ARTICLE 6. Ver ification of Di sabil ity An att end in g phys i c ian's statement will not be necessa r y until after one (I ) shift/day o f disability, except when required by the fire Chief. If t he Fire Chi e f requires a phy sician 's statement of di sa bility, th e City sha ll bear the cost of suc h phy s ician 's sta t ement. Ab use of Tempora r y Oisabil lty Abu se of t emp orary di sabil ily occurs wh en an employe~ misrepresents the actua l reason for requesting temporary disabll i t y or when an employee uses t emporary disability leave for unauthor ized purposes. An employee wh o makes a fa l se c l aim for temporary di s abi l ity leav e shall be subject to dis- ci plinary action . ARTICLE 7. ·ON-THE-JOB INJURY -DISABILITY A. For any on-the -j ob in j ury whi ch ca uses any employee to be absent from wor k as a re sult of su ch injury, the City shall pay to such employee hi s full wages for the f irst day of hi s ab se nce from wor k up to and includ-I ing the 90 t h calendar day of suc h abs ence, le ss ·,,hatever sums received by th e emp l oyee a s disabi lity wage s und e r workmen's compensatio n . The City re serve s the ri ght to req u I re any emp 1 oyee on injury or disability 1 eave to s ubmit to an examination (s) by Ci t y appointed phy s i c ian(s) at the City's expense or und er the provision of wo r km e n's compensation or the retirement/ pen s ion provision s as pr ov id ed under State Statut ~ . • 6 • I I B. Al l injuries that occur during working hours shall be reported to the employe e's superv isor within 24 hour s of the Injury or before the em- ployee l eav es their depa rtment of employment. ARTICLE 8. MILITARY LEAVE A. Any employee who shall be a member of the National Gu~rd or any oth er com pone nt of the mil ilary forces of the slate, now or hereafter or- ga n I zed or co ns l I luted under the s late or federa 1 law , or who sh a 11 be a member of l he re se rve force s of th e United States, now or hereafter or - gan I zed or co ns t I luted und er f ederal law, sha 11 be enl It led lo leave of ab sence fro m hi s employment with out lo s s of pay, se ni ority , status, ef- fi c iency r ating, vacation, sic k leave or ot her bene fits for all the time wh en he/s he i s engag ed with suc h organization or component In train ing or active service ordered or authorized by proper authority pursuant to law, whether for s tale or federal purposes, but not excee ding fifteen (15) days in any calendar year. Such leave shall be allowed In case the required mi litary se rvice is satisfactorily performed, which shall be presumed un - le ss the contrary i s established . C. Such l eave shall not be allowed unle ss th e emµloyee returns to his pub li c po s it i on Immediately upon being relieved from such military service and not l at er than the expira t ion of the time herein limited for such l eave, unl ess he/she is prevented from so returning by phy s i ca 1 or mental dl sabil lly or other ca use not due to his own fault or i s required by prop er author iti es to continue in su ch military service beyond the time herein l imlled for such leave. O. Subje ct to provision A, B, and C above, the City shall provide full pay to an emp loy ee granted milit ary leave, les s what ever wage s the employee may have r ecei ved by the mil ilary for s uch servic e. ARTICLE 9, FU~~RAL LEAVE The Flre ·Chi e f sha ll grant le av e with pay to an emp loyee to attend the fun eral of a member of the employee 's family. The number of days gr anted shall be govern ed by th e circumstances of the cas e, but In no event shall the y exceed five (5) working days for non-s hift em pl oyees or three (3) shift s for shif t work employee s . For th e purposes of thi s section, "em- pl uyee 's family " shall mean th e employees , spouse, or th e chi l dre n, grand ch ildren, parents, grandp arent s , brothers and s i s t ers of the em ployee or of the em ployee's spouse and oth er member s of th e famil y al the dl ~c re - tion of th e City. -7 - ARTICLE 10. JURY DUTY ANO WITNESS SERVICE Leave may be gra nted to an emp loyee for serving on jury duty or as a wi tn ess in hi s of f icial ca pa ci ty in obedience to a subpoena or direction by lega l aut hority. He /s he shall be entit l ed to the difference between his regu l ar comp ensation and th e fees received for jury duty or as a witness. When he/s he i s subpoenaed in pr ivate litigation to te st ify, not in his of- fi c ial capacity but as an indi vi du al, the tim e abs ent by reasons thereof ,hJl I be lak en as annu al leave, pe r sona l leave or l eave without pay . Wh en any of the foregoing holi days fall on a Sunday, the fol low ing Monday shall be ob se rved as t he legal holiday . When any of the foregoing holiday s fall on a Saturday, ea ch employee s hall be entitled to a day off for s uch holiday, which day off shall be sc hedu l ed as th e City Manager ~n d/ or Fire Chief determin es , but no s pe ci fi c day shall be obse rved a s a holi - day for purpo se of cl os ing City offi ces an d fun ction s. ARTICLE 12 . UNIFORM CLEANING ALLOWANCE I A. Jf an employee i s required to wear a uniform and /o r s afety equip -I me nl , the em ploy ee s hall wear t he uniform and /o r afety eq ui pment only as authorized or required by th e department work rul es. All employees shall maintai n a presentable app eara nce while on duty . Th e em ployee is respon- sible for any da mag e to th e uniform or safe t y eq uipm en t by neg li gence or deliberat e act. The City wi ll be respon s ible for provid in g all uniforms and s afety eq uip ment. • 8 • I I The Department , on a r ep la ceme nt bas is, will bear the cos t of re - pla cement uni form s. The new replac eme nt uni form will mee t or exceed recog- niz ed indu s try st andards suc h as tho se published by OSHA, NFPA, or the U.S. ll ur e a" of s t.ndard s. Should the depa rtment auth or ize or require a specific work/Hfety shoe, t he department will provid e s aid shoes which will be con si de red part of the r equired uni form. If th e department require s and provide s the shoes as de sc ribed abov e, the foot wear allowan ce as provid ed In C below will be r edu ced lo f i fly percent (5 0%) of the co s t of authorized footwear up to $50 .00 per year. TUITION REFUND Upon r ec omme ndation of the Fire Chief and af ter prior approval of the City Manag er or hi s deslgn ee, th e City of Engl i wood may ·re i mbur se an em- ploy ee for sa ti s fact ory comple tion of attempted course work of Grade C or abo ve for undergraduate and graduate classes at 100% of public institution rates or 50% of private in st itu tion rat es . Thi s includes rei mburseme nt for the co s t of required te xts and as soc iated mandatory fe es. Emp l oyees enroll ed in programs which require attendance dur i ng regular- ly schedu l ed wo rking hours may be granted ti me off with th e emp l oyee and City equally s haring th e co s t on a 50% basis . LIFE INSURANCE Te rm 1 i fe ins urance will be provided by the City for em ployees covered by this Resolut io n of $35,000 for each employee . A conv ersion privilege upon retireme nt of 50 % cov erage payable by the emp l oyee will be made avail- able by the City for sai d r etired emp loy ee . ARTICLE 15. DENTAL INSURANCE During the li fe of thi s Reso lu tion, th e City s hall pay at l eas t $35 .00 pe r mo nth toward the premium cost for depe ndent coverag e and at l east SI 1 .00 per month fo r s ingle coverage fo r the City Dental I nsura nce Plan or other pl an se l ected by the City as a sub s titute for the City ll ealth Plan for each s ingl e and dep endent policyho ld er. -9 - Beginni ng January 1, 1988, emp'oyees will pay S5.00 per mo nth toward the pr emi um co s t for dependen t cov erage and S2.00 pe r month for e,;ngle coverage for dent a 1 insurance. ~n y di s pu t e concernin g the inter pre t atio n or appli cat ion of benefit s und er the denta l plan sha ll be sub ject to the di s pute re solution pro ce dur e only. ~RTIC LE 16.
