A RESOLUTION AUTHORIZING THE NOTIFIC A~!ON
OF PROPERTY OWNERS OF ASSESSMENTS WIThIN T.aE
NORTH SECTION ' IN PAVING DISTRICT NO. 26 AND
ESTABLISHING A DATE FOR A PUBLIC HEARING ON SAID
ASSESSMENTS,

WHEREAS, the stree t paving, curb, gutter and sidewalk
impro~eme nts within the North Section in Paving District No. 26,
in Englewood, Colorado, have been satisfactorily c ompleted and
have been accepted by the City of Englewood1 and
WHEREAS, a statement showing the whole cost of said
improvements and a proposed apportionment of the same against the
property within the North Section in the District has been filed
with the Director of Finance, and
WHEREAS, the City Co uncil has considered the speci al
benefits accruing on each lot or tract of land within the North
Section in the District by reason of the making of the improve-
ments and has determined that the apportionment of the assessm ent s
for s aid im provements, as set forth in the assessment roll, is in
accordance with such benefits;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO:
1. That the Director of Finance i s hereby authorized
a nd directed to notify the owners of the prope rty to be assessed
fo r said improvements by publication of this Resolution in thr ee
consecutive weekly issues of The Englewood Sentinel, a newspaper
published and of general circulation in the City of Englewood,
that said improveme nts have been completed and accepted, that the
cost thereof has been apportioned according to benefits . and that a
he aring on the assessment roll will be held on Monday, December
6, 1982, at the Mun i cipal Building, at 7 :30 P.M, prior to the
fin al pas3age of the assessment ordinance, and which date is not
le ss that 15 day s afte r the first publication of the notice of
hearing. In addition, notice of time, date and place of the
hearing shall be mailed to each property owner to be assessed with
the cost of improvements, on or about the date of the lat publica-
tion of this Resolution.
2. The whole cost of said improvements within the North
Section in Paving District No. 26 is the amount of $81,835.59,
said amount including costs of inspection, collection, incidentals
and interest as allowed by law. The City of Englewood will pay
approximately $50,017.37 toward the total cost, leaving the amount
of $31,818.22 to be assessed against tile property specially
benefited and included with the North Section in the District,
Th e amount to be assessed against each lot or t 'ract of land is set
forth in the assessment roll filed with the Ci ty Council.
J. That any complaints or objections which may be made
in writing by the owners of land within the District, to the City
Council and filed in the office of the Director of Finance on or
be fore Thursday, December 2, 1982, will be considf,red and heard
by the City Council at the meeting of the City Council, on Monday,
December 6, 1982.
4, Any complaint or objection to the · validity of the
assessme n t s or the proce e dings taken therefor shall be deemed
waived unless p resented in writing at the time and in the manner
set forth above.
5. That if any one or more sections or parts cf this
Resolution shall be adjudged unenforceable or invalid, such
judgment shall not affect, impair or invalidate the remaining
p rov is ions of this Resol ution, it being the intention that the
vari ous provisions hereof are severable.
