A RBSOLUTIOH AUTll>RIZIHG TBB NOTIFICATION OP PROPERTY OWNERS OF ASSBSSllBll'l'S FOR PAVING DISTRICT HO. 23 AND ESTABLISHING A DATE FOR A PUBLIC BEARING ON SAID ASSESSMENTS. WBBRBAS, the street paving, curb, gutter and sidewalk iJaprov ... nt• in Paving District No. 23 in Englewood, Colorado, have been satisfactorily completed and have been accepted by the City of Bnglewood1 and WBBRBAS, a statement showing the whole cost of said improve- ment• and a propoaed apportionment of the same against the property within the Diatrict baa been filed with the Director of Finance1 and WBBRBAS, the City Council has considered the special benefits accruing on each lot or tract of land in the District by reason of the making of the improvements and has determined that the appor- tionment of the aaaea ... nt• for said impFovements, as set forth in the a••e•• .. nt roll, ia in accordance with such benefits1 NOW, THBRBFORB, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OP BNGLBllOOD, COLORADO, as follows: 1. That the Director of Finance is hereby authorized and directed to notify the owner• of the property to be assessed for said improv ... nt• by publication of this Resolution in three consecutive weekly issue• to the Englewood Herald-Sentinel, a newspaper published and of general circulation in the City of Englewood, that aaid improvements have been completed and accepted, that the cost thereof ha• been apportioned according to benefits. That a hearing on the a••e•• .. nt roll and a hearing on the Ordinance levying the aaaeaaments will be held on Monday, May 14, 1979, at the Municipal Building, at 7:00 P.M., prior to final passage of the aaae•• .. nt ordinance. In addition, notice of the · time, date, and place of each hearing shall be mailed to each property owner to be asaeaaed,with the cost of improvements, on or abOut the date of the firat publication of this Resolution. 2. The whole cost of said improvements within Paving District No. 23 is the a110unt of $312,401.27, said amount including costs of inspection, collection, incidentals and interest as provided by law. The Urban Syate .. Highway Program will pay $224,880.86 toward -7- • • • the total cost; the City of Englewood will pay $28,869.45, leavinq the amount of $58,650.96 to be assessed against the property specially benefited and included within the District. The amount to be aaaeaaed against each lot or tract of land is set forth in the aa~e•ament roll filed with the City Council. 3. That any complaints or objections which may be ~ade in writing by the owners of land within the District to the City Council and filed in the off ice of the Director of Finance on or bafo~e Thursday, May 3, 1979, will be considered and heard by the City ~ouncil at the meeting of the City Council on Monday, May 14, 1979. The City Council shall also hold a public hearinq at the same ti.lie on the Ordinance levyinq the assessments prior to the final passaqe thereof. 4. Any complaint or objection to the validity of the assess- ments, or the proceeding• taken therefor, shall be deemed waived unless presented in writing at the time and in the manner set forth above. s. That if any one or more sections or parts of this Resolution shall be adjudged unenforceable or invalid, such judC)Jlent •hall not affect, impair or invalidate the remaininq provision• of this Resolution, it beinq the intention that the various provisions hereof are severalbe.
