ISSUE/ ACTION PROPOSED
Approve a Resolution for the Planned Development submitted by Waste Management
Denver South for the property located, at 2400 W. Union. Waste Management bought
this property from the City last year with the Intention of expanding their current
facility. Since Council was aware of the plans at the time of the sale, and the
planned development appears not to be a controversial Issue, staff suggests that no
PubU c Hearing Is needed In thls case.
PREVIOUS COUNCIL ACTION
On Septr.mber 16 , 1991 , Co uncil ,,.;,,f'ted Resolution No . 54, Series 1991. a pproving
the sale of this property to Waste l · •.agement of Denver • South.
STAFF ANALYSIS
This Planned Deve lopment Is required as a r esult of the purch ase and proposed
deve lopment by Waste Man agement of the former City greenh ou se property. This
property Is In excess of one acre In s ize and therefore the Planned Development Is
n ecessary. The proposed d evelopment Is an eiq:ianslon of the existing Waste
Management operati on. Th e Planning Co mrnJsslon h as detennlned that the proposed
de velopment Is consistent \\1th the standards by whi ch Planned Developme n ts are
evaluated .
One lallue that has been raised durtng the review of the proposed Planned A..
Development was the handling of stonnwater runoff. The Utlllties Department has W9
had several dlacusslow wi th Waste Management concerning the pote ntial dlscharge
of stonnwater from thJs entire site Into the South Platte River upstream of the City's
raw water Intake.
As a result of these dlscusslons Waste Management agreed, In December 1991, to
undertake remedlal action to prevent the dlscharge of untreated runoff Into the rtver.
Waste Management further agreed to provldlng written confinnation of tl1elr planned
action. however, at the time of the preparation of the Staff Report for the Planning
Commission, confirmation had not been received . Lacking thJs conflnnation the staff
recommendation was to deny the requested Planned Development until the
confirmation was received and approved by the Uttllties Department.
Subsequent to the preparation of the Staff Report, It was dlscovered that Waste
Management had In fact, written a confirmation letter, but It was Inadvertently
mJsdtrected and not received by the Utlllties Department. Upon receipt of the letter.
the day of the Planning Commission Publlc Heartng, the Utlllties Department
reviewed and approved the letter as meeting their requirements.
At the Publlc Heartng, Staff advised the Commission that the confirmation letter had
been recetvcd and approved by the Uttllttcs Department end therefore the staff
recommendation was changed from dental to approval of the Planned Development. A.
As a part of the approval of the Planned Development, the CommJsslon required that ..
the Utlllties Department provide signed approval of the confirmation letter received
from Waste Management. Thls approval was attached to the Ftndlng of Fact and
approved by the Commission at their February 19, 1992 meeting.
BACKGROUND
The area p roposed Planned Development was annexed to the City In 1959. There
record of the development activity of thJs property prior to the mld l 970's ts
In co mplete . Tlus property had served as the City's greenhouse for many years. In
U1e late l 980's the property was leased to a floral design school whJch operated there
fo r a sh ort time . In 1991 the property was purch ased by Waste Man age m ent fo r
expansion of ther e a dJ ac--nt operation.

Th e Planned Development regulations require that a Planned Devel-
opment be filed and approved for all industrial property of one
acre or more. At the time the existing Waste Management site was
developed, Planned Development approval was not required. Thu ■,
this Planned Development application is te~hnically for only the
newly acquired greenhouse property . However, the applicant has
provided site information for the entire existing development to
assist i n the e valuation of the proposed Planned Development .
In reviewing a Planned Development, the following standards are
to be applied:
1. Us es permi tted . Th e use of the property which is the sub-
j ect of the Planned Development, shall be a Permitted Prin-
cipal Use in the zone distri ct i n which the Development is
located , or a use permitted pu rs uant to other provisions of
the Zoning Ordinance.
The proposed use of the property is f or an expan sion of the ex-
isting Waste Ma ,1agement operation 1,hich will include conver sion
of the greenhouse to a s hop facility and the balance of the site
,sparking and stora1e of vehicles and e quipment. These use s are
permitted in the I-1 Zo ne District.
2 . The Planned Development shall be c~nsistent with the intent
of the Comprehensi ve Plan and the policies therein.
Ttis proposed Planned Development is consistent with the Compre -
hensive Plan and policies and furthers the development of indus -
trial property wi th uses that are compatible with adjacent uses.

J. The Pli.nned Development's relationship to its surroundings
shall b · considered in order to avoid adverse effects t o the
existing and ;,ossible future develop::ient caused by traffic
circulation, building height or bulk, ladle of screening or
intrusions of privacy.
This proposed Planned Development will allow for the expansion of
ex i sting uses. The site is adequately screened from adjacent
uses and is compatible with those uses. Access to and circula-
tion through the site is im proved a s a result of the proposed de-
velopment.
4. Minimum requirements for usable open space shall be se!-.
through the overall design and amenities proposed for deve ;-
opment.
The landscaping provided f or this development is in compliance
with the r e quirements of the Comprehensive Zoning Ordinance.

velopment shall not be less than the requiremar.~ of the Com-
prehensive Zoning Ordinance.
Adequate parking is provided on the greenhouse site, as well aa
on the ex isting development .
6 . Site Plan. The approving ag,rncies shall be satisfied that
the s i te plan fo r the Planned Development meets all the fol-
lowing requir~ments:
a. If th e proposed development include s multi-family or
no nr esident i al buildings or structures and i s adjacent
to a single family residential use dist rict , the devel-
opment s ha l l c on tain a buffer .

The proposed development was, in part, undertaken to provide for
better access and circulation within the entire development . The
proposed circulation system will more efficiently move traffic
into and through the site while providing for the necessary sepa-
ration of functions to insure public and customer safety while on
site .
d . Bi cycle and pedestrian trails are to be provided where
the City bicycle and/or trail plan or the Regional Bi-
cycle Transportation plan shows such trail or trail
corridor.
Bicycle or pedestrian trails are not proposed for the subject
site.
e. 1'he s ite plan shall provide for the maximum preserva-
tion of natural drainage areas, vegetation and other
desirable f eatureb.
Drainage, as indicated in the Utilities Manager's memo, is of
particular concern to the City. A proppaed course of action has
been agreed to by Waste Management and the City; however, no for-
mal documentation has been presented concerning this issue.
Given the critical nature of this issue, the recommendation of
the Department of Community Development is that the proposed
Planned Development be denied until such tine that the documenta-
tion is prese nted to and approved by the Utilities Department.

2 . THAT the proposed amendment were considered by the Planning and Zo n ing Commission
at a Public Hearing on February 4, 1992.
3 THAT testimony was received from the public and in the form of the Staff Report
which was made a part of the record.
DECISION
THEREFORE, it is the dac:ision of the Planning and Zoning Ccanission that the proposed
Planned Development be approv"?d subject to the approval of the surface drainage system
by the Utilities Department, and referred to City Council with a favorable
rec0111119ndat ion .
This decisi on was reached upon a vote on a motion made at the meeting of the City
Pl anning and Zoning Commission on February 4, 1992, by Mr . Glynn, seconded by Mr.
Drape r, wh i ch mot i on states.
The Planning Commission rec0111119nd approval of the planned development
requ~steo by waste Management Denver South, subject to signed approval by the
Ut 11 i tie~ 14anager of the City of Englewood on the surface drainage system . This
rec r Jat i on shall be referred to City Council fo r their consideration.

Waste Management of Denver South Proposed Plan
We have met several times with representatives of Waste
Management of Denver -South in regards to t he quality of
the stonnwater that is generated on site and is discharged
to the South Platte Ri ver . Since the raw water intake f.or
the City's drinking water supply lies immediately downstream
of that s t ormwater discharge, the r unoff from the existing
site as well as form the old gre~n house site wa s included
i n the discussion.
The outcome of the discussions wae, th.a 'c Waste Management
plans t o direct the stormwater from the greenhouse site to
the existing site, construct a stormwater collection pan
a long the perimeter of the existing si'ce, and construct a
sediment/gre~se trap in the stormwater discharge line. This
was agreed to at a meeting in December .
Waste Man agement officials have said that they would send
written confirmat ion of our agreement and preliminary pla ns
for the stormwater syst e m. At th is t ime, th is
c orrespond ence ha ~ no t been sent, and therefore th e
Uti lities Department c annot approve the propo sed plan for
Wa ste M~nagement 's greenhouse site at t h is t ime .

l9!ll wh en you toured our facility with myself and our Environmental
Compliance ~anager, Bruce Cl abaugh .
As we discussed, Waste Management of Denver -South (WMDS)
appr eciates your questions and concerns about storm water discharge
from our site into th• Platte River, and we agree some improvemente
mus t be made to our present system. At our meeting, we mutually
agreed that WMDS will install an asphalt "V" pan along the eastern
property line to allow •torm water to drain into a nnd and grease
trap to be located above our trailer pit near the sr•utheast corner
of our property. In addition, it will remain our policy to sweep
our lot on a weekly bas i s of any excess oil re•idue from our
vehicles that is absorbed with oil dry material. Furthermore, we
will maintain several absorbent booms along the exi:iting "V" pan
to c a tch any e xc ess oil in the event of a storm until the ■andtrap
i s installed,
we have con tracted with Randall & Blake, Inc, (RBI) to complete ~ur
site de velopl\',ent plan . Dan Almond is RBI's representative who is
c urrently wo r king with Rick Kahm and Harold Stitt at your otfice
on t ha specif ic details . If the weather permits , th is next month
we will be able to have a survey and drawing s completed in time !or
our hearing with the Planning and Zoning Commission, In any case ,

We have reviewed the December 27, 1991 correspondence from
Mike McGee of Waste Manage11ent of Dem•er -South regarding
the improvements to the on-site stormwater collec l on and
treatment.
Although the preliminary plans have not yet been subm i tted,
it appears fr om the correspondence that the requ i red
im provements will be constructed.
The Uti l ities Department accepts the c orrespondence as
evidence that the imp r ovem e nts will be constructed, and
therefore , does not wish to slow the current zoning
pr, ;edure .
