Lessor shall receive, on o weekly ba sis, co pie s of sign-in sheets from the previous wee k's Youth Activity Center. ARTICLES. USEOFPREMISES. 3.01 . Perm'ilted Use Lessee shall operate the leased pr emise& as a Youth Activity Cent.er during the t,,rm of this Lease and shall use the premi1es for no other purpo1e. 3 .02 Youth Attjyj•y Center Defined The term "Youth Activity Center" as u.sed in this Lease means that th e leased premi ses shall be used for activities on Saturdhy nights for person s from and including the ages of 9 through 14, for , but not limited to, the following lYJl C activities : A , Gome Act ivities : consistin g of, for example, games auch aa volleyball, buketball, racquetball, wallyball, danc in g, ping pong, video games, and lhe like, including any activities which may be available but not listed stemming from the uniqueness of the leased premises; B. Audio and Video Adi vi tic,: including, but not limited to, performance s or penon(s) tc coordi nate and direct t he playing of records, videos, laserdiscs and the like; C. E,Qgd Drink and Concession Acti Yit.ies: including the sale of so fl drink s, sandwiche s, chips, candy bars, banners, T -s hirts, etc. Lessee will obtain th e required City of Englewood sales tax license and wi ll comp ly with all applicable C ity ordinances and health regulations; and D. All adv ertising and morketini: promoti on s related tc the Youth Acth•ity Ce nter as approved by the Rec reatio n Center Supervisor . 3.03 Manner of Ooera tfon Dur ing th e te rm of this Lease and any extensions , Lessee shall kee p the leased pr emises reasonably stoc ked with concessio n merchandi se, including so ndrink s and food, and rea sonably st.o ffed to adequately se rv e the pat.ron s. Lessee mu st ope rate th e Youth Activi ty Center on the leased premi ses in a diligent and efficient manner. Le ssee must keep the lensed premi ses ope n for busin ess from 7:00 o.m. to 12 :1)0 midnight on eac h Saturday of th e mo nth durin g the te rm of lhis Lease, except Les,<"' i, not requir ed lo operate its busin ess on legal ho liday s, no r duri ng any li me wh en such operatio ns mu st be sus pended because of cas ualty loss to the leased premi ses nndfor the build ing in which th e lensed premi se s er e located , strik e, insurr ec tio n, or othe r cnuse beyo nd the control of Le ssee. 3.04 . Lessor shell, el its own expen se and ri sk , mn intain th e leased premises including but not limite d to maintenance of the roof, foundntion, plumbing, hea ting, ond all structural soundness or the exterior wa lls (including ell windows, window gloss, plate glass and doors), perking lots, walkways s urrounding the lensed premises or the building in which the leased pre mi BO!' art: 1ocoted, stairwnys, and elevators, also including b ut not limited t.o repairs and ell nec,11~s17 ro ploce men ls or these items. 4 .02. Waste of Nuisance. Except as provided in 4 .01 , Lessee shall maint.oin the leased pre mi ses and keep them free from waste or nuisance through out the Lease te rm and any exte nsion . Al th e termination of the Lease , Lessee shall surrender and deliver the leased pre mises to Lessor in a s good a state ofrepnir and condition as they wr e in at the time Lessor delivered possession to T~ssee, reasonable wear and tear an ; d P.mage by fire, tornado or other casualty excepted. However, Lessee and Lessor r<r10~.1ize that ordinary wear and t ear moy include stains from food, drinks, candy, and gum. Lessee will make a good (nith effort to clea n up s uch st.-ins but sha ll not be required lo unde rtok e major capital expenditures for r emoval of such stains nor any structural repa irs which rnny be cau se d by s uch stains. 4.03 . Failure to Perform In the eve nt eith er party foil s to pe rfo rm its obligati on to re pa ir or m a intain as set forth in 4.01 a nd 4.02 abeve alur notice from the other party of the need for s u ch repair or mai ntena nc e and the passage of a reason able a mount of time for performnn;•e on er s u ch notic e, lhe othe r pn rly may terminate thi s Lease or ol its oplion, s u spend busi ness op e rations un t il such r ep airs or mai ntena nce e re compl eted. Gnrh•g• Rem oynl Lessor sh all pay for the removal of oil gorbngo and rubbi sh fr om th e lease premises during the term of the Lease. ARTICLE 7. ALTERATIONS, ADDITIONS, AND ll\{Pli.Q\IEMENT, 7.01. Consent nf Lessor . Lessee shell not mak e ony o1ter ation s, ntlditions, or impr ove ments to t.hc le ased premises wiLh'out the prior written co nse nt of Lessor . 7.02 . Property of Lessor-AH alterations , additions, or improvements made by Le ssee shall beC<>me t:1e property of Lessor, et the termination of this Lease . Lessor may, however, require that Leesee remove any or aH alteration&, additions , and improve ments installed or made by Lessee, and any other property placed on the premises by Les·ro e, upon termination of the Lease. In th e event that Lessor requires Lessee Lo remove such alterations, add itio ns, or improv ements, Lessee shall repai r any dom nce lo the pr emises caused by such removal . Lestee may erect sign& on portions of th e leased premises and portion s of the building in .. ,hich the leaaed premises arc located, &ubject to the approval of the City Recreation Center Supervisor. ARTICLE 9. INSURANCE AND INDEMNITY. 9.01. Property Insurnoc:e Lesso r shall, at its ow n expen se, during the te rm of thi s Lee se, keep all buil dings, struct.ures, imp ro vements, fixtures, and eq uipm ent, which ore not pe rt of the leased premises but are require d for access of enj oym nt of th e l.·:::d premises in su red a~i, .st loss or damage by fire or theft. 9.02. Liobilitv Insurance Lessee shell , at its own ex pen se, during the t erm of this Lease, k ee p an d maintain a poli cv of genernl liability in surance listing Lesso r as an additional name d insured. 9.03. Portia) Peslmctjon If the leased premises should be damaged by fir e, tornado, or other casualty not the fault of Lessee, but not lo such an exte nt that rebuilding or repairs ca nnot reasonably be completed within sixty (60) working days, thi s Lea se shall not terminate exce pt as provided below: If partial destruction of the leased premises occurs during Iha term of the Lease, Lessor nee d not rebuild or repair the laoso d premises. If the Le s,or shall a l its sole election, cos t and risk , oroceed to r ebuild or repair the leased premi ses lo s ub stantially chnnge the condition m which they existed pr io r to such damage and the lea sed promi ses a re unlenenlable in whole or in pert during or following such damages, the r onl, payable during the period in which they ere unlenanteble in whole or in pert shall be abated. In the event that Lessor should foil lo compl ete such rebuilding or r epai rs within sixty (60) days from the date of written notification by Le sso r lo Lessee of the occurrence of th e damage, Les see may terminate this Le as e by written notifi cot.ion lo Lessor. Upo n s uch notification, oil rights and obligation s under th is Lea se shall cease . In the oven t th at Lesso r does not provide written notice es stated above , an d in the furth er eve nt that Lessee is unable lo fully u se the leased premi ses, then upon the ex piration of nin ety (90) days from the lo st dale that Lessee woul d hove bee n able lo conduct its busi ness if there has been no d amage . ARTICLE 11. DEFAULT. 11 .01 . D.e.fw.&lt.. INSPECTION BY LESSOR. 12 .01. Access by Lessor. Les see shall permit Le ssor and Lessor's agents, rep rest.:1lntivcc;, a nd employee• IQ enter into and on the lea sed premises at all reasonable timos for the purpose of inspection, moinlenance , making repairs or nlt.erations t.o the premises, or ony other ~urpose of inspection n ecessary to prot .. iet Lessor's inte rest in the premises or to perform Lessor's duties under this lease so long os such access does not interfere with the quiet use and enjoyment by Lessee of the lea sed premi ses or the business of the Lessee on th o leased premises. ARTICLE IS. ASSIGNMENT AND SUBLEASE. 13.0L Asarnnmenl-nod Subletting bv Lessee. Lessee mny not sublet, assign, or other~ f..i transfer this Lease or any right or improvements on the lensed premises, without the written consent of Le ssor. In con sideration of the mutua l coven ants nnd agreements set forth in this Lease, and other good ond valuable con sid e ration, Lessor does h er eby demi se and lease to Lessee, end Lessee doe s herebt lease from Lessor, certein portions of the Englewood Recreation Center located at l 155 West Oxford Avenuo, Englewood, AT1pahoe County, Colorado (the "premises'").
