HomeMy WebLinkAbout1990 Resolution No. 050....._,, RESOWrIOO NO. 50 SEJUES CF 1990 - A RESOWrIOO APPROVING AN P.GREEMml' RfXiARDING l'IIE MAINmWlCE Cf' llAR'IMlml Avm!JE GRADE SEPARATIOO &TRllCnJRE m:n,m,I THE CIT.t Cf' EN.I.E1<0Xl AND THE Dl!2M:R AND RIO GRANDE WESTERN RAIIJ\OI\D CXM>ANY AND THE ATCIIISCN, TOPEK/1 AND SANTA re RAII».YCXM>ANY, WHERFAS, the State Departnent of Highways, of the State of Colorado constructed a railroad/highway grade separation structure carrying the Railroad Catpanies' tracks and facilities over Dartlrouth Avenue and Little Dry Creek in the City of Englewood; and WHEREA£, DartmJuth J1venue is under the jurisdiction and control of the City of Engl,awood and is designated as a major collector QI the Federal-aid Urban Highwai• System; and WIIERFJ'S, the State's project for grade separation structure wi ll be funded in part under the provisions of Section 130, Title 23 u.s .c.; and WHERFAS, regulations pranulgated under Title 23 u.s.c., require a written agreeient covering maintenance responsibilities QI Federal-aid projects; and WHERFAS, it is desirable to establish responsibility for the renewal and/ or replacerent of the grade separation structure or CC11p0nents thereof when such nee1 is the result of normal usage and the passage of time; IOI, TIIEREFOOE, BE IT O!UlAINEil BY THE CITY <lXJNCIL CF 'l"E CITY Cf' ENGLl:NXXl, COUJ/ilNJO, AS FOLLOIS: Section 1. The Maintenance Agreement Dartm:,uth Aver,ue Grade Separation Structure between the City of Englewood, The Denver and Rio Grande Western Railroad Cotpany and the Atchison, Tcpeka and Santa Fe Railway Corpany is hereby qpproved. Said Maintenance Agreement for DartmJuth Avenue Grade Separation Structure contains generally: A, The terms and conditions set forth in this Agreement apply to a grade separation structure (bridge structure) carrying the railroad coopanies' tracks over and across DartmJuth Avenue and across Little Dry Creek. B. The bridge structure shall include but are not limited to all abutirents, piers, girders, walkways, hand rails and waterproofing. 1. The Atchison, Tcpeka and Santa Fe Railway carpany shall be responsible for maintaining, 1l!pairing and renewing and/or replacing, as needed, the east two bridge structures and/or their CC11p0nents. 2. The Denver and Rio Grande Western Railroad Co,pany shall be respor.sible for maintaining, repairing and renewing 611d/or rep ,1eing, as needed, the west bridge structure and/or its ca,ponents. 3. The City of Englewood shall bear 1/2 the oost of such maintenance, repairs and renewals and/ or replllC8N!llts a, the entire bridge structures except as outlined in the Agreement under paragraph 4. When structure work involvL~g the City participation beoares necessary, the Railroad ca,panies shall enter into a supplemental written agreenent detailing the t:.enNI and cooditia,e under which the City shall bear its share of the oost. 4 • Each Railroad ca,pany shall, at its sole expense, maintain all of the track, ties, ballast, walkways, hand rails, waterproofing and ccmnunication and signal facilities belonging to it and located i;,on the bridge structure. c. The City shall be solely responsible, physically and financially, for the oondition and maintenance of all land and waterway areas, including structures, grading and inproveirents located thereoo, lying beneath the bridge structure. Under this provision, the (1 City Os responsibilities include rut are not limited to, maintenance C of the Dartmouth Avenue road,iay surface, roadbed, curb, gutter, sidewalk, retaining wall on the north side of the roadway, and roaa.,ay drainage. The City's maintenance responsibilities hereunder also extend to all slope paving and cobblestone paving beneath the structure and to Little Dry Creek's chaMel and stream bed, its stream banks and drainage slopes , and to any existing or required bank and slope stabilization and/or control structure and grading. The discharge of the City's responsibilities shall be carried oot in accordance with and neet the City' s and any other applicable agencies' procedures, standards and criteria. D. The City shall bear the entire cost of repairing any portia, of the bridge structure accidentally damaged by vehicular traffic q,erating on or adjacent to Dartm:ruth Avenue. The oost of such repairs shall include the oost of taking and/or providing such em,rgency rreasures as may be necessary to maintain the bridge's structural integrity and/or to maintain oontin•Jed railroad operations through the area. The City has the right to recover its costs £ran any person or entity causing such damage . E. Eac h Railroad Calt>anY shall bear the entire oost of repairing any portion of the bridge structure and the land and waterway area lying beneath the bridge structure accidentally damaged by reason of its rail operations over, upon or adjacent to the structure. "nle oost of such repairs shall include the cost of taking and/or providing such energency rreasures as may be necessary either to assure continued operation of vehicular traffic on Dartmouth Avenue or to provide an acceptable alternate roote until the regular route can be restored. The Railroad Crnpanies have the right to recover their costs fran any person or entity causing such damage. F. The cost of repairing, renewing or replacing the bridge structure or any oa,ponent thereof as a result of a natural disaster or other occurrence beyond the oontrol of the parties hereto shall be evenly divided between the City and the Railroad Carpanies. The parties or any of tliem may appl:,, for any natural dhaster or relief funds that may beo:me available. If such funds are received and utilized to offset or reinburse the parties for the CXl.lt <'.)f repairs or replacenent, only those repair or replacenen•, oosts exceeding the available disaster relief fun,18 shall be cc.nsidered for divisia, between the partfos. G. Billings for maintenance, repair, renewal or replacement of the bridge structure or carponents thereof shall be sul:mitted to the appropriate party within ninety (90) calendar days after cmpletiat of the particular wor.k or after receipt of suppliers' and/or subcontractors' bills. ~int>ursemmt for such billings shall be made within thirty (30) calendar days of receipt. H. The parties shall oonduct periodic inspections of the bridge structure, as required, to determine maintenance, repair, renewal and/or replacenent needs and shall mutually agree as to the need for and scheduling of actions and renedies required to ilrplemmt the results of such inspections. l. If the parties are unable to agree oo the need for maintenance to, repairs to, or the renewal or replacenent of the structure or an item or carponent thereof, a qualified engineering consultant, licensed and registered in the State of Coloraoo, selected in unanimity by the three parties, shall rule oo the need for such maintenance, repair, renewal or replacenent. Each party shall pay one third (l/3) of the consultant's oosts. Nonnally, the parties shall abide by the oonsultant' s decision or recam-endation. PREVIOUS COUNCIL ACTION In late 1988 , Council discusse d the possibility that Englewood would be required to assume the maintenance and replacement costs for the railroad grade separation over Dartmouth Avenue at Santa Fe . Staff was d irected to work with the railroads to come up with an acceptable agreement . STAFF ANALYSIS This agreeme.nt makes the City responsible for any repair work below the main s tructure, the main structure is shared 50-50 with the railroads and that portion above and including the waterproofing is the responsibility of the railroads . Additionally, 1f the st~ucture 1s hit by a v ehiclo on Dartmouth , the City pays for the repair . If damage is caused by rail operations , t hen the railroads pay for repair . FINANCIAL There are no immediate financial outlay s. All obligations under this agreement would be in the future, as repa irs are needed and/or a s replacement of the structure become s neces sary .
