WHEREA S, the City of Eng l ewood, by Charter Amendment effective April 13 , 1981 , pro vi ded for the establishment of ma na gerial and superviso - r y em ploye es within th e se rvi ce of the City of Engl ewood; and . . WHEREA S, th e Ci ty of Englewood deems it i s necessary lo establish man age rial em ployee s with full res pon si bility lo the City i n order that the City be able t o fulfill it s mi s•,ion lo provide competent, re s ponsible gove rn me nt to Eng 1 ewood c i l i zen s; and WIIER [AS, by virtue of managerial duties a ss igned to positions by th e City , the City of En glewood Career Serv i ce Oo ard has determined that the following positions are managerial and as s uc h are, therefore, excluded from r e pre s entation in any collectively bargained employee relations system of t he City of Englew ood; and WHEREA S, th e City of Engl ewo od de s ire s t o esta bli sh and maintain a sound and beneficial employme nt sys tem lo benef it th e City and managerial employees of the City. Sick Leave A 11 s i ck l cav e acc rued by permanent employee s prior to January l, I 980, shall ve s t with the employee and may be used in the following manner: A. After the 180 days as described above h.we been use d, unl e s~ the empl oyee i s entitl ed for retireme nt as a result o f disability. 8 . By cashing in a 11 accrued s ick l eave accurn ,· lated under the prov i ou s plan upon normal or disabi lity retirement or separa t ion from the City at the rate of onP. hour's pay for each two hours of accrued sick leave . C. By , ash i ng in accru ed s ick leave under the previou s plan, once each ye ar at the conversion rate of four (4) hour s sick l eave for one (I) hour pa y , not to ex ceed a cJnversi on of more than 400 hour s e ach ye ar. ~e portinq of Temp orary Disability The employee or a mronber of the employee 's household sha 11 notify the employee's supervisor at least 30 minute s prior to the empl oy ee's scheduled r e porting time. No temporary di sability leave will be granted to an em- ploy ee who fail s to notify their supervisor prior to the begi nning of the I I I I employee's work schedule unl ess circumstances beyond the control of the emp l oyee would not pe rmi t . Verifi c ation of Disabil lty An at t endi ng physician 's stateme nt will not be ne cessa ry until after one (1) shift/day of disability , except when req uired by the Police Chief . If the Poli ce Chie f requires a physician 's stateme nt of disability, the City shall bea r t he cost of suc h physi ci an 's statement. An employee who ma ke s a fal se claim for temporary di sabil ily l eave sh all be s ubje ct to dis- ci plina ry action. ARTICLE 8. ON-THE-JOB INJURY -DISABILITY A. For any on -the -job injury which cau,es any emp l oyee to be absent from work as a re su lt of suc h injury, the City s hall pay to such employee his/her full wage s for the fir s t day of his/her absence from work up to and including th e 90th calenda r day of such abse nce , less whatever sums received by ~!·.c· emp l oyee as disability wages under workmen's compensation. The City reserve s lhe right to require any employee on injury or disability leave l o submit lo an examinalio n(s ) by City appointed physiclan(s ) at the City's expe nse or und er the provisio n o f workmen's compensation or the re- l i rcment /pcns ion provisions as provid ed under State Statute. B. All i njuri cs that occur duri n~ working hours sha 11 be reported to the employee's supervisor within 24 hour s of the injury or before the em- ploy ee leaves their de partm ent of emp l oyment. ARTICLE 9. MILITARY LEAVE A. Any perma nent or probationary emp l oyee who En l is ls or is inducted into th e mi l itary, nava l, air or other armed services of lhe United Slates sha 11 be entitl ed to a l eave of absence without pay for the duration of such war or until honorably discharged, whichever occurs first, and for one (I) year lherea fter . B. Any emp 1 oyee w~o sha 11 be a member of the Natio nal Guard or any other component of the mi Ii tary force s of the state, now or hereafter or- ganized or cons li tut ed under the sta te or federal law, or who sha 11 be a me mb er of the re serve forces o f the United States , now c hereafter or - ganized or constituted und er federa l l aw, shall be entitled to l eave of absence from his/her employment without loss of pay, senior ity, status, eff i ciency rating, vacation , sick leave or other benefits for all the time when he/she is engaged with such organization or co mpon ent in t rai ni ng or active service ordered or authorized by proper authority pursua nt to l aw, whether for state or federal purposes , but not exceeding fiftee n (l !i ) day s in any ca l e ndar y•a r. Suc h l eave shall be allowed In case the requ i red -7 - military service i s satisfactorily performe d, which sh all be presumed un • l ess th e contrary is esta bli sh ed. C. Such l eave shall nol be al l owed unle ss the employee returns to his/ her pub l ic position imm ed iatel y upon be in g relieved from such military ser- vi ce and not later than th e expiration of the time herein limited for such l eave , unless he /she i s prevented from so returning by ph ysical or mental di sab i l ily or other cau se not due t o hi s/her own fault or is required by pr oper auth oritie s lo conti nu e i n suci, military se rv ice beyond the time he rein limit ed f or s uc h leave. 0. Subject lo provi s i on A, 8, and C above, lhe Ci t y shall provide full pay lo an employe e granted m,l ilary leave, l ess whatever wages the employee may hav e re ce iv ed by lhe mi litary fer such servi ce . ARTICLE IO. FUNERAL LEAVE lh e Pol i ce Chi e f shall grant leave with pay lo an emplo yee to al tend the funeral of a member of lh e emp loyee 's family . The numb er of days gran• ted shal 1 be gov erned by the circums tan ce s of the case, but in no event shall th ey exceed five (5) working day s. For the purpo ses of thi s se ction, "emp l oyee's f amily " s hall mean th e empl oyees , spouse, or th e children, grandc hil dre n , par en t s, grandparents, brothers and s Is ler s of the employee or of the emplo yee's s pouse . Annual leave may be grant ed by the Police Chi e f if additional time off is deemed appropriate. ARTICLE II. JURY DUTY AND WITNESS SERVICE Leave may be gran t ed l o an emp loyee for ser ving on jury duty or as a witn ess in his/her official capacity in ob edie nce to a subpoe na or direc· li on by 1 ega 1 authority . He/ she sha 11 b2 ent It 1 ed to the d I fference betw ee n hi s/her regular compensation and the fees re ce ived for jury du ty or as a witness . Wh en he /s he i s subpoenaed in private litigat ion to t est ify, not in hi s/her offi c ial capacity but as an individu al , the time abse nt •., r easo ns thereof sha l l be taken as annual leave , per sonal leave or leave with out pa y. When any of t he foregoing holidays f all on a Satu rd ay, each empl oyee shall be e nt itl ed to a day off for s uch holiday , whi ch day off shall be sc hedul ed a s the City Manager and / or Pol i ce Chief de t e rmine s , but no specific day sha ll be observed as a ho li day for purpo se of closing City offices and functions . ARTI CLE 13. UNIFORM CLEANING ALLOWANCE I f an em ployee i s required to we a r a uni form, the emp loyee sha 11 wear t he un i fo rm onl y as a uth or i zed by the departm ent work rul e s . All em ploy ees shal l r,J in t a i n a pr es entabl e appearan ce whil e on duty. The emp l oyee is r es pon s ibl e for any damag e to t he uniform by neg li gence or deliberate ac t . The City wil l be re s pon s ible for pr ovi d ing and c l ea ning of said uniforms. ARTICLE 14. TUITION REFUND Upon reco mmendati on of the Pol i ce Chief and aft er pri or approval of the City Manager or his/her de s ign ee , the City of Eng l ewo od may reimburse an em ploye e for satisfactory comp l etio n of attempted cou r se wo rk of Grade C or above for under graduat e and gradu at e clas ses al 100% of public inst itution rate s or 50 % of private in stitution rates . Thi s i nclu de s reimburseme nt for the co s t o f r equ i red t ex t s and ass oc iated mandatory f e es. [m ploye e s e nroll ed in prog r ams which r equire attendan ce during reg ula r- l y scheduled wo r king houn may be gran t ed time off wit h t he employee and City equally shari ng the cost on a 50 % basis . The emp loy ee may elect to use annua 1 1 eav e , per so nal leave or compen s atory t i me to reimburse the City fo r t he lime taken off during working hour s t o pur s ue a degree. ARTICLE 15 . LIFE INSURANCE Term life in s uran ce will be provided by th e City for emplo_yee s co ve red by thi s Re sol ution of S35 ,000 for eac h employee . A co nver s ion privil ege upon retireme nt of 50 % co verag e payab l e by the employee will be made avail- abl e by th e City for said r e tired emp l oyee. ARTICLE 16. Any dispute co ncerni ng the i nterpretation or applicat i on o f be nefit s under the dental plan shall be subject to the dispute r eso luti on proc edure only. ARTI CLE 17 .
