WHEREAS . Ordinance No . 3, Series of 1993 concerning Massage Therapy Clinics and their regulatio,, st.Ill.es under ~5.5.4 A that ,uch application for • permit shall be filed with the Licensing Officer of the City; and WHEREAS, EMC 5-1\-2 defines "Local Licen sing Authority" as the City Council of the City of Englewood or such designee as it shall determine by resolution ; and WHEREAS , in order to expedite the issuance of routine license applications in a competent and thorough manner the Licensing Officer should iasue li censes and perform the day to day administration of the Massage Therapist Licenses; and WHEREAS, the new Code calls for a high degree of profe&Sionalism on the part of the massage therapist and provides sufficient reguJ :,tion to protect the community; and WHEREAS , the Director of Financial Services is de si gnated as the Licensing Officer of the City of Englewood for other miscellanea .. ; regulatory licenses under the Code and should also be designated the Licensing Officer for Massage Therapist lic enses tc, reduce confusion ; NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, THAT: ~-The Liceniing Officer for the City of Englewood is hereby designated as th l' Local Licensing Authority tr. review and approve or disapprove applications submitted in accordance wi t.h Title 5, Chapter 5, Englewood Municipal Code, 1985. ·"'°"'° AND """°""D o;,>oili a.,~?' & ~ ATTF,ST : /~ -~~ {dtu~~d/-~ Patricia H. PREVIOUS COUNCIL ACTION Ordinance No . 3, Series of 1993, is the most rece nt ordinance amending Title 5, Chapter 5, and was approved by City Co uncil on January 7, 1993 . BACKC,<OUND At the time Ordinance No . 3, Series of 1993, was approved , a li censing designee for Massage Therapy licenses was not identi fie d by City Council. Without that designation , City Council retains the autho rity to re view and approve or disapprove applications that a:e ;ubmi tt~d in accorda nce with Title 5, Chapter 5 of the Englewood Municipal Cod e, 1985. STAF" ANALYSIS Staff has reviewed the Englewood Municipal Code, 1985, and concurs th at it is necess.iry for City Council to designate a local licensing authority to review and issue licenses under Title 5, Chapter 5. It is the reco mmendation of staff th at this aut~.ority be designated to the Licensing Officer, who is identified in the Englewood Municipal Code as tht Director of Fin ancial Se rvices . This recommendation is in ke eping w it;, designation of the Li ce nsing Office r for other misce llaneous/regulatory li censes und er this section of the Code. This issue was re viewed by the Liquor Licensing Authority on November ~. 1993 . The Authority supports staff's recommendation that the Licensing Officer be de signated as the licensing authority.
