WH [REAS , the City of Engl ewood, by Charter Amendment effecti ,e April 13 , 19 81, prov id ed for the establishment of managerial and sup ervi so- ry emp l oyees with in the se rvi ce of th e Ci ty of Englewood; and WH EREAS, the Ci ty of Eng l ewood dee ms it i s necessary to es tablish managerial employee s with full re s pon s ibility to th e City in order that the City be able to fulfill its mi ssion t o provide com pe tent, r esponsible government lo Eng 1 ew oo d c il i ze ns; and WH EREAS, by virtue of manageria l dut ies assigned to posit io ns by th e City, the City of Engl ewood Ca r ee r Se rvice Boar d ha s de termined tha t th e followi ng po s ition s are manageria l and as suc h arc, th erefore, ex cluded from repre se ntati on in any co ll ec tive l y ba rg ain ed employee relations sys tem of the City of Englew ood; and WHEREA S, the City of Engl ewoo d desires to establ i sh and maintain a sou nd and beneficial employme nt system to benefit t he City and managerial cmp 1 oyec s of th e Ci ly. LONGEVITY Effective Janu ary l, 1982, l ongev ity compen s ation will no lon ge r be acc ru ed for any empl oye es covered by thi s Resr l ulion . However, for th ose emp l oyees re ce i vin g lon ge vity comp ensat ion pr ior lo Janu ary l, 1982, they sha 11 cont inue lo rccci ve sa id compe nsa tion at lh e i r present rat e per mo nth . Emp l oyees wit h l ess t han f ive years of cont inu ou s service with th e Ci ty as of January I , 1982, will not be eli gible for lon ge vity compens ation al any ti me . Annua l Leave Pa The rate o f annual l ea ve pay shall be t he em ploy ee's r egu lar straight lim e hourly rate of pay for th e empl oyee's regular job and charged on a working hour ba s i s , exc lu ding holidays and regular days off. Ann ua l leave shall be allowed only to the total hour l y amo unt accu mul ated at the begin- ning of th e l eave, as verified by the Depar t ment Head. Employee s ma y r eceive their annua l leave pay no ear l ier than three ( 3) days prior to the start of th e i r an nual leave, provid ed the employee makes a wr itten request l o t he ir superv iso r f i flec n calendar days prior to th e start of th eir an- nu al leave. For any on-th e-j ob in j ury whi t .. causes any employee to be absent fron1 wo, k as a res ult of such injury, th e Ci t y shall pay to s uch employee hi s/her f ul l wages fr om the fir s t day of hi s/her ab s ence from work up to and including th e 90th ca l endar day of such absence , l ess whatever sums r eceiv ed by the emp l oyee as di sa bility wage s under workmen 's com pensation . Th e City r ese rves th e right to require any employee on injury or di sability leave to submit to an examina t io n(s ) by City appo i nted ph ysicia n(s ) at the 'City 's ex pense or un der th e provi s io n of workm en's compe nsation or the r e tir eme nt /pens i on provi s ion $ as provid ed under State Stat ute, B. A 11 in jur i es th at occur during working hou rs sha 11 be r e ported to th e emplo yee's s up ervi sor with in 24 hours of the injury or befor~ the em- ployee lea ve s th e ir department of emplo yment. ARTICLE 9. LONG TERM DISABILITY INSURANCE Long term disability insurance is provided for employee s covered by this Resolut ion . For descr ipt io n of eli g ibility and co verage, see the Ci t y's lon g term di sa bility pl an avail ab le in the Emp l oye e Relations Department . ARTICLE 10 . MILITARY LEAVE A. An y perman ent or pro ba tionary employ ee who enli s t s or is ind ucted into the mi l it ary, naval, air or other armed services of the Unit ed Sta tes shall be ent itled t o a lea ve of abs ence without pay for the duration of su ch war or until honorab l y disc ha rged, whi chev er occurs fir s t , an d fo r on e (I) ye ar th ereafte r . B. Any em ployee who sha 11 be a me mb er of t he Na ti ona l Gua rd or any oth er comp one nt of th e mii itary for ces of the s t ate, now or hereafter or- ganized or co ns tituted under th e s tate or f ederal law, or who shall be a -7 - member of the reserve fo r ces of the United States, now or hereafter or - ganized or constituted under federal law, shall be entitled to leave of ab se nc e from his/her employment without loss of pay, seniority , status, e fficien cy rating, vacation, sick leave or other benefits for all t he ttme 1<h cn he/s he i s engaged with suc h orga ni zation or compone nt tn training or ,,c Live scrv ice ordered or author I zed by proper author! ty pursuant to law , whether for s tate or federal pcrposes, but not exceeding fifteen (15) days 111 ,rny cal endar year. D. Subject to provi s ion A, B, and C above, the Ci t y shall provide full pay t o an employee gra nted military leav e, l ess whatev er wages the employee may have r ecei ved by the mi 1 i tary for suc h serv t cc. ARTICLE 11. FUNERAL LEAVE The Dep a,·tme nt Mead s hall grant leave with pay to an empl oyee to attend the funeral u f a member of the employee's f am i l )'. The numb er of days gran- t ed s hall be governed by the circumstanc es of the case, but tn no event sh,1 ll th ey exce ed five (5) working day s . For the purpo ses of this section, "c i:1p l oy~e•s famil y" st1al l mean the employe e's spou se, or the children, ~1r andc l,i 1 dren , parents, gra ndpar ents , brothers and st sters of the empl oyee or of the emp loyee 's s pouse. Annual l eave may be grant ed by the Departm ent ll r ad if additiona l lime off is de emed ap propriate . ART ICLE 12. JURY DUTY AND WITNESS SERVICE Leave may be granted to an employee for serving on jury duty or as a witn es s in hi s/her officia l capacity in obe d ienc e to a subpoena or direc- lion by legal authority. fie /s he shall be entitled to the difference between hi s/her regula r co mp ensat ion and the fe es received for jory duty or as a witn ess .· Wh en he /she is subpoenaed i n private lit ig ation to testify, not in hi s/her offi c ial capacity but as an individual, the lime absen t by rea son s thereof shal I be taken as annual l eav e , per son al leave or leave wi t.hout pay. New Year 's Eve: De cember 31 ll. Any employee covered by thi s Resolution who does not perform duty sc heduled on the working days immediate l y pr ior to and following a holiday s hall not receive pa y for t he hol iday unl ess other¥1ise authori zed by the Departmen l li e ad. C. Employ ee s required to work on an official City holiday may receive equivalent tim e off or pay at t he di scre tion of the Departme nt Head. D. When any of t he foregoing holiday< fall on a Sun day , the following Monday shall be ob se rv ed as lhe legal holiday. Wh en any of the fore going holidays fall on a Sa turday, eac h emp loyee shall be entitled to a day off for such holiday, which day off shall be sched ul ed as the City Manager and / or Department Head de t ermines, but no spec ifi c day shall be observed as a holiday for pu r po se of clos ing City offices and functions. ARTICLE 14 . UNIFORM CLEANING ALLOWANCE If an employee is required to we ar a un i form, th e ernp l oyee sha 11 wea r the uniform only a s authorized by the department work ru le s. All em plcyees s hall maintain a pre se ntabl e appearance while on duty. The City will con - ti nu e to provide uniforms, cle aning and repl aceme nt s. The City will pro- vide 50% of the cost of required work s hoes up to a maxi mu m of S40 per year. Th e employee is responsi bl e for any damage to the uni fo r m by neg l ige nce or de libe rat e act. ARTICLE 15. TUITION REF UND Upon reconvne ndat ion of th e Department Head and after prior approval of t he Ci ty Manager or hi s/her des ignee , the City of Eng l ewood may rei mbu rse an employee fu r satisfactory comp l et i or. of at tempted course work of Gra de C or above for undergraduate and graduate classes at 100% of pub l ic institu- tion rates or 50% of private in sti tu tio n rates. Thi s includes reimb ur se- ment for the cost of required texts and associated mandatory fees . Employees e nroll ed in program s which require at t endance dur i ng regular- ly scheduled working hours may be granted t i me off with the employee and City equally s haring the cost on a 50% ba s i s . The emp loyee may elect to use annual leave, persona l l eave or compensatory time to reimbur se the City for th e time taken off during working hour s to pursue a degree. -9 - ARTICLE 16 . LIFE INSU RAN CE Te rm 1 ife insurance wfll be provided by the City for em ployees covered by th is Reso luti on of $35,000 for each employee . A conversl~n privilege upon retireme nt of 50% cov cr~1e payable by the employee will be mad e avail - able by th e City for sai d r etired emp l oyee . ARTIC LE 17 . DENTA L INSURANCE Dur i ng the 1 ife of this Contract, the City shall pay al le ast $35 .00 pe r month toward th e premium cost for t.epe ndenl coverage and at l cast SI 1.00 per mont h for s ingle cove rag e :or the City Dental In surance Plan or other pla11 se le c t ed by the City as a subst itute for the City Health PlJn for eac h si ngl e and depe nd en l pol i cyho 1 der. Begi nn ing January I, 1988 , em ploy ees will pay $5.00 per month toward th e pr em ium co s t :or dependent coverage and S2 .00 per month for s in gle coverage for den t a I insuran ce . HEALTH INSURANCl EMPLOYEES/RETIREES A. Begin nin g January 1, 1;00, the City will pay at l ~a st $186 .00 per month toward th e premiu m cost for dependent coverage and $57 .2 8 per month for s ing I e coverag e for the City's self-funded hea 1th insurance pl an. 8. Beginning January I , 1988, employees will pa y $9.00 per month to- ward the premium cos t for depe nd ent co verag e for the City 's self -fund ed hea lth in suran ce plan. Employe es having s ingle coverage will pay $4.5 0 per month of the th e tota l sing l e premium cost . C. Any dispute concerni ng the interpret ation or applic ation of bene- fit.s prov id ed und er th e health in suran ce plan s hal l be subject to t he dis - pule r es oluti on pr oced ur e onl y. D. Retirees prior to January l , 1980, will be provided health in - sur ,1n ce cov erage by the City on a non -participat ing ba sis. The coverage will coordinate with Medicaid and Medic ar e wh erev er appli cable. Retirees after Janua ry 1, 1980, will be ~uarant r ed co nv ersion privileges to the I hea lth in suran ce plan avai l able t hro ug h the City. The City will pay 50% of I th e cos t of cove ra ge of he /she conv ersion plan up lo a ma ximum of S75.00 per month . • 10 • I I ARTICLE I 9.
