WHEREAS,. tr.e State o:!: Colorado relie s upo n ~v e a l gover n - ments to carry out many licensing and r eg ulatory ~ctivities and s hould prov ide l oca l gover nme n ts and their t axpayers with sufficient pr otection to exercise t hat r e~ponz ibility wi t ho ut fear of expensive antitrust litigation and liability; and WHEREAS , the exposure of munici alities in Colorado and througho:.i t the country to ant i trust lawsuits ha s been expa nded as a res ul t of r ecen t decisions of the United States Supr eme Court; anc 1;HER EAS , the potential for damage awards and the s ub- stantia l expense of uefendinq antitru st litiqation , even if s :.icc ess ful, may inhibit-municipc1liti es f rom er.acti n~ or enforcing regul ations which protect the pub lic health , sa f ety and welfare , but which a l so may be d eemed to r es tr uct competi - tior?; c::.11L! Hl.EF.C:AS, at least ti11e Color ado municipal ities ai.~eady have been s ued unrl er the antitrust laws; 2.nd WHERFAS, o ther Colo r ado mun i cipalities have been thr atened with antitrust l aws uits for l i ce nsing or r egt:lator y decisions; and 1-IHER EAS , the cost to the taxpay e rs of Boulder, Co lorado, in defending one f ede ral antitrust lawsu it , which was settled prior to trial, wa s an escimated one-quarter million dollar s ; and WHERE AS , municipalities differ from private enterprise in that pr ivate e nterprise is not charged with protect ing th e public healtl , safe t y and welfare through licensing and regu lation ; and WHERE AS , nu me rou s protections from municipal licensinci and r eg ula to r y ac t ions , other than dama ges under the antitru s law s , a r e available s uch as public notice , public hearing , pub lic mee ting and pub lic r ecord r eq uirements , court r eview of act io ns , periodic e lections a nd the rights of init ia tive , refere ndum and r eca l l , and the con t in uing authority of lhe General Assembl y or the peo p l e of Co l orado to modify the stat u o r y or con s titutio na l authority of Co l orado 's mun icipali t ies ; NOW, THEREF ORE, BE I T RES OLVED BY THE CITY COUNCIL OF THE CI TY OF ENGLEWOO D, COLORA DO, AS FOLLO WS: That the Colorado Ge n e ral Assemb ly should act as q u ickly as possibl e to adopt H.B. 1134 in order to protect l ocal governments and their taxpayers from expensive anti- tru st litigation and liability for l oca l licensing and regulatory activity and that the City of Englewood s u ppo rts ef f o rts of the Colorado Municipa l League in this r e gard.
