The probat ionary pe r iod for all newl y ap pointed employ ees shall be twelv e
(1 2) months from the date of hire . Aft e r comp letion of th e prob at ionary peri -
od, lhe employee s hal l be given perm anen t s tatus .
A. A promoted City emp loyee shall re ce ive a minimum of one step incre ase
in pay and se rv e a tw e lve (12) month prob ati onary pe riod i n the new pos i -
tio n ; provid ed , howe ve r, that after ha v in g sa ti s fa ctoril y served in sa id
ne w pos iti on for a pe ri od of at l eas t s i x (6) month s, th e head of th e de -
par tm ent lo which the employee wa s promoted may r ec omm end permanent status
;n the new po si tion fo r the emp loyee prior to th e expira t ion of th e tw elve
(1 2) mon th pe r iod. Any s ub s tantial tim e se rv ed in an acti ng capaci t y by
th e emp l oyee will be taken int o con si der ation by the de partm ent he ad wh en
r ecomme ndi ng th e length of t he pro bati onary pe ri od lo the appointing au -

des igna t ed repres entative shall respo nd in writing within ten (IO) work days.
If th e gr ie van ce i s sti ll un s ettled , the Englewood Employee s Association
or bargai n ing unit ~mpl oyee, within ten (JO) work day s after the r e ply of the
City Ma nage r or h is/her de s i gnated re presentative, may, by written
nol ic e,r eque s t th e mat ter be he ard by the Career Ser vice Board. The Career
Servi ce Bo ard sha 11 be reques led to issu e a dee is ion within thirty ( 30) days
a f te r con c lu s io n of te s timony and argument. Each party shall be responsible
for com pens ation to it s ow n r e prese ntatives and witne sses . Failure by the
Eng l ewood Employe ~s Ass ociation or an emp loyee to co mply with any time limita -
t ion s hall co ns titut e a sett l ement of the grievance . Should the employer not
,·espo nd within th e prescribed time, the gri evance will automatic ally pr oceed
to th e next s tep .

C. If the correc tive action wa s for unacceptable behav ior s uch as ab sen-
t ee i •m, tardine ss, or rule s violati ons and no simi lar violation s were
com mi tte d by the emplo yee during the followin g on e (1) yea r period, th e
cor rective action sha 11 be re placed with a writ ten s t atement by the em -
p J oyee' s s up ervisor th a t no similar violation has acc rued during the one
(I) year pe riod and that th< correct ive action ha s be e n remov ed from the

ARTICLE 30. DUES DEDU CTI ON
A. The City agree s to dedu c t the Englewood Employee s Association du es
each pay pe riod from th e pay of those employees wh o individually request in
w1·iting th a t s uch dedu c tions be made, s ubje ct to the garnishment law s of the
State of Colorado. Th e amount s to be dedu c ted shall be cer t if i ed to th e City
r i nance Di r ec t or by th e Trea s ur er of the As soc i a ti on, and the aggreg a l e deduc -
t io ns of all empl oyee s s hall be remitted t oget her 1,ith an itemized stateme nt
lo th e Tr ea s ur er by the 15th of the s uc ceedi ng month, after suc h deduction s
arc made . Th e authorization s hall be revocable during the term of the Co n-
t ra c t, upon a thirty -day (30) written notice by the employee to the City
