HomeMy WebLinkAbout1978 Resolution No. 027,,,, , • RESOLUTION NO. 27 , SERIES OF 1978 A RESOLUTION RELATING TO THE ENGLEWOOD MUNICIPAL COURT. WHEREAS, over the past years an administrative procedure has development whereby the Englewood Municipal Court and its budget has been placed under the supervision and control of the Department of Finance within the Executive branch of the City government: and WHEREAS, on February 2, 1978, Judge Louis Parkinson of the Municipal Court by Memorandum to City Council set out his objections to said procedure and reconmended subtative changes and modifications thereto: and WHEREAS, the City Council has reviewed the relation- ship of the ~udicial branch to other branches of the Englewood City government as set out in the Charter and Ordinances and find that said procedure and practice above set out to be inconsistent with and at variance with the express provisions of sa i d Charter and Ordinances. • NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL . OF THE CITY OF ENGLEWOOD, as follows: • 1. That the Municipal Court is a separate and indepe nde nt fun ction of City government co-equal with the Ex e cu t ive and Legislative branches thereof. 2. Th a t th e Municipal Court budget shall henceforth be s e parate and dis ti nct from the budget of any other department or bra nch of City gove rnm e nt and shall be subject to approval by the City Coun c il. 3. That the Municipal Judge is the head of the Municipal Court system and shall preside over the same with full authority to supervise and direct its operation and its personnel subject to the Home Rule Provisions relating to the Englewood Career Service System.
