property is within thn 100 -yoar fl ood plain for Bi g Dry Creek .
Two 7S-foot Public Servic e Com p a ny easem e n ts c ross the site, p r ov iding a further
challenge to the owners /lj nd /or dev e lopers.
The applicants propose 1.r, d i v ide the s i te into small lig ht industrial sites in order
to offer locations for tl'-IJ typ& of industr i es tha t specialize i n small-scale
production .
PROCEDURE :
In reviewing the Prel i.rr na c y Subdivis ion Plat , the Commission should pay particula:-

2 . The proposed layout o f lots and blocks and the proposed dime nsions thereof

3. rhe availab il ity o f all u tilit i ea , and t he pro ximity thereof to the area
proposed for su b division.
4. Topography and natural features of the land with sp~cial refe rence to flood
plains.
S. The c o ntinuity of street s a nd alleys wi thin t he area p roposed for subdiv i-
s ion, and the design and location of s u ch streets and alley s, with relation
to exist i ng st r eets and alley s, both within a nd without the area proposed
f o r su b d iv ision , and t he Master Street Pla n .

After reviewi ng the Pr elimi nary Plat, the Con.mie sion !!!1 c o ntinue or adjourn it s
deliberation from time to time in orde r to obta in furt her i nf ormation rehting to
the Preliminary Plat , but the applicant must be notified of that action.
When the c omm issio n has completed its c onsideration o f the Prelimin ary Plat, it may
giv e i ts uncondi ':ional approval to the Preliminary Pl a t or it may state conditions
or changes required for appro val of the Prel iminary Plat, or it may disapprove t he
Preliminary Plat .
After completion of its c onsidera tion of the Prelimi na ry Plat and d e termina tio n o f
whether any of the further c o nditions o r requirements should b e impo sed,the Commis-
sion shall present to the applicant a written statement whi ch s hall state to the
applicant whether the Comm i ssion haB unconditionally ai:proved, c o nditionally ap-
p r oved, or d isapproved the Preliminary Plat.
I n the eve n t that the Commis sion conditi onall y app r ove s the PL·elimi nary Subdivision
Plat, the writ ten statement of the Planning Commission shall set for t h the condi-
tions and r e quirements to be met by the applicant and the reason s they were imposed.
In the e v ent of a disapp r oval of t he Prelim inary Subdivi s ion Plat, the writte n CJ
statement of the Commis sio n sh all set fortn the reasons therefor, an d the applicant
may appea l such disappr ova l .
Upon receipt by t he a ppl icant o f the Commi ssio n· s writ ten statement, the applicant
shall, within six month s, submit t o the Commission the Fina l Plat, together with

BACKGROUND OF PREVIOUS ACTION RELATING TO THE SUBJECT PROPERTY:
Th e s ubject property waa part of a nd included i n , the annexation of 13 S acres which
straddled Soutl'-Santa Fe Drive, and a n nexed by Ordinance 116 of 19 S9. At the time
of annexation, the p r operty was zoned M-l, Industrial. In 1963, the property was
rezoned to I-1, Light Industrial.
Informat ion in the Building Division recor ds indicates that a Building Permit was
issued in August, 1963 f o r a mob ile home to be l o cated on the pro perty. In .January,
1912 , a Building Permit wa s issued f or a shelter to be used in c o n junction with a
golf drivi ng range. There has been no o ther building acti v i ty since that time.

tion through the subjec t proper ty .
On .Januuy 11 1 198,,, the Plann i ng Co mmission con sidered a Preliminary Subdivl ■ion
Plat for the northern eight (8 ) acres of the s ub j ect pro per ty . It was proposed that

The Planning commission a p proved the Prelimi nary Plan with c o nditions. The Final
P lat was never subm i tted.
Mr. Cameron contacted the Planning Division staff in 1985 about the "interim use" o f
the property as an R.V. sto r a ge area. Mr. Cameron was told that in order to utilize
the property for R.V . sto rage, a De v elopment Pla n would hav e to be filed, aa well as
a request t o waive the req uirements f o r subdivision. Mi:. Cameron submitted the
Planned Devi? o pment and the Subdivision, and the Planning Commission ope ned the
Pub li c He o r i "1J o n the Pla n ned Deve l o pment o n ltovember 5, 198 5. There were 11",&tters
to b e worked o ut reg arding the floo d p lain and the Pu blic Hearing was continued to
November 19, 1'7 g 5 , Thing s we re no t resol\'ed , a nd t he Public Hearing was continued
u n t il Dec:emb&r J , 1985. The fl ood plain i ssue wa s stil l not resolv ed, and the
P~blic Heari ng Aas continued until December 17th. On that date, the Planning Com-
mission told ~-~ applicant to come b ack with a new application ..._hen the flood plain
problems we re ru sol v ed, and the consider a tion of Case No. 32-85, the Subdivision
Waiver and Ca s e No. 33-8 5, the Planne d Dev elopment, ceased.
The staff has di scussed other interim uses of portions of the property with the ap-
plicants 'l 'nc& that time, bu t t here have been no formal requests until the p re1ent
act ion.
An agreoment was written by the City Attorney which addressed t he flood p lain is-
sues. Th is agreement was no t s igned by Hr. Camero n , a nd should be reconsidered as
it relates to t his new case. The orig ir.al a gre e ment is attached.

In a atudy prepared by the University of Colorado Sc hool of Urban Regional Planning
in 1989•, the sub j ect property is id entif i ed as "underutiliz.ed." Thia la an obvioua
concluaion and the Preliminary Subdi v ision Plat that is before the Planning Commla-
sion i ■ the owner's proposed me thod of providing small industrial site• for produc-
tive ut ilization of the property.
With the Public Service Co mpany easements c rossing the p r operty, the Sig Dry Creek
Flood Plain on t he sou thern port ion of the property a nd the Santa Fe improvement ■
effecting access to South Sa nta Fe Dr i ve , any dev elopment will require a coordinated
effo r t on the part of the property own er, the Ci ty, Urban Drain age, and the Colorado
Hi ghway Department.
The ultimate dev elopment of the property at 4755 South Santa Fe Drive will be of
benefit to the City and to t he business community, and every effort should, there-
fore, be made t o overcome the many obstacles tha t exist on the pro p erty.
The specific matters which will have to be addressed by the camerons o n o r i n con-
nection with the Final Plat, wi ll be presented by the staff at the Public Hearing.
It is recommended that the issue of the floo d p lain be resolved to
of UtOan Drainage and the City En9ineere, eith-ar on the Final Plat, or in documents
accompan.,ing the final Pl at p r ior to the Commission's final con side ratio n of that
document .
