The City of El'lglewood declares its intent to appropriate a 1990 conditional ltater storage right in McLellan Reservoir and a right of refill for Englewood's existing absolute water storage rights in Mc:Lellan .Reservoir (as decreed in Civil l\ction No. 3635, in the District Court in and for the County of Douglas, State of Colorado, dated May 18, 1972. ) , bo'-.h as rrore fully described l:ela.1. section 2. The City Attorney is authorized to ocmnence appropriate court p~ connection with the ai:propriation of water storage rights in Mc:Lellan Reservoir as set forth herein. Section 3. PREVIOUS COUNCIL ACTION None. STAFF ANALYSIS lt appears that several additional water rights and exchanges would enhance Englewood's raw water supply, ,even with a 1990 appropriation date. The additional rights include direct flow rights at the Union Avenue Intake, atoraye rights at the Cent~nnial Park gravel pits and additional storage rights in McLellan Reservoir. The exchanges include the McBroom Ditch Exchange, which would allow water available at the HcBroom Ditch headgate to be taken at other points along the south Platte River, and the Well Water Exchange, which will permit water to be taken out of the South Platte River if well water is put into the river system at a downstream point. BACKGROUND A 1990 appropriation date for a direct flow right is a junioi:;, right in the Colorado water ayate m. However, there are period ■ of the year when this right would be in priority and water could be taken. An exchange such as the ones listed can be u1ed to transport water that is available at downstream locations to upstream locations without constructing pump station& and pipeline ■, providing certain rive t condition ■ are met. The storage rights at the Union Avenue (Centennial Park) gravel pita would give f.nglewood the ability to usa the gravel pit• to ■tore water av•il•blo in wot period ■ of tht year un~il it waa needed in drier periods. The additional storage rights at HcLellan Reservoir woulci not provide a dditional physical capacity at the ra ■arvoir, but would allow additio:-ial amount ■ of water to be ca lled for and stored by the reaervoir each year.
