RESOLUTION MO. 40 , SERIES OF 1980
A RESOLUTION AUTHORIZING THE NOTIFICATION
or PROPERTY OWNERS OF ASSESSMENTS WITHIN THE
SOUTH SECTION IN PAVING-DISTRICT NO. 26 AND
ESTABLISHING A .. TE FOR A PUBLIC HEARING ON SAID
ASSESSMENTS.
WBEREAS, the atreet paving, curb, gutter and sidewalk
improveiaenta within the South Section ·in Paving District No. 26,
in Englewood, Colorado, have been satisfactorily completed and
have b .. n accepted by the City of Englewood; and
WHEREAS, a atatement showing the whole cost of said
iaprove .. nta and a proposed apportionment of the same against the
property within the South Section in the District has been filed
with tbe Director of Finance1 and
WHEREAS, the City Council bas considered the special
benefits accruing on each lot or tract of ·land within the South
Section in the Dia tr ict by reason of the making of the improve-
ment• and has determined that the apportionment of the assessments ,
for said iaprove .. nta, •• set forth in the assessment roll, is in
accordance vith such benefita1
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO:
1. That the Director of Finance is hereby authorized
and directed to notify the owners of the property to be assessed
for said improvements by publication of this Resolution in three
consecutive weekly iaaues of The Englewood Sentinel, a newspaper
publiahed and of general circulation in the City of Englewood,
that aaid iaprovements have been completed and accepted, that the
cost thereof haa been apportioned according to benefits and that a
hearing on the aaaeaament roll will be held on Monday, September
29, 1980, at the Municipal Building, .at 5:00 P.M. or at such
later time aa Council ia able to bear it in its normal course,
prior to the final passage of the asaessment ordinance. In
addition, notice of time, date ~nd place of the hearing shall be
mailed to ~ach property owner to be assessed with the cost of
improvements, on or about the date of the 1st publication of this
Resolution.

2. Tb• wbole coat of.said improvements within the South
Section in Paving Diatrict No. 26 ia the amount of $73,522.26
said amount including coata of inapection, collection, incidentals
and intereat as •lloved by law. Th• City of Englewood will pay
approxi .. tely $11,654.76 toward the total cost, leaving the amount
of $61,867.50 to be asaeaaed against the property specially
benefited and included with the South Section in the District • .

fortb in the aa .. aa .. nt roll filed with the City Council.
3. That any cc.plaints or objections which may be made
in writing by tbe owner• of land within the District, to the City
Council and filed in tbe office of the Director of Finance on or
before Thuraday, Septeaber 25, 1980, will be considered and heard
by the City Council at the meeting of the City Council, on Monday,
Septeaber 29, 1980.
4. Any complaint or objection to the validity of the
a•••••••nta or the proceeding• taken therefor shall be deemed
waived unl••• preaented in writing at the time and in the manner -••t forth above.
5. · That if any one or 1DOre sections or parts of this
Resolution ahall be adjudged unenforceable or invalid, such
judg••nt ahall not affect, impair or .invalidate the remaining
proviaiona of this Resolution, it being the intention that the
various proviaiona hereof are severable. ·
