~lHEREAS, the City Council of Englewood, Colorado, has detetmi.ned that it
i s necessary to create a local or special ilrprovernent district within the City
f or the purpose of ( i) constructing and installing street paving, curb,
gutter, and sidewalk iJrproverrents, together with necessary incidentals, on
certain streets and avenues within the City ("Zone l"), (ii) providing for the
rerroval and replacement of sub-standard curb, gutter , and sidewalk and the new
construction of curb , gutter, and sidewalk i.Jlt,rovarents, together with
necessary incidentals, on certain streets and avenues within the City ("Zone
2 •) , and (iii) constructing and installing street paving, curb, gutter ,
sidewalk, water, sanitary sewer, and storm drainage i.Jlt,rovernents, together
with necessary incidentals, within an undevelq,ed area within the City ( "Zone
3"), all as set forth in this Resolution, and to assess part of the oost of
the llll'rovetents againr,t the real property specially benefited by the
illproverents and incl1.ded within the district; and
WHERF.AS, the district will be divided into three separately defined zones
for the purpose of det.\'rmining the assessrrents payable within thr, respective
assessrrent units; and
WHERFAS, the district will be divided into three separately defined zones
for the purpose of determining the assessrrents payable within the respective
assessment units; and
WHERFAS, pursuant to the Olarter of the City and Title 11, Chapter 2, o f
the 111lllicipal Code of the City, the City Council has detetmi.ned to proceed
with the reroval and replacement or new construction and installation of such
iJrprOllelT'ents , provided hc:Mever, that the City Council shall consider all
,irotests and obj ections that nay be made in connection wi th the proposed
i.Jlt,r011e1rents, before ordering the reroval and replacement or new construction
and installation thereof; and

8. There shall be prepared an ordinance creating with i n the corporate
limits of the City , a special inprovement district to be designated as "Paving
District No. 34 /Concrete Replacerent District No . 1991", providing for the
removal and replac8'"'nt of new construction and installation o f the
inp~ovements, all as described in this Resolution, and in accordal'ce with the
preliminar:r report, plans, maps, specifications , details and e stimates of
costs of the Engineer, herein referred to and no,, on file in the office of the
Director of Public works. :.t is anticipated that the ordinance will be
considered for passage on first reading by the City COOncil at a regular
rreeting thereof to be held on April 15, 1991.
9. Should any one or rrore sections, paragraphs, clauses, or provisions
of this Resolution be judicially determined · invalid or unenforceable, such
determination shall not affect, iJ¢r or invalidate the remaining provisions
hereof, the intention being that the various provisions hereof are severable.

1991) represents y ear fi ve o f the ten-year pro gram. Modificati ons t o the "year
fi v e" program are as f ol l ows:
l. The 3800 block of s . Delaware S t . and the 000-1 00 b locks of W. Ke nyo n Ave. were
a dded to this proj ect. They had been omitted f rom PO #33 (year (our).
2 . The alley east o f the 3700 bloc k of s. Ac oma St . and the alley e a st of the 4 800
block o f S . Bro adway were added at the r equest o f many pro perty owner s through
the petition proces s .

buen completed, improving approximately 99 miles of streets a nd 40 alloys.

through specia l aeaeaemente levied tor work done adjacent to their properties, and
the City, through monies budgeted in the PIF for street and al ley i n toreectlo n work,
i n cidental storm sewer construction, r ight-of-way acquisition , fen ce colocations,
e t c.
A~ the 1983 Budget Rotreat, Council tentatively approved a ten-year paving district
program to bring all etreota , not incl uded in previous districts, up to City
s ~andards , Proposed paving dist r ict streets were pres ented to Council as an
a c cum ulat ion of recommendations from several areas: requests f rom citizene,
petitiona, requeata frl>fn bueineaa or i ndu strial property owners, regueste from
Council, review of past districts, review of maintenance problems and coats , and
phys ical i nspections. Pr Lo r to i nclusion in the list , streets showing signs of
distress were teated for th ickn e ■s of asphaltic concrete a nd baaecourse to determine.A

There is $60,000 budgeted in 199 1 PIF for City Coate in this project . After
contingencies, the Concrete District PIF balance of approximately 520,000 wi ll be
available for application to City costs in the Voluntary Co nc r ete Program.

pl atted stree t in a new subdivision located at Big Dry Creek and South Sa n a Fe
Drive. The d evelope r of this subdivision petitioned to include this street in the
Paving District. There wi l l be no cost to the City f or this street as the develope r
wil l be assessed f or all aspects of construct1on including in fr astructure (water and
