ENGLBWOOD, COLORADO, '1'0 CRBATB A SPBCIAL IMPROVEMENT DISTRICT

WHBRBAS, the City Council of Englewood, Colorado, has
determined that. it i• neceaaary to create a special improvement
district within· the City, for the purpoae of constructing and
installing atr .. t paving, curb and gutter and sidewalk improvements,
together with neceaaary incidental•, on certain streets and avenues
as set forth in thia reaolution, and to assess the cost of the
iaprov,...nt• a9ainat the property apecially benefited by the
improvement• and included within the district; and
WBBJUIAS, purauant to the· Charter of the City and
Chapter 14 of the Municipal Code of the City, the City Council
has determined to construct and install such improvements,
provided, however, that the City Council shall consider all protests
and objection• that aay be .. de in connection with the proposed
.i11ll'covt:111ent», befortt orderinv the construction thereof; ancl ·

Engineer of the City for the propoaed special improvement project

BB IT RBSOLVBD BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO:
l . That the City Council has determined there .exists
a necessity for the conatruction and installation of the street
paving, curb and gutter and aidewalk improvements, together with
necessary incidental•, on tho .. atreets and avenues which are
more particularly ••t forth in the notice of hearing, and to
create a apecial iaprov ... nt diatrict for such purpose.
2. That the &nvineer•a reports, together with the
p reliminary details, apecificationa, estimates of cost, maps and
~chedulea prepared and filed with the City Clerk be and the same
are hereby approved and adopted by the City Council for use in
the construction and inatallation of the improvements to be made
in said iaprove11ent diatrict •

3. That .. teriala to be used in constructing and
installing the propoaed illprovements are stated in the Notice
hereinafter set forth.
4. That the •••••...nta to be levied against the
property to be ·included within the di•trict for said improvements
shall be due and payable within thirty days from and after the
final publication of ~ ordinance ••••••inq the whole actual cost
of aaid improvszent• a9ain•t the real property in said district,
provided, however, that any owner who shall pay the entire amount
of the a•••••=•nt within said period of time shall be entitled
to an allowance of 5t of the amount of the assessment. In the
event any owner of r .. 1 estate shall fail to pay the whole of '
such aaaeaament a9ain•t hi• property within said thirty days, .
then the whole coat of said improvements so assessed against his
property •ball be payable in ten (10) equal annual installments
of aa• .. •••nta. Th• intereat rate on the unpaid installments of
a• .. •• .. nt• will be eatabliabed by ordinance to be adopted by the
City Council at a later date. The first of said installments of
principal and int.reat •hall be due and payable at such time as
may be determined in and by the aaaeaament ordinance, and the
remainder of the annual inatallments of principal and interest
shall be due and payable aucceasively on the same day in each
year theroafter until all are paid in full.
5. That the property to be assessed for said improve-
ments shall be the property specially benefited by said improve-
ments and included within the improvement district, and more
~~rticularly describud in tho Notice hereinafter set forth.
6. That there •ball be prepared an ordinance creating
within the corporate liaita of the City a special improvement
cliatrict to be known aa Paving District No. 27 providing for the
conatruction and inatallation of the improvements, all as described
in this a.aolution, and in accordance with the preliminary .report,
plana, aapa, •P8Cificationa, details and estimates of costs of the
Engineer, herein referred to and now on file in the office of tho
Director of Bngine9rinrJ serviaell.The proposed ordinance will be considered
for pasaage on firat reading by the City Council at a regular meet-
ing thereof to be held on April 7, 1980. ·
7. Notice of the public hearing on the creation of
the district ahall be publiahed once a week for three weeks in
the Englewood B•rald S8Atinel, a newspaper of general circulation
in the City. In addition, a copy of such notice shall be mailed,
postage prepaid, to each known ownor of real property within the
proposed district.

(b) The description of the :proposed district, and

including the real property within one-half (1/2) block of such
streets and alleys. Adjustments for the assessment of costs

(c) Th9 probable total cost of the improvements
to be conatructed and inatalled i• $596,200.
(d) Th• probable amount of the total cost which
the City •hall pay i• approximately $136,500 •
(•) The balance of the total cost which is not
paid by tbe City of Bnglewood will be assessed against the pro-
perty apecially benefited by the improvements, and included
within the Di•trict. Probable costs per front foot for said
improvements are a• follows:
Asphalt paving on atreets 36' wide (6 and 2) $25.55 per front foot
Concrete alley paving 14' wide $40.02 per front foot
Paving of other width• •ball be in proportion to the above estimate.

The .coats of paving to be constructed along the
sides of corner lots within said District shall be assessed
against properties within one-half (1/2) block, or 300' of
such intersections and corner lots, whichever is smaller,
on a zone basis in accordance with benefits conferred on such
properties.
Bach one-half (1/2) block, or 300' section, will
be divided into six (6) parallel zones and assessments will
be on the following basis:

No aaaea ... nta will be made for curbs, gutters and
sidewalk• in place which confora with the plans and apecif ica-
tiona for the proposed illprov...nta and which are acceptable to
the City Bngineer.
The coat of illproving street, avenue and alley inter-
sections throughout the District, and of paving in excess of 36'
widths and a• tbickn••• on street• designated as arterial or
collector within residential sonin9 aa of March 3, 1980, will
be paid by tbe City of Englewood.
Property owner• are apecif ically referred to the schedule
of propoaed aa .. a...nta which will be on file in the Off ice of
the Director of &n9in .. ring Services, from which ·the approximate
amount to be aa .. a .. d against any particular lot or parcel or
property •Y be deterained.
Upon CQllPletion of said improvements, or as soon as the
total coat thereof ia definitely ascertained, such cost shall be
apportioned to th• property in the District. Notice of such
apportioftllent shall be given and a Hearing will be held prior to
th• adoption of an ordinance aaaeaaing such coat, all as provided
by law •

(f) Said assessments will be due and payable without
demand within thirty days from and after the final publication
of an ordinance assessing the whole cost of said improvements
against the real property in said District: provided, however,
that any owner who shall pay the full assessment within said
period of thirty days shall be entitled to an allowance of
five percent (St). In the e~ent that any owner of real pro-
perty shall fail to pay the whole of such assessment against
the property within said thirty days, then the whole cost of
aaid improv .. ent so a•••••ed againat the property shall be
payable in ten equal annual inatall.ID8nt• of principal. The
first of auch installment• of principal shall be due and pay-
able at such time as may be determined in and by the assessing
ordinance and tbe r-inder of said installments shall be due
and payable on the aame date each year thereafter until all are
paid in full. The rate of in~ereat to be paid on unpaid and deferred
installments will be eatabluhed by .. ordinance to be adopted by ·
the City Council at a later date.
(9) A &earing on the creation of the District will
be held by the Council on Monday, tba 31st day of March 1980,
at 7:30 o'clock P.M., at the City Hall in Englewood. A
public hearing shall be held prior to the final passage of
such ordinance, at the regular meeting at 7:30 P •. M. on Monday,
April 21, 1980.
(h) Any person desiring to be heard upon the issue
of the creation of the district or upon the construction,
installation or improvement of the improvements involved,
may appear at the time and place set for the public hearing
ti.reon for that purpoH.
(i) A map, estimate and schedule showing t~e approxi-
mate amount to be assessed, and all resolutions and proceed-
ing• will be on file and can be seen and examined by any person
interested at the Office of the Director · of Engineering Services
at any tiae during busine•• hour• on or prior to the date ~f
hearing.
