JO , SERIES OF 1977 A RESOLUTION DECLARING THE INTENT OF THE CITY COUNCIL OF THE CITY OF ENGLEM>OD, COLORADO, TO APPROVE THE WHOLE COST OF THE IMPROVEMENTS MADE IN AND FOR SIDEWALK IMPROVE- MENT DISTRICT NO. 76 IN THE CITY OF ENGLEWOOD, COLORADO; TO APPalVE AND CONFIRM THE APPORTIONMENT OF SAID COSTS AND ORDERING PUBLICATION AND MAILING OF NOTICE THEREOF TO THE OWNERS OF PROPERTY TO BE ASSESSED WITHIN THE DISTRICT; AND TO APPROVE THE COMPLETION OF SAID DISTRICT. WHEREAS, the City Council of the City of Englewood, Colorado, pursuant to Article x, Section 107 of the Charter of the City of Englewood and the provisions of Title XII, Chapter 1, 1969, E.M.C., enacted Ordinance No. 34, Series of 1976, creating Sidewalk Improvement District No. 76, and pro\l ding for the construction therein of sidewalk improvements; and WHEREAS, the construction of such improvements has been completed and the total costs of such improvements have been reliably ascertained • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: 1. That subject to the provisions and conditions contained within the said Charter and Ordinances, City Council hereby declare• that it is its intent to approve the whole cost of the improvements made in and for Sidewalk Improvement District No. 76, to approve and confirm the apportionment of said costs to each lot or tract of land in said District, and to assess a share of said cost against each lot or tract of land in the District, and to approve the completion of said District. 2. That a Public Hearing upon said assessments will be held before City Council at City Hall, 3400 South Elati, Englewood, Colorado, to conunence at 7:30 o'clock P.M. on Monday, March 14, 1977, and that Notice of the proposed assessments be given by the City Clerk and published in the Englewood Herald Sentinel, a newspaper published and of general circulation in said City, in three (3) consecutive weekly editions, therein giving Notice to the owners of the property to be assessed of the matters and things required by law. At or about the time of the first publication, Notice shall also be given by prepaid mail to all known owners of property to be assessed with the cost of said improvements. -1- • • • 3. The Notice to be published shall be in sub- stantially the following form: NOTICE OP PUBLIC HEARING UPON THE COSTS AND ASSESSMENTS FOR SIDEWALK IMPROVEMENT DISTRICT NO. 76, CITY OP ENGLEWOOD, COLORADO, AND OF A HEARING UPON A BILL FOR AN ORDINANCE APPROVING SAID COSTS AND ASSESSMENTS. All owner8 of real eatate and property located in Sidewalk Improvement Diatrict No. 76, created by Ordinance No. 34, Serie• of 1976, City of Englewood, Colorado, and all persona generally, are hereby notified that the con- struction of the i111provementa for Sidewalk District No. 76 baa been completed and the coats thereof have been ascer- tained, and that the City Council ia of the intent to approve and confirm the apportionment of said costs to each lot or tract of land in said District: to assess a share of said costs against each lot or tract in said District1 and to preacribe the manner of collection and payment of said assessments: and that the City Council at its reqular meeting on February 7, 1977, adopted a Resolution setting forth its intent to approve said costs and assessments • Said persons are further notified as follows: (a) The whole cost of said improvements is the aum of $53,064.65. (b) Of said awn of $53,064.65, the City of Engle- wood will pay $11,216.20, leaving a balance of $41,848.45 to be assessed aqainat the real property in said District.
