HomeMy WebLinkAbout1985 Resolution No. 011I RESOLUT I ON ~N~O~,___,/_/ _ _.c;S~E~R~I~E~S_:;.O~F_=-cl9~8=5 A RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF ENGLE\oKJOD, r.OLORADO, TO CREATE A SPECIAL IMPROVEMENT DISTRICT IN TIIE CITY, TO BE DESIGNATED AS PAVING DISTRICT NO, 30, ADOPTING DETAILS AND SPECIFICATIONS FOR THE PROPOSED DISTRICT, AND ORDERING PUBLICATION AND HAILING OF THE NOTICE OF HEARING TO THE OWNERS OF THE PROPERTY TO BE ASS ESSED FOR IMPROVEMENTS IN THE DISTRICT, WHEREAS, the City Council o f Englewood, Colorado, has deterr.1ined that it is necessary t o create a special imp r ovement district within the City, for t he p 1,rpose of con structing and i nstalling street paving, curb n11d gutter and sidewalk improvem e nts, togeth e r wi th ne c essary incidentals , on certain streecs as set forth in this Resolutio n , and to asse s s the cost of the improvements again st the property specially benefited by the improvements and included within the d ist rict; and WHEREAS, pursuant to the Cha r ter of the City and Chapter 14 of the Municipal Code of th e City, th e City Council has d e termined t o construct and install s uch im p rovements, provided however, that the City Council shall conside r all protests and objections that may be mad e in c on nection with the proposed improvements, before or de ring the cons tr uction thereof; and WHEREAS, pursuant to an order of the Cit y Council, the Enginee r of the City for the proposed speci al improvement project has prepare d and filed prelimi nary plans, specifications, est i mate s of c ost, maps and sch ~dule s for the proposed improvements: BE IT RESOLVED B Y THE CITY CO UNC IL OF THE CI ':Y OF EN GLEWO OD , COLORAD O: 1. That. the City Council h e.s dete rmined th e r e exists a n ecessi t y for th e con st ru c ti o n and i nstal l at io n o f t h e street paving , curb a nd gutter and sidewalk improvem en ts, t oge ther with necessary incident a ls, o n thos e streets which ar e more parti c ul a rly s et forth in th e no tice of h ear ing , and to creat e a special i mpro vement district for such p urpose, 2. That th e Engineer's reports, t oget her wi th th e pr eli mina r y deta ils , specif icati o ns, estimates of cos t, ma ps an d -l - schedules prepared and filed with the City Clerk be and the same ar e hereby appr o ved and adopted by the City Council for use in the con s tru ct ion and installation of the improvements to be made in said improvement district. 3, That materials to be used in constructing and installing the proposed improvements are stated i n the Notice h ereinafter set forth, 4. That the assessme nts to b e lev i ed ag a inst th e property to be included within the district, f or said improvements, shall be du e and payable with i n thirty days f ~ a ·~ after the fin a l publication of the ordinance a sse ssing t h ,• 1,\t,· l e actual c ost of s aid improvements against th e real property in .,a la di stri ct, provide d, however, that any owner who shall pay the e nti r e amount of the assessment within said period of time, shall be entitled t o an allowance of 5% of the amount of th e assessment . In the even t any ow ner of real esta te shall fail to pay the whole of such assessment against his or her property with i n said thirty da y s , then the wh ole cost of said i mproveme nts so assessed a gai nst such pr oper ty shall be payable in ten (10) e qual. a nnLal in s tallments of assessments. The interest rate on the unpaid installments of assessments will be at a rate not e xceeding 14\ pe r annum, as shall later be established by ordinance. The first of said installments of principal and interest shall be du e and payable at such time as may be determined in and by the ass e ssment ordinance, and the remaind e r of th e annual installments of principal and interest shall be du e and payable suc c e ssively on the same day in each year thereafter until all are pa id in f ull, 5, That the property to be assessed f o r said improvements shall be the property spe ci a lly ben e f i ted by said im provements and included wit hin th e im p rovement distr i ct, and mor e particularly d e scribed in the Notice hereinafte r se t f orth. 6, Tha t there s hall be prepar~d an ordinance creat i ng within th e corporat e imits of t he City, a special improvement o istrict to b e designated as Paving District No, 30, providing for th e const ru ction an d i ns t allation of th e i mprove me nt s, all a s d escribed in th is Reso lution, and in ac co rdance with t he -2 - I preliminary r -,port , plans, maps, specifications, details and estimates of c,sts o f ~~e Engineer, herein referred to and n ow on file in the office of the Director of Engineering Services. The proposed ordinance will be considered for passage on first reading bi• the City Council at a regular meeting thereof to be held on April 15, 1985, 7. Notice of the public he aring on the creation of the district shall be publist,ed once a week for three weeks in the Englewood Sentinel, a newspaper of gen eral circulation in the City. In addition, a copy of such notice shall be mailed, postag e prepaid, to each known owner of real property within the proposed district. The c os t of improving street , av e nue and all ey intersections throu g h o ut the District, and of paving i n excess o f 36' widths and 8" thickness on streets designated as a rterial o r collector within residential zoning as of Ma r c h 4, 1985, ••ill b il paid by the City. Property owners are specifically referred t o th e schedule of proposed assessments which will be o n file in th -, Office of the Directer of Engineering Services, from whi c h t h e appro ximate amount to b e asse s sed a 7•,J n s t any particular l o t or parcel or prope rty may be determined. Up o n completion of said improvement s , or as soon as the total cost thereof Is definitel y •.~e rtaine d, such cost shall be apportioned to the property in t he District. No tice of such apportionment shall be given and a hearing will b e held prior to the adoption of an o rdinance asses s ing such c o s t, all as provided by law. (f) The asse s sments will be due and payable without demand within thirty days from and after the final publication of an ordinance assessing the whole c o st of said impr o vements against the real prope rty in the District: pro vided, howeve r, that any owner who shall pay the full assessme nt within said p e riod of thirty days shall be entitled to an allowance of five percent ( 51). In th e ev e nt that an owner of ,-~3 1 propecty shall fail to pay the whole of such assessment again s t the prop e rty within said thirty days, then the whole cost of said improvement so assessed against the property shall be payable in ten equal annual installments of principal. The first of such installment s of principal shall be due and payable at such time as may be determined in and by the assessing ord i nance, ar.d the remai11der of said Installments shall be payable on the s a me date each ye~c thereafte ,· •:ntil all are paid in full. The rate of i n terest to be paid on u .. p a id and deferred installme nts will b e at a rate not exceeding 141 p er annum, as shall be e s tablished by ordinance to b e adopted by the City Council at a later dat e .
