HomeMy WebLinkAbout1993 Resolution No. 083• • • RESOLUTION NO . 73 SERIES OF 1993 A RESOLUTION SUBMITTING TO A VOTE OF THE REGISfERED ELECTORS OF THE CITY OF ENGLEWOOD AT THE NEXT SCHEDULED REGULAR MUNICIPAL ELECTION A PROPOSElJ SPECW, IMPROVEMENT ASSESSMENT TAX TO BE IMPOSED UPON THOSE PROPER ~IES WITHIN THE BOUNDARIES OF A SPECIAL ASSESSMENT DISTRICT TO BE FORMED WITJ-IIN THE CITY OF ENGLEWOOD FOR CONCRETE, SIDEWALKS, CURB, GUTTER AND ASPHALT AND CONCRETE PAVING IMPROVEMENTS AND AUTHORIZE DEBT TO PAY FOR THE IMPROVD1ENTS . WHEREAS, 3400 So uth Emerson Street and 900 East Dartrn ,uth Place are in need of street repair. curb, gutter, sidewalk and stonn drainage imp, vements to m eet municipal City standards and to stay reasonably clo se to schedule : and WHEREAS, the City Council of Englewood, Colorado has determi ned that it is necessary to create a local or special improvem ent di strict within the City fo r th e purpo se of const ru cti ng a nd installi ng street paving, curb, cutter, sidewalk, and storm drainage improvem ents, togeth er with necessary incide ntal s, within an undeveloped area in the City, all as set fonh in this Resolution, and to assP.ss the cost of the improvements against th e real pro pe rty specially benefited by the improvements and incl uded within the district; a nd WHEREAS , pursuant to an order of the City Council, th e City Engineer has prepared and fil ed prelim inary plans, specification s, estimates of cost, maps and schedules for the proposed impro \•ements; NOW, THEREFORE, BE IT RESOLVED BY THE C ITY COUNC IL OF THE CITY OF ENGLEWOOD , COLORADO, THAT: ~-Pursuant to the provi sio ns of law the City of Engl ew ood hereby submits for a vote of the registered elect.ors of the City of Englewood at the 1993 Munici pal Election the following ballot q uestio n s : SHALL THE Cl'i'Y OF ENGLEWOOD DEBT BE INCREASED $50,000, WITH A REPAYMENT COST OF $72,850; AND SHALL THE CITY OF ENGLEWOO D TAXES BE INCREASED $9,000 ANNUALLY (ove r the life of the district the sum of th e tax increase shall not exc ee d the sum of $72,850), such amown to be issued for the purpose of paying for the costs of new construction and the removal and rep lacem ent of s ubstan dard co ncrete curb, gutter, and sidewalk as well as installing asphalt and concrete paving to minimum City specifica ti ons for paving district the tax to be impo se d over a period of ten yea rs and only upon prop ertie s loca te d within }or.al improvement districts created within th e City; such tues to con sist of special assessment bond s payable so lely from the proceeds of special asse ssments or other legally available moneys of the City -.,,ci the proceeds of such bo nd s and specia l assessments, and investment inco m e thereon, be coll ected and s pent by the City without regard to any eX])en diture, revenue- raising, or othe r limitation co ntained within Article X, Section 20 of th e Co lorado Constitution? YES NO __ ~ If the majority of' the registered electors voting at said election vote yes for said proposition the City Council shall at the earliest practical and lawful time adopt an ordi na nce confonning to the affirmative vote of the majority or said regiatered electors voti ng at said ~pec:ial election. ~-By approving this Resolution the City is not stating that special assessments are by any law taxes. It ia the purpose of this Resolution to addreH the iasue of financing special imp rove ment project.a in the most economical manner and to avoid ez-penaive, time co nsuming litigati on and the uncertainties thereof.
