve nue-raisi ng, or othe r limitation con tained within Article X. SJ:ww, By approving thi1 Reaolution the City is not stating that ,pecial assessment■ are by any law taxes. It is the purpoae of this Resolution ta addre11 the i11ua offlnanclng special improvement projects in the most econo mical manner and to avoid expensive, time cons uming liligntion and the uncertain1ies thereof.
