WHEREAS , pursuant to Article 80 of the 1988 Unifonn Fire Code adopted June 4, 1990 by Ordinance No . 23 , Series of 1990 by th e City of Englewood, Colorado , the De partment of Safety Services is authorized to im plemen t a Haza rdous Materi als Permit PNgrnm ; and WHEREAS , this issue wa s studied and discusse s wilh City i !,••ncil on October 19, 1992 ; and WHEREAS, as part of the Hazardo•n Materials Per:t,,t i'• ogrom, certain charges are necessary to implement and operate the program ; NOW , THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 0 1' ENGLEWOOD , COLORADO, AS FOLLOWS: . ~-The Englewood City C,,uncil hereby authorizes the following fee s: Facilities shall incur a fee whenever materials stored , dispensed , used or handleri at any facility fall into one 01· more of the Hazardous Material Categoriea and are in amoun t,, which exceed the limitations desil!Jated in Table No . 4.108-C . The asser ,ed fee for the Hazardous Materials Pennit will be calculated by multiplying the total number of established Ha,:,rdous Material Cateeories for materials handled at the facility by Fifty Dollars ($50.00) p,r HP.>.ardous llaterials Category. The number of separate chemicals falling into a particuldr category is of no conseq~ence . Fees are assessed by category pursuant to Section 80.103 of the 1988 Uniform Fire Code and Table No . 4.108-C. The following categories are hereby designated for purpose s of charges of the Fifty Dollar ($50.00) fee per cat egory: I. Expl osi ve and Blasting Ag ents ; 2. ::::ampres se d Ga ses : 3. Sens itize rs and other health ha znr ds . .. ~ It is hereby auth orized that in adclition to these charges the City shall charge for the total number of consultant and inspection hours incurred by City personnel in evaluating compliance with the Hazardous Materials St.orage and U ~ provisions of the Engl ewood Ci ty Code a charge of Twenty Dollars ($20 .00) per hour a■ .. t forth in the attached documents marked Ellhibit "A'". Chris Olson, Executive Officer Ron Boston, Assistant Fire Marshal ISSUFJACTION PROPOSED Council is requested to adopt a resolution establishing a fee schedule to provide funds for the implementation and operation of the Department of Safety Services Hazardous Materials permit Program pursuant to Article 80 of the 1988 Uniform Fire Code. PREVIOUS COUNCIL ACTION Council adopted the 1988 Uniform Fire Code on June 4, 1990 by Ordinance No. 23, Series of 1990. BACKGROUND The Fire Div ision of the Department of Safety Services is required by Federal law to facilitate implem e ntation of certain hazard o us materials regul atory provisions of Title Ill of the Superfund Amendments and Re-authoriza tio n Act (SARA) of 1986. Our respons ibility under SARA Title TII is to gather and make available information for our community on the types and qu antities of hazardous materials stored and used in our business and industrial occupancies. Article 80 of the City's fire code contains specific technical requirements to which these businesses must ad here if the y are storing or using haza rdou s material s . The Fire Di visio n is responsible fo r conducting comp liance inspection s to verify th at the provisions of Article 80 of th e Ci ty 's fire code are fo ll owed . STAFF ANALYSIS The Department of Safety Services is faced daily with an ever-increasing threat of emergencies involvi ng hazardous materi als within Englewood . The City's fire code contains regulatory provisions fo r the storage, handling, and use of products categorized as "hazardous materials." In order to provide a sufficient regulatory framework for hazardous materials use in Engl~wood, it is necessary to implement a proactive program designed to enco urage safe stor age and handling of these materials. The Fire Prevention Bureau has designed a permit program that will interact readily with Sta te and Federal regulatory requirements for those properties within Englewood that must comply with hazardous ma te rials regulations . In order to offset the administrative and materi al costs associated with operation of this program, it is recommended that nominal fees be es tablished for the Fire Prevention Bureau's required plan review /inspection activities . FINANCIAL The estim ated cost of implementing and operating this program for the first year is $4~,000 . This includes resource material / supplies and projected staff costs . (The staff requirement n2eded to implement this program will be assimilated into the workload of the Fire Prevention Bu re au, therefore the estimated $30,000 in staffing costs will not be a cost increase to the Fire Division.) The anticipated first year revenue generated through this program by permit fees, consultation fees, and placard fees for 300 businesses is $45,000. -
