WHEREAS , the Engl ewood i;ity Council , upon r ecoomenclation of the City Pla nning and Zonir,g Ccmnission pre viously a pproved 3incla ir Park Pl anned Devetvpnent in 1977; and WHEREAS, an a pplication to amend the S inclair Pa rk Pla nned Dev e lopment was filed by Mr. Joseph Hef fl e y, Pr esident of Winley I nc . , d/b/a can-den Hemes. NOW , THE REFORE , BE IT RESOLVED BY 11iE CITY CXlUNC!L OF IBE CITY Of ENGLfl,IOO(), COLORAD'.l , AS FOLLOWS: CITY COUNCJJ L FINDS : l. Th a t the application in Case Number 1-85 is conc e rned wi th an amendment to a prev iously approved Planned Development for proper~y at 300 wes t Grand Ave nue i n the City of Englewood , County of l\rapahoe , State of Colorado , l ega lly described as follows : A portion of Section 10 , Town sh ip 5 So uth, Range 68 West of the 6th P.M., more particula rly described as fo llows: Beginning at the South quarter corner of s aid Section 10 ; thence Sou t h 89048' 36" West a dista nce of 101 6 .66 feet ; the nce North 00029' 10 " East a dist ance of 220 .00 feet to the true point of beginning ; th, nee North 00029 ' 10" East a dista n~e of 410 . 00 fee t ; t he nce South 89048 ' 66" West a distance of 165 .29 feet , more or l e ss , to the Northeast corner of Lot 16, De lawa r e He igh ts ; thence South 00029 ' 10" West a distance of 410 .00 feet ; th,,rce North 89048 '36 " East East a distance of 165 .28 feet to l11e true point of begin- ning , conta ining l.556 acres , mor e or l ess . 2 . That the area with which the appli ca ion is concerned is to be developed by Mr. Joseph Hef fley , who is under contract to purchase the proper ty loca ted at 300 west Grand Avenue owned by Eugene D. Johnson . The appli cation is for a n amendment to the approved Sinclair Park Planned Development. 3 . Th at the Sinclair Park Planned Development was origi na lly a pproved by Englewood Ci ty Counci l in 1977 ; the a pplication to amend s aid Plann ed Development was filed wi th the Department of Ccmnunity Deve l opment on Decembe r 7 , 19 84 . 4. Th at the objective of filing of thi s application to amend i s to al low the construction of 22 townhouse dwellings , rather than 20 dwe lling u11its , and change the bui l ding de sign a nd l ocation as well as the t'"a ffic circulation , open space , and yar d s e tba ck fron the a pproved Planned Develo[>TIPnt. 5. That a public hearing was he ld before the Englewood Pla nning and Zoning Ccmnission on Janu ary 22 , 1985. 6 . Th a t the Plann ing and Zo ning cannission is of t he opinion there should be some flexibility in the Planned D!>ve lo[Xnent guide- lines . 7 . Beca use of new concepts i n develo[Xnent a nd the limited amou nt of a vailable l a nd in the City for mecli um-densi!:y housing , the design as proposed is appropri ate to be construct,c· on the subject property a nd that cam:len Place One Pla nned Devdo[Xnent is consistent with t he inte n t of the Compr e he nsi ve Pla n . (X)NCLUS IONS : l. That proper notice was given of the Public Hearing which , ... _ held on J a nu a ry 22, 1985 . 2 . That the applicat ion fi l ed by Mr . Joseph Heffley for 300 \'fest Grand Avenu e , to be known as carrrl en Place One , is in canpl i a nce with the Pl a nn ed Deve lo[Xnent District and the R-2 , Medium-De ns, ty Residence Distr i c t. 1 . Tt ,~t t he Plan ame r.dment i s designed for home owne rship. 4 . Th at t he amended Pla nnec Develo[Xnent would be compatibl e with the neighborhood and will have no adverse effect on the adjacent properties . 5 . Th at the proposal amendme nts are consistent with the inte nt a nd purpose of the City Compr e he ns ive Plan . IT JS HE REBY DOCIDED that this Council adopt the foregoing Findings of Fact and Concl usions of the Englewood Pla nn 'ng and Zon i ng Ccmn issi on and a pprove th a pplication to amend a n appr<'ved Planned Developrent for property located at 100 West Grand /\venue to be known as Caroen Place One .
