WHEREAS, the COloraclo State Departrrent of Highway s has requested a
terrporary construction agreerrent for rechannelization of Little Dry Creek ,
construction of the new railroad bridge, construction of the new Cushing Park
parking lot and reiroval of the existing parking l o t;
IOI, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

Section 1. 'Ille Ten\X)rary Easerrent between the City of Englewood,
COlorado, and the State Departrrent of Highways, Qivision of Highways, State of
COlorado, Project No. FCU 085-2 ( 51) for construct;ion of irrprovenents to Santa
Fe Drive at Dartrrouth Ave . for rechannelization of Little Dry Creek, a new
railroad bridge, new Cushing Park parking l ot and rerroval of the existing
parking l ot is hereby approved. A copy of said Tenporary Easement is attached
hereto and incorporated herein by reference.

BACKGROUND
In order to construc t the proposed Dartmouth/Santa Fe Im provements , including the
rechn nnelization of Little Dry Creek , construct ion of the new ra ilr oad bridge, c on-
struct ion o f the ne w Cushing Park parking lot and remova l of the ex isting parking
l ots along Dartmouth, the Co l orado Departme nt of High•,rn y s has rc1uested a Te mporary
Easeme nt . Th e easement woulJ be for a period of two years and provi des that any
dm nn gcs co ex ls ting lmproveme nts would be res to r e d or rcpa ire d unle ss t h ese im prove•
mcnts were schedule d for de molition, in which case the c onstruc ti on doc uments d eta il
t h e new const ruc tion . A graphic representa t ion of the easement i s ,;hewn on t he at·
cach ed map.
Once con struction is compl e t e d , the i mp rove men ts will become t h e prope rty of t h e
City.
In t he final ph ase of con struction, when Dartmouth is r egrade d and wi de ne d at Santa
Fe, t he Colo rado De partme n t of Highway s will b e prov id ing a prrmancnt right•of•way
a greeme n t for a por t ion of t h e prope rty n otth o f t he ex i s ting road right•of•way .
Al l con struct ion sho uld b e completed in 1991 o r 199 2.
Th e r e is no t r a n sfer o f funds fo r the Te mporary Easem nt s ince im prove me nt s va lued
at over $7 00,000 will become the City 's upon completion of con struction .
RECOMl!ENDATION
It is recommended that the Te mporary Easement wl t h the Colorado Department of High·
ways for construction of improvements associa t ed with the Dartmou th/Santa Fe im•
provements be approved,
