A RESOLUTION ACCEPTING THE RECOMMENDATION OF THE ENGLEWOOD El,ECTION
COMMISSION CO NCERNING REAPPORTIONMENT OF CITY COUNCIL DISTRI CTS .
WHEREAS, the Englewood City Charter eeta forth that the City be
divided into four di ■trict ■ which ■hall be contiguous a nd c ompact ,
hav i ng appro ximately the same number of registered voters in each; and
WHEREA S , ca ■e law exiate which makes it imperative for t he
populat ion of t hose d i ■tric ts to reflect no more t han 5\ d i ffe rent ial
between the moat and the least populated d i strict ; and
WHEREAS, the 1990 census population figures will not conc lus i vely be
known until 7\pri l , 1991; and
WHEREAS, during 1992 the Stat e of Colorado shall reapportion its
di ■tricta which action will undoubtedly affect Arapahoe Co u n ty precinct
boundaries upon wh ich City district lines are drawn; and
WHEREAS, the Englewood Election Cotl'IT\iaaion haa reviewed and
determined it la unable to make a recommendation in th is matter until
after definitive population numbers are confirmed and State
reapportionment is completed.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of t he City of
Englewood, Colorado, to postpone, for the present t ime, all a ction
concernin<J :"!apport ionment of City Council Di stricts . The Englewood
Elect ion c ,.11~.T'tl ssion i s advi aed to thoroughly r e view matters relat ing to
the State f Colorado Re~p pcrtionment as those matters affe ct the County
o f Ara p a hoe t nd the City of Er :glewood; further, the Englewood Election
Co mmi s sion li hall ma ke recommendation s t o City Co uncil c o n c e rn ing
nec essary reapport ionment of City Counci l Dist rict s i n o rder for t h at
r eapport ionment to b ecome effectiv e six months p r ior to the 1993 r egu lar
mu n icip a l e lec tio n.

numbers (one-man/one-vote l aw). I t is the opi n ion of the City Attorney th at unless
definitive p o pulation figures are available by Febru ary l, 1991, it would oe
impoaeible t o make an i nfo rmed recommendation to City Council in a timely manner.
Initial figures have been released by the Census Bureau; however, it is the City 's
intent to dia pute tho se h.,t:1 ree, 11nd the outcome of the dispute and final
confirmation of population figures are not expected until late Apr il, 1991. City
Attorney Ric< DeWitt ind icated his s·.ip port o f the Ele ction Commission's
recomm endation to t ,etpone act ion on t his ma ter unt il con clusive datll 1.e a v ailable.
BACKGROUND

ordinance adopted by the City Council after receivi ng the recommendation of the
Election Conn1aeion . Factor ■ u ■ad in District boundary reapportionment are : no

The last reapportionment waa comf')_e ted i n 1981, and by Charter , a pport1.onment ahould
be reviewed in 1991.
The Englewood Election Commi ■■ion met on January 22 , 1991, to review this process.
The Election Comrniaaion waa adviaed that population figures fr om the 1990 census
will not be a vailable until sometime in April, 1991 . The State of Colorado plans to
reapportion it ■ diatrict ■ during 1992, appo inting the State Reapportionment
Comm i eaion i n July, 1991 to convene in August, 1991. The State Reapportio nment
Commi ssion must file ita recomme ndation, with the Secretary of State by March 15 ,
1992 . The reapportionment of State D istri ct ■ will affect county Precinct boundarie ■
upon which the City's district line ■ are drawn . Consequently, the State's and
County • s reapportionment could greatly affect the City • s reapportionment.
In ~.ight of theae facts, the Election Comrniaeion la recorrme nd ing that Council
postpone any rediatr icting until after the State &!'l.d Co unty have completed ita
reapportionment in 1992 . At that time, a thorough review of population and
regi ■t ared voters will be conducted by the Electio n Commission who will then make a e
recommendation to City Council concern i ng any necessary redi s tr icting to become
effective eix mo nths prior to the 1993 regular municipal election.
This a c tion will result in no fina nc ia l impact upon t he City .
