WBBRBAS, the City Council of Englewood, Colorado, has
deterained that. it i• neceaaary to create a special improvement
diatrict within· the City, for th• purpose of constructing and
inatallin9 atr .. t paving, curb and gutter and sidewalk improvements,.

aa .. t forth in this reaolution, and to assess the cost of the

improvement• and included within the diatrict1 and

Chapter 14 of the Municipal Code of the City, the City Council
ha• determined to construct and inatall such improvements,
provided, however, that the City Council shall consider all protests
and objection• that may be made in connection with the proposed

BB IT RBSOLVBD BY TBB CITY COUNCIL OP THE CITY OF
BllGLDIOOD, COLORADO:
1. That the City Council ha• determined there exists
a neceaaity for the construction and inatallation of the street
paving, curb and gutter and sidewalk improvements, together with
neceaaary incidental•, on tho•• streets and avenues which are
more particularly set forth in the notice of hearing, and to
create a special illprov ... nt district for such purpose.
2. That the Engineer's reports, together with the
preliainary detail•, apecificationa, estimates of cost, maps and
schedule• prepared and filed with the City Clerk be and the same
are hereby approved and adopted by the City Council for use in
the construction and installation of the improvements to be made
in said illprovement district •

property to be ·included within the diatrict for said improvements
shall be due and payable within thirty days from and after the
final publication of the ordinance aaaeaaing the whole actual cost

provided, however, that any owner who shall pay the entire amount
of the •••••.-.nt within aaid period of time shall be entitled
to an allowance of 5t of the AJIOUllt of the aaaesament. In the
event any owner of r .. 1 eatate ahall fail to pay the whole of

property •ball be payable in ten (10) equal annual installments

aaaea ... nta will be established by ordinance to be adopted by the
City Council at a later date. The firat of said installments of
principal and intereat shall be due and payable at such time as

particularly deacribed in the Notice hereinafter set forth. ·
6. That there shall be prepared an ordinance creating
within ta. corporate liaita of the City a apecial improvement
diatrict to be known •• Paving District No. 26 providing for the
conatruotion and inatallation of the improvements, all as described
in thia Reaolution, and in accordance with the preliminary report,
plana, aapa, apecificationa, detail• and estimates of costs of the
Bngin .. r, herein referred to and now on file in the office of the
Director of Public Worka. The propoaed ordinance will be considered
for paaaage on firat .reading by the City Council at a regular meet-
ing thereof to be held on March 19, 1979.
7. llotice of the public hearing on the creation of
the diatrict ahall be published once a week for three weeks in
the Englewood Herald Sentinel, a nevapaper of general circulation
in the City. In addition, a copy of auch notice shall be mailed,
poata9e prepaid, to each known ownor of real property within the
propoaed 4iatrict.

DISTRICT IN ENGLEWOOD, COLORADO, TO BE KNOWN AS
PAVING DISTRICT NO. 26, POR THE PURPOSE OF
COlfSTRDCTING AND INSTALLING STRBBT PAVING, CURB
AND GUT'l'BR AND SIDEWALK IMPROVEMENTS, TOGETHER
WITH NBCBSSARY INCIDENTALS, ON CERTAIN STREETS
AND AVENUES THEREIN, AND OF A PUBLIC HEARING
THBRBON.
All owners of real estate and property hereinafter
deacribed, and all persons qenerally, are hereby notified that
the City Council of Enqlewood, Colorado, pursuant to its own
order, haa adopted preliminary details, plans and specifications
for conatruction of street pavinq, curb and qutter and sidewalk
improvement•, in and for a proposed special improvement district
within the corporate limits of Enqlewood, Colorado, to be known
aa Paving Diatrict No. 26. Said persons are further notified as
followas
a) North Section -South Zuni Street from West Yale
Avenue ·to Weat Dartmouth Avenue.

l) The improvements to be constructed or installed
Necessary qrading and excavation, pavinq
with s• asphaltic concrete base course and
2• asphaltic concrete surface approximately
44 feet in width, concrete walks, curb and
qutter where not already installed: toqether
with appurtenances and incidentals on the
east one-half of South Zuni Street, from the
north side of West Yale Avenue to the north
side of West Dartmouth Avenue.
The west one-half of South Zuni Street,
between West Yale Avenue and West Dartmouth
Avenue, which is located within the city
limits of the City and County of Denver,
will be improved by the City and Count~ of
Denver at the same time, but the improvements
to the west half of the street, and the cost
thereof, will not be incl~ded in this District •

It is anticipated that the City of Englewood
will enter into an agreement with the City
and County of Denver, who will in turn enter
into an agreement with the Colorado Department
of Highways, relating to the advertisement
of construction bids, the award of the
construction contract, and certain other matters
relating to the construction of the project.
Thia section is receiving partial fun4ing through
the Urban Systems Federal Aid Program.
2) The description of the proposed district and
the property to be assessed with the cost of the improvements
shall be all of the real property fronting or abutting on South
Zuni Street between the termini hereinbefore described, including
the real property within one-half block of South Zuni Street.
Adjustment• for the assessment of costs will be made for irregular
and odd-•haped lots and parcels of property.
l) The probable total coat of the improvements to
be con•tructed and installed is $68,300.
•> The probable amount of the total cost which
the City shall pay ia approximately $30,000 •
5) The balance of the total coat which is not paid
by the City of Bnglewood will be assessed against the property
specially benefited by the improvements and included within the
District. Probable coats per front foot for said improvements are

The coats of paving to be constructed along the sides
of corner lots within said District shall be assessed against
properties within one-half block, or 300', of such intersections
and corner lots, whichever is smaller, on a zone basis in accord-
ance with benefits conferred on such properties •

and incidental• on east one-half of South Zuni
Street, from the aouth side of West Dartmouth
Avenue to the aoutb aide of West Floyd Avenue.
The west one-half of South Zuni Street, between
West Dartmouth Avenue and West Floyd Avenue,
which is located within the city limits of
the City of Sheridan, will be improved by the
City of Sheridan at the same time, but the
improvement• to the west half of the street,
and the coata thereof, will not be included in
this District. It is anticipated that the
City of Englewood and the City of Sherittan
will enter into an agreement relating to the
advertisement of construction bids, the award
of the construction contract, and certain other
matters relating to the construction o~ the
project.

c) It ia the intent of the City of Englewood to
con•truct the improvement• in the North Section of the District
under a aeparate contract from that of the South Section.
d) No aaaessments will be made for curbs, gutters and
aidevalk• in place which conform with the plans and specifications
for the propoaed improvement• and which are acceptable to the City

e) The cost of improving street, avenue and alley
inter .. ction• throughout the District will be paid by the City of
Bn9lewood.
f) Property owners are apecif ically referred to the
•chedul• of propoaed aaaeaamenta which will be on file in the
office of the Director of Public Works, from which the approximate
amount to be aa•e•aed against any particular lot or parcel or
property .. y be determined.
g) Upon completion of said improvements, or as soon as
the total coat thereof ia definitely ascertained, such cost shall
be apportioned to the property in the District. Notice of such
apportionment •hall be given and a Rearing will be held prior to
the adoption of an ordinance assessing such cost, all as provided
by law •
h) Said assessments will be due and payable without
d..-nd within thirty days from and after the final publication of
an ordinance aaaeaainq the whole coat of said improvements against
the real property in said Diatrict1 provided, however, that any
owner who •hall pay the full assessment within said period of thirty
day• •hall be entitled to an allowance of five percent (St). In
the event that any owner of real property shall fail to pay the whole
of •uch a••e• ... nt againat the property within said thirty days,
then the whole co•t of •aid improvement so assessed against the
property •hall be payable in ten equal annual installments of
principal. The firat of auch in•tallments of principal shall be
due and payable at such time as may be determined in and by the
aa•e••in9 ordinance, and the remainder of said installments there-
after until all are paid in full. The rate of interest to be paid
on unpaid and def erred in•tallmenta will be established by ordinance
to be adopted by the City Council at a later date.
i) A Rearing on the creation of the District will be
held by the City Council on Tuesday the 13th day of March, 1979,
at 8100 o'clock P.M. for the South Section (Dartmouth to Flord>
at the City Hall in Englewood. A public hearing shall be he d
prior to the final passage of such ordinance at the regular meeting
at 7:30 P.M. on Monday, April 2, 1979 •

· j) A Hearing on the creation of the District will
be held by the City Council on Tuesday the 13th day of March, 1979,
at 7:00 o'clock P.M. for the North Section (Yale to Dartmouth)
at the City Hall in Englewood. A public hearing shall be held
prior to the final passage of such ordinance at the reqular meetinq
at 7:30 P.M. on Monday, April 2, 1979.
k) Any person desiring to be heard upon the issue of
the creation of the District or upon the construction, installation
or iaprovement of the improvements involved, may appear at the
time and place set for the public hearing thereon for that purpose.
1) A map, estimate and schedule showinq the approxi-
mate amount to be assessed, and all resolutions and proceedinqs will
be on file and can be seen and examined by any person interested at
the off ice of the Director of Public Works at any time during
buaine•• hours on or prior to the date of hearing.

9. Should any one or more sections or provisions of
tbi• a.•olution be judicially determined invalid or unenforceable,
such determination shall not affect, impair or invalidate the
r ... inin9 provisions hereof, the intention bein9 that the various
provision• hereof are severable.
