'lbe Hauler shall provide tra:m pick-up oo previously !:cheduled plck-up days for their c ...;;carers participating in the s-lAR'I' Pilot Program. The Hauler shall pick-up trash that would be oollected by normal residential service. Items Hauler would normally not collect soould not be oollected <ile to participation in the Pilot Program, even if such itans have been tagged wi th special program stickers. B. i<t partici pating households, Hauler shall oollect all trash placed in special Program bags, or tagged with a special Program sticker. Tagged trash will cxmsis t of household trash that , due to s i ze o r structure, should act be placed in a plastic trash bag . Trash that is not bagged in Program bags, or not tagged with an appropriate sticker, will be oollected as part of the regular collection service , but will be noted on Hauler's route sheets. C. To insure t.>ie Hauler's drivers know l,juch households are participating in the Program, the Hauler's route sheets are to clearly indicate which custorrers have subscribed to the Pr ogram . D. The Ci t y recognizes that Hauler will collect recyclables , and the Hauler accepts responsibility for rraterials collected, and keeps revenue genera ted fran the sale of recyclables. I. The Hauler will direct any hruseholds that wish to subscribe or drop the voluntary Pilot Program to the City's Program Coordinator. J . If households place conta.iu.nated or nonrecyclable itans in r ecycling bucket, the driver is to leave those specific itens in the bucket and place a City supplied card in the bucket . The card will convey that these itans cannot be recyc l ed since they do not fella, program guidelines. r.v. PIOlLFX5 l\H) CDIPIAlNl'S: A. As in-properly packaged trash is set rut, trash not in a Program Bag or displaying a Program Sticker, it is to be noted by the driver a, their route sheets. en the sane day, the Hauler is to notify the City 's Recycling Coordinator of the in-properly packaged trash, including address and type of in-proper participation. This will insure the Coordinator can personally address the problem and clarify the programs operational details to the hrusehold in question. B. The City shall att"'l)t to contact the tr::rJsehold, that placed out in-properly packaged trash within forty-eight (48)_ hours of the Hauler notifying the City of in-proper packaging. C. The City shall develop procedure to handle abuses and ~laints concerning households participating in Pilot Program . Abuses of Program will be nonitored thrrugh spot checks by City employees as well as the City being notified by Hauler. V. 3NJLl!R ll!\TA TO BE SUPPLIPD TO 'lBE CITY: Concerning the Hauler data collection, if a City employee is not directly involved in collecting data, the Hauler is to supply the Cit y with the rrethodology used to collect data. Unless otherwise specifi ed, the Hau ler shall supply the City with information collected, during an d after the Pilot Progr am , within forty-five (45) day s of Pilot Program's car(.ll etion. A. The Hauler needs to describe to the City the minim.Jm qualifi cations to establish a contaminnted recyclable. This infoonation is to be supplied to the City as contamination occurs. Households that participate wi ll r ecei ve a credit an the ir bill for eac h month they participa e . This credit shall appear a, the custa:ers bill in the f irst billing cycle after the Program has begun. 2. Upon receipt of a staterrent r e flect ing the total number and address o f participating househol ds , and verif ication by the City 's Pilot Program O:O rdinator, the City wi ll make payment to the Ha ule r for partic i ?ating househol ds within fifteen (15) days . Material Breach : nie parties '",lree tha t any of the follC7wing events shall constitute a material breach of this l\greemant and the City may, at its electio n, terminate the ",l"eernent upon the happening of any of the follC7wing events : a. ~ator shall fail to maintain and q:,erate according to the terms of this Agreenent . b . Written Notice: Either party may terminate this Agreement prior to expir ation of its term at any ti.ire by giving to the other party at least thirty (30) days pr ior written notice . Ordinance No. 62 , Ser lee of 1990, au thor ized an intergovernmental agreeme nt between the Ci ty of Englewood and tho City of Littleton c oncerning the shared personnel services of a "Re cyc ling Co ordinator" to carry out the SMART Grant.
