SERIES OF 1989 --
A RESOLUTION ALLOWING FOR A NEGOTIATED CONTRACT FOR THE SLURRY
SEAL PROGRAM 1989 INSTEAD OF THE COMFETITIVE BID PROCESS UNDER
SECTION 116(b) OF THE HOME RULE CHARTER AND THE ENGLEWOOD
MU NICIPAL CODE 1985, SECTION 4-1-J, AND AWARDING A NEGOTIATED
CONTRACT FOR 1'HIS PROGRAM FOR MAINTENANCE OF THE ENGLEWOOD STREET
SYSTEM.
WHEREAS, the City of Englewood is responsible for
maintenance of approximately 120 miles of public roadw~!S in the
City; and
WHEREAS, the Department of Publ.lc Works and Engineering and
Street Maintenance Divisions have developed a system-wide
maintenance program in which they have found slurry seal to be a
viable, economic preventive maintenance alternative; and
WHERP.AS, previous construction expe.~ience and expanded
product knowledge has caused the staff of this Department to
believe that local contractors do not possess the specific
product knowledge or construction expertise to construct"
quick-set slurry acceptable to City staneards; and
WHEREAS, local emulsion manufacturers presently do not
proeuce proven quick-set emulsions satisfactory to City needs;
and
WHEREAS, staff of this Department has evaluated the
abilities of and qual i ty of quick-set slurry utilizing a specific
l ocal aggregate and a quick-set emulsion from the Ergon Refinery
i n Vicksburg, Mississippi; and
WHEREAS, Bituminous Asphalt Sealing Specialists, Inc. of
North Lit t le Rock, Arkansas, has laborator y-tested and field-
tested this product, and City staff has evaluated the abilities
of this company in placing quick-set s lurry seal in our 1987 and
1988 Programs, and has discussed their work quality and product
quality with other governmental agencies which have had years of
experie nce with this company; and
WHEREAS, Secti on 116(b) of the Englewood Home Rule Charter
a nd Section 4-1-3-1, Englewood Municipal Code 1985, allow
contracts for public works or improvements to be negotiated,
provided that contracts for which no competitive bids have been
requested have been approved by resolution which shall declare
the reason for exception to the competitive bidding requirement;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF F.NGLF.WOOD, COLORADO, THAT:

Section 1. The Department of Public Works i s hereby
authorized to negotiate a contract for Slurry Seal Program 1989
in an amount not to exceed $240,000 in lieu of the competitive
bid process as allowed by Section 116(b) of the Englewood Home
Rule Charter. and Section 4-1-3-1, Englewood Municipal Code 1985.
Section 2. The Department of Public Works is hereby
authorized to prepare a contract for the Slurry Seal Program 1989
pursuant to their investigations of local aggregate, quick-set
emulsion produced by the Ergon Refinery in Vicksburg,
Mississippi, and construction of the product on Englewood streets
by Bituminous Asphalt Sealing Specialists, Inc., of North Little
Rock, Arkansas.

BACKGRCiUN D
The City of Englewood i s responsible for maintenance of a street system comprised of
approx ima t el y 120 total miles. On a n annual basis, the Department of Public Wo rks ,
Engi neering Services a nd St r ee t Maintenance Divisions, develop a system-wide main-
tenance program. Thi s p r ogram may inc lude asphaltic concrete overlays or various
preventive ma i ntenance s u rface treatments, depending upon specific existing roadway
condition s. Over the past f ew ye ars , we have become parr.ic ularly interested in
s lu rry seal as a v iabl e, economic preventive maintenan .:e alternative . Our previous
-::o nstruction exper ience and e xp anded knowledge regarding quick -set slurry seal has
caused City staff to be l ieve t hat local contrac tors do not yet possess the specific
product kno....,le dge or const ruction expe r tise to cons truct quick-set slurries accept-
ab l e to t he City of Eng l ewood at th is time . The City of Englewood does belong to
the International Slurry Seal Association (ISSA). In Hay, 1987, we contracted with
Mr . C. Rob ert Benedict, Dayton, Ohio, then Director of Research for ISSA, to deve l op
a quick-se t slurry s pecifically for the City of Englewood . The slurry utilizes a
spec ifi c loca l aggr ega t e and a specific quick-set emulsion that is produced by the

Er gon refinery in Vicksburg, Mississippi. There are no known emulsion manufacturers
in t his a rea who have produced a proven quick-set emulsion that would serve our pu!-
poses at this time. The specific slurry product designed fo 1 ,s has been laborAtory
t ested and field tes ted in No rth Little Rock, Arkansas by Bituminous Asphalt Sealing

pecialists, Inc . (BASS). Members of our 1 taff have had the opportunity to evaluate
ho nbllitlcs of this company in placing quick-Ht slurry aeal both in Arkansas in
earl y 19 87 and on our streets in our 1987 and 1988 Slur,y Seal Programs. We feel
th nt ou r 1987 and 1988 Slurry Seal Programs were very successful and that Bituminous
Aephnlt Sea ling Specialists, Inc . did an exceptional job for us . We have also had
tho opportunity to discuss tho quality of their work, and product quality with other
governme nta l agencies which have had years of ex"'erience with this company . At this
point in t ime, BASS would agoin be the only slurry seal contractor that City staff
is confiden t can c ome into Englewood and construct this specific product for us.
Front Range Slurry Update:
Our continuing efforts to establish quality quick-set slurry seal as a maintenance
alternativ e in this area are beginning to have market impact.
Local emulsion manufacturers are attempting to produce quick-set products (similar
to our speci fi ed emulsion) this year . Their successAs/failuras will be measured
over the n ex t several years. The specific emulsion chat we specify has been suc •
cessfully utilize d in other areas for over 10 years.
Other municipali ties are a ttempting slurry seal programs in 1989 , Unfortunately,
vague product specifications and lack of slurry experience may lead to construction
of infe rior slurrie s and potential produc t failures . It will take time to properly
evalua te unp roven slurry mi x e s and unfami liar slurry contractors . As others experi•
ment , we wil l watch and eva luate, but propose to continue to construct our proven
-roduct to extend the l ongevity of our Englewood street system .

Mr . Jacob P. Br oadaway, Pres ident of BASS, Inc . recently visited the City of Engle•
wood , to discuss our proposed 1989 program with us . He is presently ·evaluating our
program and prep9 r ing a unit price for our project. Our negotiated prices for the
198 7 and 1988 Sl urry Programs were $1.64 a nd $1.56 per square yard respectively . lie
are expec ting to benefit: this y e ar from: 1) Advance ordering of aggregate materials
to again gc nera .:e s avings i n aggregate costs, 2 ) The general contractor's comfort

whil e h e is here (additiona l vol um e would mean overall lower unit costs for all
conce r ned ).
We an ticipate t h e above items would generate savings over last year of approximately
5%, resulting i n unit price~ in the $1.45 to $1.50/S .Y. range; allowing us to con•
struct .'.l pp roximate l y 160,000 s quare yards of slurry (approx . 68 blocks) in our 1989
program . With the added e x pense of our specific quality local aggregate, the
transportation cos ts for brir:ging o ur quick-set emulsion from Vicksburg, Mississip -
pi, and the mobilization of a c onstruct i on effort from North Little Rock, Arkansas ,
we beli eve un it c o sts in thi s range to be reasonable and acceptable for our proven
quali ty product. The costs for Slurry Seal Program 1989 are borne by the City
through monies b udgeted in t he PIF (includes Arapahoe County Read and Bridge Fund
Moni es).
