tion Ro. 26 Serie• of 1980, relating to the proposed Downtown
Iaprov•••nt Diatrict Ro. 1980-1, and providing for a public
hearing to be beld on the conatruction and installation of the
propoaed i11Prove•nt• and the creation of a special iliprovement
diatrict1 and
11111Jt1AS, at the public hearing held on July 14, 1980,
the City Council heard and conaidered all protests, objections
and c011Mnta, concernin9 the propoaed improvements and the propos-
ed special i•prove .. nt diatrict1 and
WllERBAS, after conaidering all such protests, objections
and co•••nts, the City Council has determined to make certain
chan9•• in the boundary of the proposed district, to delete
certain i•prove .. nta pro1»9sed to be constructed and installed, to
amend th• ••tiute of the total project coat, and to change the
method of the aaaeaa .. nt of coats1 and
WBBREAS, in view of the proposed changes, the City
Council baa detenained that it i• necessary to provide for a
further hearing on the propoaed improvements and the proposed
special i•prove .. nt diatrict1
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLBMOOD, COLORADO:
1. That the following changes shall be made to the
proposed i•provements and to the proposed special improvement
district a
(a) The i•provements to be constructed or ~nstalled
are aa followa1
(i) Walk-through improvements at 3448/3450 So. Broadway
to connect the proposed parking lot with South
Broadway1
(ii) Parking lot for approxi .. tely 130 spaces in the 3400
bloc~ of South Lin-=oln Street.

(b) The ••tillated total project cost of the improve-
.. nta liated in paratrapb (a) above ia $589,3001 it is anticipated
that the City of Englewood vill pay approximately $135,000 and the
Englewood Dovntovn Development Authority approximately $70,000
toward the total project coat. The balance of such cost will be
a•••••ed againat the property within the district.
(c) The propoaed method of aaaeasment of cost shall
be aa fol lowa 1
(i) the coat of the parking lot improvements (including
all land acquiaition) will be aaaeaaed against each
lot taking into conaideration the number of off-
atreet parking apace• required by city zoning laws
and the actual nullber of off-street parking spaces
vbich are preaently provided by the owner. For the
purpoae of a•••••in9 the costs of the parking
i11ProveMnta, the diatrict will be divided into a
Priaary lone (bounded on the north by Girard Avenue,
on the aoutb by Baapden Avenue, on the east bv South
Lincoln StrMt, and on the west by the alley
between South Broadway and South Acoma Street),
(ii)
and a Secondary Zone (con• iating of all of the
re .. inin9 area in the diatrict). Deficient spaces in
the Pri .. ry lone vill be aaaeaaed at 1 1/2 times the
rate for deficient apace• in the Secondary Zone,
thus eatabliahing a 60t/40t coat ratio between the
two zones. The eatiaated cost in the Primary zone
ia $958.02/parking apace which is lacking and in the
Secondary lone ia $638.67/parking space which is
lacking. Ho credit will be given to any property
owner for providing more parking than is required.
the coat of the walk-through improvements will be
aasessed against all of the property within the
district (excluding property owned by the City of
Bn9lewood and the Englewood Housing Authority) in
the proportion that the aqua re footage of each lot
or tract in the Primary and Secondary Zones (as
defined above) bear• to the total square footage of
all the ••••••able property within the Primary and
Secondary Zonea, reapectively. The estimated cost
to be aaaeaaed in the Primary zone is $0.124/sq.
ft. 1 and the estimated cost to be assessed in the
Secondary zone is $0.083/aq. ft •

once a week for tbr .. week• in the Englewood Sentinel, a newspaper
of general circulation in the City and, in addition, a copy of
such notice •hall be .. 11ed, po•tage pre-paid, to each known owner
of real property within the propoaed district. Thia Resolution
•hall conatitute the notice of public hearing.
4. All other provisions of Resolution No. 26 Series
1980, P••••d and adopted on June 16, 1980 shall apply to the
propoaed project and the creation of the propoaed .special i•prove-
.. nt di•trict, except a• •pecifically ... nded herein. Any provi-
aion of aaid aeaolution which i• in conflict herewith, ia apeci-
f ically repealed.
5. Should any one or 110re •ectiona or provi•iona of
thia Reaolution be judicially determined invalid or unenforce-
able, auch determination •hall not affect, impair or invalidate
the re .. ininv proviaiona thereof, th• intention being that the
varioua proviaiona hereof are severable •
