SERIES OF 1982 A RESOLUTION PROVIDING FOR A PROCEDURE BY WHICH COMPLAINTS OF NON-BARGAINING UNIT EMPLOYEES MAY BE RESOLVED BY SUPERVISORS, DEPARTMENT HEADS, OR CITY MANAGER. WHEREAS, the citizens of the City of Englewood adopted a Charter amendment entitled "Englewood Labor Relations and Career Service System -1981" on March 24, 1981 which became effective within twenty (20) days thereafter; and WHEREAS, the City of Englewood adopted an Ordinance revis- ing Title V of the 1969 Englewood Municipal Code on December 21, 1981 to partially implement the requirements of the Charter amend- ment; and WHEREAS, newly adopted '69 E.M.C. §5-3-6 requires the adop- tion of a complaint resolution procedure for employees not members of a bargaining unit; and WHEREAS, the City deems it in the best interest of the City informally to resolve complaints for such employees, if possible, and thereafter to provide a formal procedure by which complaints may be resolved by supervisors, departments heads, or, ultimately, by the City Manager as provided in the Charter; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: 1. There is hereby established the following complaint resolution procedure applicable to non-barg aining unit employees subject to the Career Service S y stem of the City of Englewood. A complaint is a claim alleging a violation or misinter- pretation of the application of City policies regarding non- bargaining unit employees' terms and conditions of employment . set forth in Resolutions Nos. 54, 55, and 56, Series of 1981. The purposes of the following steps are to facilitate a means of communication between the City administration and non-bargaining unit employees and to provide those employees a means to express and resolve their concerns over matters relating to their benefits provided in Resolutions 54, 55, 56. This complaint resolution pro- cedure shall not be applicable to evaluation, demotion, supervision, or discharge. INFORMAL RESOLUTION STEP I. Within 15 days after its occurrence, or the date on which the employee should hav e become aware of it, the employee shall discuss his/her complaint with his/her immediate supervisor. The complaint shall be discussed verbally and, if settled, no further action is necessary . • '1 ... FORMAL RESOLUTION STEP II. If the complaint is not resolved on an informal dis- cussion basis, the complaint shall be reduced to writing and signed by the employee and submitted to the immediate supervisor. Employees using the Dispute Resolution Pro- cedure should explain in writing the nature of the dis- pute, what attempts the employee took to resolve the dispute, and the requested remedy . The immediate super- visor shall investigate the complaint and provide a written response to the employee within ten (10) working days of the date of submission. S TEP III . Within five (5) working days from receipt of the super- visor's written response , the employee, unless satisfied with the supervisor's response, shall submit the complaint in writing to the appropriate department head who shall investigate the complaint and submit a written answer to the employee within ten (10) working days. STEP IV. If the complaint is not settled at the department head level, the employee, within five (5) working days from receipt of t h e department head's answer , shall submit the complaint in writing to the City Manager. The City Manager may conduct an investigation if deemed appro- priate and shall provide an answer to the employee within five (5) working days, which answer shall be final and the complaint shall be considered resolved. Attest: If the dispute is resolved at any earlier step in the resolution procedure, a written statement to that effect should be made and signed by the employee and presented to the employee's department head. A copy of the resolved dispute shall also be provided to the Director of Employee Relations. ADOPTED AND APPROVED this <;-tfi day of To~ , 1982. -2- I, Gary R .
