RESOLUTION NO. 18 , SERIES OF 1976
A RESOLUTION ADOPTING FINDINGS OF FACT AND CONCLUSIONS IN
CASE NO. 7-76, APPLICATION FOR THE REZONING OF LANO WITHIN
THE CITY OF ENGLEWOOD, COLORADO FROM R-2-A TWO-FAMILY RESIDENCE
DISTRICT, TO R-2-C, MEDIUM DENSITY RESIDENCE DISTRICT.
WHEREAS, pursuant to Section 22.3 of the Comprehensive
Zoning Ordinance, a Public Hearing was held before the City
Planning and Zoning Commission on January 6, 1976, to rezone
a certain parcel of land within the City from R-2-A, Two-
Family Residence District to R-2-C, Medium Density Residence
District; and
WHEREAS, said Planning and Zoning Conunission has
considered the proposed amendment and map change and has
submitted its favorable recommendation to the City Council
therefor; and
WHEREAS, pursuant to Section 22.3 of the Comprehensive
Zoning Ordinance , a Public Hearing was held before the City
Council on March 22, 1976 to rezone said parcel according to
the above designation; and
WHEREAS, the Council has reviewed the evidence taken
in the form of testimony, statements, reports and documents
filed in the above rezoning application,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BNGLEWCX>D, COLORADO, as follows:
Section 1.
That the Findings of Fact and Conclusions contained
in Case No. 7-76 relating to the rezoning of a certain parcel
of land within the City of Englewood from R-2-A to R-2-C, pur-
suant to Section 22.3-2 of the Comprehensive Zoning Ordinance,
heretofore presented to the City Council by the City Planning
and Zoning Commission, are hereby approved and adopted.
Section 2.
That a verified copy of said Findings of Fact and
Conclusions are attached hereto and made a part of this Resolution
as though fully set forth •

A Public Hearing was held in connection with Case No. 7-76
on February 18, 1976, in the Council Chambers at the Englewood ·
City Hall. Th e following members of the City Planning and
Zoning Co .. ission were present: llr. Jorgenson, Mr. Ed Smith,
llr. Tanguaa, llrs. Wade and Mr. Williams.
The follo wing •embers of the Commission were absent:
llr. Jones, llr. Parker, llrs. Pierson and Mr. Don Smith.
FINDINGS OF FACT
Upon review of the evidence taken in the form of
testi11e>ny, prese nta t ions, repor~s and filed documents, the
co .. iss ion •akes th e following findings of fact:
That proper noti ce of the meeting to consider the
proposed zoning was g~ven by posting and publishing.
That th e area being considered is described as that
area bounded on the north by the centerline of East Kenyon
Avenue, on th e e ast by the centerline of the Sherman/Grant
alley, on the s outh by the centerline of East Oxford Avenue
and on the west by the centerline of the Broadway/Lincoln
alley.
That the area being considered was previously zoned
R-2-A, Two-faaily Re side nce, which zone district was repealed
by Ordinance No. 30, Series of 1975 .
That the land to the north of the area which is being
considered is zoned R-3, High Density Residence and R-2,
Mediua Density Residence: to the east of the subject area, the
land is zon e d R-1-C, Sing l e -family Residence; to the south,
the land is zoned R-1-C, Single-family Residence and R-2,
Mediua Density Residence; and to the west, the land is zoned
B-2, Business .

That the subject area includes eight blocks and is
situated between a single-fa•ily residential develoi:aent on
the ea9t and n bm:sinrRR rfiRtrict on the woAt. Flood Junior

dovolopmont .1H lo tho north, nnd the area to the south is a
dovelo.-«'nt or prtaarlly Htnglo-faaily houses with some two-
ta•ily residences interspersed throughout.
That the sub.J•'Cl nroa was largely developed with
•inale-faaily residences 11e>re than thirty years ago; how-
ever, there were soae residences designed for two-family use
throushout tho area.
That within the subject area, there are now approximately
144 single-faaily units, 31 two-faaily units, seven three or
four-faaily units, and one eight-faaily unit.
That there are approximately three undeveloped sites
within the subject area at this time.
That the single-t'aaily and two-family units would be
peraitted uses and would aeet the requirements of the R-2-C,
lledlUll Density Zone District, and the units in excess of that
density could continue to be used as Non-Conforming Uses.
Tbat consistent with accepted Planning practice, the
R-2-C, MediU11-Density Residence District zoning would serve
as a "buffer" between the business district to the west and
the aingle-faaily residence district to the east.
That the proposed R-2-C Medium Density Residence
District would be in conformance with the Comprehensive Plan.
CONCLUSIONS
That proper public notice of the Public Hearing was
given by both posting the property and publishing in the
official City newspaper.
That the area which was the subject of Case No. 7-76,
which area is proposed to be zoned R-2-C, Medium-Density Resi-
dence, is one in which single-family and two-family units are
and can be adequately accommodated, but a higher density develop-
•ent would not be coapatible with the existing development.
That the proposed R-2-C, Medium Density Residence
District zoning would provide a suitable transition between
the Business District to the west of the subject area and the
single-faaily residential area to the east .

That the proposed R-2-C, Mediua Density Residence District
would exclude the construction of new dwellings in excess of a
two-family density and would protect against encroachment of
general co1mercial or industrial uses.
That the proposed R-2-C, Medium Density Residence zone
District will continue to conserve and stabilize the value of
property, secure safety from fire and other danger, prevent un-
due concentration of population and traffic and proaote the
health, safety, •orals and the general welfare of the public
and would i•ple•ent the Coaprehensive Plan of the City of
Inglewood, Colorado, which plan was adopted by Resolution No.
28, Series of 1969 •
